April 13 2023: Update on the big update is about the $8.9 billion over 25 years settlement offer. April 12 2023 Update: Many are asking how J&J can go through bankruptcy once more. The answer is complicated and complex. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only means to address both present and future talc litigations in a definitive manner. That is, it thinks it can get a lower rate when there is an element of bankruptcy that puts pressure for a settlement. Is talc in makeup cancer. Going back to hundreds of years of American time, the business believes that bankruptcy is beneficial to everyone by dispersing settlements more equally and effectively than trial courts, where some litigants receive significant awards while others receive nothing.

Attorneys representing cancer patients who oppose the agreement counter this by arguing that the plaintiff is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole was not spared: victims’ lawyers call it the most significant “fraudulent transaction that has occurred in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. However, it’s a means to try and push the $8.9 billion settlement, and to keep the pressure on plaintiffs.

Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) over talc products in exchange for a share of any wins. J&J is now offering to pay $8.9 billion to settle all lawsuits.
The involvement of the funders is public knowledge due to an New Jersey court rule requiring the release of certain details regarding outside funding backers. The rule aims to tackle the growing demands for the regulation of litigation funders. J&J has more than 60,000 claims when you combine federal and state child powder-related lawsuits. February 25 2023 Update: A Congressmen from Tennessee is now demanding that be the U.S. Government Accountability Office (GAO) initiate an investigation into the amount J&J Talc products have cost the government over the many years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of not recognizing the risks of its talc products over many years, while tax dollars were spent on treating people who suffered injuries from exposure to the product.
