April 13 2023: Update on the most important update is about the $8.9 billion over 25 years of settlement. Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future talc litigations in a definitive manner. It thinks it will pay less if there is the bankruptcy element which applies pressure to negotiate a settlement. Why does talc cause cancer. Driving past more than 400 years in American past, the company argues that bankruptcy benefits everyone by dispersing settlements more fairly and effectively than trial courts in which some litigants receive substantial settlements while others get nothing.
The basic tenet in this 3rd Circuit decision was this is not a case of one that makes a profit, but an affiliate to accept the legal burden and declare bankruptcy Congress had in mind when it came to drafting the Bankruptcy Code. Lawyers representing cancer patients who oppose the agreement counter this with what you conclude is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole was not spared attorneys representing the victims claim it the largest “fraudulent transfer ever in United States history.”
Despite the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way to try and push the $8.9 billion settlement to keep the pressure on plaintiffs.

The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) concerning talc products in exchange for a percentage of any settlements. J&J is now willing an offer of $8.9 billion in settlements for all lawsuits.
The involvement of the funders is publicly available due to the New Jersey court rule requiring the release of certain details about outside funding backers. The law is designed to address the rising calls for the regulation of litigation funders. J&J has more than 60,000 claims when you include federal and state child powder-related lawsuits.
