Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future talc-related lawsuits definitively. It thinks it can get a lower rate when there is a bankruptcy component that applies pressure to settle. Dangers of baby talc. In a quest to cover hundreds of years of American time, the business believes that bankruptcy is beneficial to everyone by dispersing settlement payments more equitably and effectively than trial courts in which some litigants receive substantial award while others do not.
