The US Trustee also asked that it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation, Erik Haas, was quoted by Bloomberg saying that J&J intends to file a response in the appeals court, calling the request a “desperate and legally deficient attempt” by a select group of law firms with conflicts of financial interests.
May 1st, 2023 Update: One frequently asked question is how plaintiffs and their attorneys turn around $8.9 billion. Of course, it’s quite a sum. There are a lot of victims. Is talc in vitamins safe. And these are really good claims for plaintiffs. We were reminded recently when two talc cases resulted in big verdicts for plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon led to a verdict worth $18.1 million. A month later, another mesothelioma-related talc case went to hearing in South Carolina and resulted in an award of $29 million to the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. which is one of the largest manufacturers of talc in U.S.
April 30, 2023 Update: When J&J initially attempted to pull the talcum powder litigation into bankruptcy, it came with an offer to set aside $2 billion to settle the case. This time, however, J&J has increased the offer to $8.9 for talc-related plaintiffs if they agree to a bankruptcy settlement and they have the support of a substantial section of the talc victims and their lawyers. Is talc in vitamins safe. But with 75% of talc plaintiffs, which is needed for approval of the bankruptcy plan is not an easy task due to the sheer number of lawyers with massive inventories of baby powder-related lawsuits, opposed towards the agreement.
What is the solution to this impasse? More billions.
April 25 2023 Update: Talc patients have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially strained. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is talc in vitamins safe. It was the 3rd Circuit dismissed its first Chapter 11 case in January, saying LTL was not eligible for bankruptcy relief because it did not show financial difficulties.
The claimants contend that the 2nd Chapter 11 case is an misuse of the bankruptcy system and it is being pursued in bad good faith. J&J asserts that the bankruptcy settlement is backed by “significant support” from the firms that represent about 60,000 potential people who are claiming. It’s fair to say that plaintiffs’ lawyers and victims are divided over what they believe is an $8.9 billion deal.
April 21st, 2023 Update A bankruptcy judge has decided the company Johnson & Johnson must face new lawsuits alleging that the firm sold a baby powder that contained a chemical that causes cancer. April 13, 2023: Update on the most important news is the $8.9 billion over the course of 25 years settlement offer. Lawyers representing cancer victims who are part of the MDL group action promised to fight the settlement alongside talc claimants. Why? They think it is not enough to pay for those suffering from cancer who are 70,000. Is talc in vitamins safe. They argue that J&J should negotiate a bigger settlement or litigate individual claims if the latest bankruptcy is declared unconstitutional.
There is a different group of lawyers outside of the leadership group in that class action. They have amassed many thousands of cases. The group is seeking to settle in what many believe to be lower than what the victims should be paid. Their argument is two-fold. First, they argue that the settlement of around 100,000 dollars per plaintiff – is fair.
That is a hard argument to present. However, their second argument has more force: victims should be no longer patient and demand their money today.
April 12, 2023 Update: People are wondering if J&J can file for bankruptcy again. The answer is complicated and confusing. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future talc-related lawsuits definitively. Also, it believes it can pay less in the event of an element of bankruptcy that puts pressure to settle. Is talc in vitamins safe. Driving past more than 400 years in American past, the company argues that bankruptcy benefits all parties as it distributes settlement payments more equitably and effectively than trial courts, where some litigants receive significant award while others do not.
The essence in the 3rd Circuit decision was this is not a matter of a profitable company making subsidiaries to meet the legal responsibility and declare bankruptcy, which is what Congress contemplated when drafting the Bankruptcy Code. However, it also stated the company was in financial difficulty because J&J offered unlimited financing.
This is why J&J jumped on the unlimited funding aspect of the agreement but did not pledge to offer unlimited funding for litigation. The company claims that its revised financing arrangements with its subsidiary addresses the appeals court’s concerns while still providing funds for claims. As if providing victims with lower amounts of money would resolve the problem at hand.
Attorneys representing cancer victims who oppose the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole is not exempt attorneys representing the victims claim it the most significant “fraudulent move that has occurred in United States history.”
Despite the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way to try and push the $8.9 billion settlement to keep the pressure on plaintiffs.
April 10, 2023 Update: Bloomberg provides an insightful article about a new law that has been passed in New Jersey that is shedding new light on litigation funding in the Class action suit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a portion of any winnings. J&J is now willing that it will pay $8.9 billion to settle any lawsuits.
The involvement of funders is publicly available due to the New Jersey court rule requiring the disclosure of certain information about funding sources outside of the. This rule is intended to respond to the increasing calls for regulation of the litigation funders. J&J faces over 60,000 claims when you combine state and federal Baby Powder lawsuits. Third-party funding for mass tort lawsuits is not without its pros and cons. But there is no question that we are witnessing the ways that third-party funding can even the playing field between people as well as large corporations in court.
April 4, 2023 Update: It is enjoyable to see the worm turn in this lawsuit. J&J was hit again this week when they were denied by the Third Circuit denied J&J’s request to keep the automatic stay in place while J&J appeals a bankruptcy ruling before the U.S. Supreme Court. It has halted thousands of talcum powder cases and prevented new lawsuits from arising ever since J&J began the controversial plan to spin the talc liabilities off into a bankrupt entity over one year in the past. Is talc in vitamins safe. After the 3rd Circuit ruled that this bankruptcy was not valid only a few months back, the stay was lifted. J&J wanted to see it continued pending its SCOTUS appeal. However, the answer was no.

Seven new talc-related lawsuits were brought into the MDL in the past month, bringing the total number of pending cases up to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee has now demanded that authorities from the U.S. Government Accountability Office (GAO) start an investigation into the amount J&J Talc products have cost the government in the years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of failing to recognize the dangers of its talc products over many years, while tax dollars were utilized to treat people injured by exposure to the products. The demand comes just weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
Is talc in vitamins safe. J&J has to begin making fair settlement offers to victims to the process of putting all this behind. It’s a mark on one of the greatest businesses.
