Johnson & Johnson (JNJ.N) has set aside $400 million to address U.S. state consumer protection actions as part of its larger $8.9 billion settlement of allegations that it’s Baby Powder and other talc products cause cancer. Johnson amendment lawsuit.

J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm plans to pay different kinds of cancer patients in bankruptcy settlement. Johnson amendment lawsuit. J&J has said that its Talc products are safe, and do not cause cancer. It is attempting for the second time to end more than 38,000 lawsuits filed in bankruptcy and prevent new cases from being filed in the near future.

Many states had initiated consumer protection actions against J&J prior to the time that LTL’s bankruptcy filing stopped those investigations from proceeding in 2021. Johnson amendment lawsuit. New Mexico and Mississippi had already brought suits for damages against Johnson & Johnson before then as well as the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative subpoenas or demands in LTL’s court filings.

New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy, joining cancer victims as well as their counterparts from the U.S. Justice Department’s bankruptcy watchdog, who have argued that a successful business like J&J can’t benefit from bankruptcy protections intended for those struggling with debt.
The first time LTL attempted to settle the bankruptcy-related lawsuits was dismissed following similar arguments. A U.S. appellate court ruled in favor of LTL did not have “financial financial distress” and therefore not eligible under bankruptcy law. Johnson amendment lawsuit. LTL had filed for bankruptcy again just over two hours after the dismissal, saying that its second attempt was different due to the fact that it had less money and more support for the possibility of settling.

New Mexico and Mississippi said in their motion to dismiss that LTL’s latest bankruptcy violation of state law enforcement powers by attempting unilaterally to cap the liability of the company for state consumer protection measures.

LTL’s recent filings also provided additional details about how the company plans to evaluate and pay for cancer claims should the bankruptcy plan be approved.

The most significant payments under the settlement would be $500,000 for people diagnosed with mesothelioma terminal prior to age 45, and $260,000 for patients diagnosed with terminal ovarian cancer before age 45.

From there, the proposed settlement offers discounts based on the severity and type of the cancer, the person’s age, history of using talc and other factors. Johnson amendment lawsuit. For instance someone who regularly used the talc product on a regular basis, had an ancestral history of ovarian cancer and was diagnosed Stage II cancer of the ovary when she was 55 may qualify for a $21,125 payout according to the plan.

Judge orders J&J, talc opponents to engage in settlement talks.

Following another hearing in Johnson & Johnson’s effort to use a Texas Two-Step bankruptcy strategy for talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the company and those opposed to the move to conduct talks to reach a settlement, Bloomberg reports.

With its second bankruptcy attempt for LTL management, a subsidiary founded by J&J to settle claims – the company offered a settlement amounting to $8.9 billion. Johnson amendment lawsuit. While one firm representing plaintiffs supports the deal, another group is opposed to the offer.

This week, the opposition group, called the Official Committee of Talc Claimants and urging the bankruptcy court to dismiss this case asserting that LTL can not be considered to be in financial trouble.

“The filing is a desperate and legally ineffective attempt by a small number of law firms to try to stop claimants from voting on the resolution plan – a plan the vast and growing majority of claimants approve of,” J&J’s litigation chief Erik Haas, said in a statement. Johnson amendment lawsuit. “The law firms involved in their filing are financially oriented and have conflicts that do not align with, contradict and oppose the interests which their clientele. We will be submitting an appeal in the appeals court.”

Johnson amendment lawsuit. Clay Thompson, a lawyer for MRHFM who has more than 80 mesothelioma victims who have filed lawsuits against J&J for bankruptcy, told the company’s second bankruptcy try will fail.

“J&J publishes press release about how wonderful its plan is while simultaneously insisting that the plan’s details, including what the individual sick individuals would be treated to,” Thompson said in an email. “What does the company have to keep secret?”

Kaplan has instructed the sides to develop a new restructuring plan, with supervision from two mediators.

As of February 2022 Kaplan acknowledged J&J’s use of Chapter 11 to hasten a settlement that would free J&J from the hundreds of thousands of claims regarding its talcum products.

In January of this year an appeals court of the federal government overturned the verdict, ruling that the company was not able to be considered in “financial distress.”

When J&J’s attempt to make an appeal before the U.S. Supreme Court was turned down on April 1, J&J was granted a second petition for bankruptcy about two hours later. In response to that move, Kaplan froze the lawsuits for 60 calendar days to decide whether to allow an additional bankruptcy.

J&J’s unstoppable profit engine sputters after $6.9B talc litigation charge.

In the two Chapter 11 attempts, J&J has bought 19 months during which the cases were in limbo. Johnson amendment lawsuit. The company wants claimants to decide whether they want to accept the settlement. J&J will require 75% acceptance for the settlement to be approved.

In addition to the gang of talc lawyers who panned the company’s bankruptcy, the U.S. Trustee is an arm that is part of the U.S. Department of Justice is also submitting a motion to dismiss LTL’s bankruptcy second case.

In a filing this week, U.S. Trustee Andrew R. Vara wrote that the doors of bankruptcy courts are “open to honest but unfortunate debtors.” Those doors “are not accessible to those that don’t have a legitimate bankruptcy objective or seek to use bankruptcy to hinder or delay their creditors.” Vara continued.

In its own words, J&J maintains there is no conclusive evidence that its talc products, including its iconic baby powder, can cause cancer. J&J has taken the products of the market–first on North America in 2020–and the rest of the world this year.

J&J intends to steer clear of the cost of going to court. It has prevailed in the majority of the cases that were decided through trial, though some losses have been very harsh.
A well-known trial in Missouri resulted in a $4.7 billion verdict against the drug maker but was later reduced to $2.1 billion following appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
Overall, J&J has lost nine trial involving talc that are being appealed or concluded. In 41 trials 32 have resulted in a win by J&J or a mistrial, or plaintiff verdict that was dismissed in appeal. Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Johnson Amendment Lawsuit

June 2 2023 Update: In the trial for asbestos-containing talc in California yesterday, technical issues interrupted the opening statement by the defense lawyers. Johnson amendment lawsuit. Jurors who were watching from home via Zoom however, heard Johnson &Johnson’s lawyer express doubt about the 70s research asserting the presence of asbestos in their product, but the session abruptly ended.

The plaintiff had the opportunity to introduce the first of their witnesses, Arthur Langer. Langer explained that the existence of other minerals alongside the talc’s mineral content is inevitable. He testified that his team advised J&J in 1971 about the presence of chrysotile asbestos the company’s talc, albeit with just 0.1 percent. He also found more asbestos in 1976.

June 1, 2023 Update: Johnson amendment lawsuit. The first trial since J&J has decided to separate its Talc division and declare bankruptcy is an important turning point within the ongoing lawsuit saga. The trial began on Tuesday in the heartbreaking trial of a young plaintiff, diagnosed with an extremely rare and aggressive form of mesothelioma earlier this year. an illness that lawyers on both sides of the argument agree is a grave tragedy.

Opening statements laid bare stark differences in each side’s story. The plaintiff’s attorney took aim against Johnson & Johnson, alleging the use of deceptive tactics in research practices and throughout the litigation procedure. As per the lawyer Johnson & Johnson tried to alter the definition of asbestos, despite internal documents dating back to 1998 and 1994 that show asbestos fibers that were found in the tissues of the plaintiff are part of.

Johnson & Johnson’s uncertain $8.9 billion settlement deal hangs in the balance with the progression of this trial. Despite the distinctive nature of this mesothelioma-related case and its distinct issues compared to the majority of talcum powder lawsuits, a verdict favoring the plaintiff could be an enormous setback for J&J’s expectations of widespread acceptance of the settlement they have proposed among plaintiffs.

May 31, 2023 Update: Johnson and Johnson’s bankrupted talc unit has strongly defended its two-time Chapter 11 filing in the facing challenges from victims of talc injuries. In a written objection to the New Jersey bankruptcy court, the company argued that the case was vastly different from the earlier filing. The subsidiary emphasized the record-breaking commitment to $8.9 billion by J&J, the biggest settlement ever to be made in a mass tort bankruptcy case. Johnson amendment lawsuit. Not mentioned: how the amount of the settlement indicates that it is an equitable settlement. J&J also claimed support from various plaintiffs’ law firms representing over sixty thousand claimants. This is hard to verify but likely incorrect.

May 24 2023 Update: As of Johnson and Johnson’s bankruptcy filing in 2021 filing, the first trial on its cosmetic talc products that are believed to that contain asbestos is scheduled to begin jury selection on Monday in California at Alameda County Superior Court, which is a well-known place for plaintiffs. The plaintiff claims that his mesothelioma resulted from asbestos exposure in J&J’s product which that the company does not deny. The trial also involves six retailers accused of selling talc-containing products.

May 22nd, 2023 Update Lawyers in the 2nd J&J talc bankruptcy are now in a dispute over who should be chosen to fill the role of a the future claims representative, a role that is critically important to resolving the Talc claims. Johnson amendment lawsuit. Randi Ellis, a lawyer who frequently appears in MDLs throughout the United States was appointed as the claims representative in the first bankruptcy. J&J’s defense group wants Ellis to be appointed to that role yet again, but the lawyers for the talc plaintiffs are objecting because Ellis has an interest conflict which would prohibit her from taking on that role for the second time. The dispute stems from possibility that Ellis was involved in the drafting of the highly disputable second bankruptcy, which raises concerns about her capability to remain neutral. It’s true that this bankruptcy is likely to be dismissed regardless.

May 17, 2023 Update: The pretend company J&J formed to settle the talc litigation bankruptcy informed the New Jersey bankruptcy court that they have set aside $400 million to pay the allegations made by states who accuse the company of misleading advertising for its talc product. Johnson amendment lawsuit. It’s a $8.5 billion settlement for cancer victims. It’s difficult to imagine the scenario in which J&J could push the settlements of baby powder through with these numbers. Although J&J’s $8.5 billion offer might seem like a large sum initially, it does not look good after you calculate the figures. The settlement plan based on our rough calculations – would not pay victims much more than $100,000 per case. That is not enough.

May 15th, 2023 update: J&J might be facing lawsuit from an advocacy group that represents cancer victims. Johnson amendment lawsuit. The group claims J&J deliberately retracted an $61.5 billion contract for funding in conjunction with its affiliate, LTL Management LLC, to simulate financial distress and to validate the company’s Chapter 11 bankruptcy filing. The group claims that this move amounts to a fraudulent transfer of rights of compensation for victims. They will investigate J&J’s actions after the announcement of the denial of the first bankruptcy case of LTL.

May 10 2023 Update: Next week this week, this week the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to reject the second bankruptcy filing of J&J subsidiary LTL Management. However, in the meantime LTL Management has filed an Order calling for both parties to participate in a second settlement mediation with the hopes of achieving a global settlement deal can reached.

May 5th, 2023 Update: The talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging that its Talc products cause cancer due to asbestos exposure. Johnson amendment lawsuit. Over 2700 people have sued the company, and it was paying $1 million per month on legal defense. The company’s most recent $29 million verdict at the Supreme Court of South Carolina forced it to file for bankruptcy protection, arguing for a fair distribution of assets between talc claimants rather than being confiscated from the receiver. Other talc suppliers have also been forced to file for bankruptcy as a result of legal proceedings.

May 4 2023 Update: U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to reopen negotiations with lawyers who have rejected the proposed $8.9 billion settlement offer. At Trenton, New Jersey yesterday, the parties appeared before a judge to discuss the next steps for their second bankruptcy matter and Judge Kaplan has pushed for further settlement talks.

This is the best way to resolve the claims of J&J. A settlement for baby powder can be achieved. Johnson amendment lawsuit. But it’ll need more money – more billions of dollars coming from Johnson & Johnson.

Lawyers have a split opinion on whether to accept the proposal and not every client views this issue the same way their attorney does. A second bankruptcy proceeding is destined to fail as Judge Kaplan has scheduled a hearing in June to determine if she will remove the bankruptcy after the second.

May 3 2023 Update: A group representing cancer victims who are suing Johnson & Johnson (J&J) asked an order from they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation involving talc products. The group of talc claimants has filed a motion this week requesting for the Third Circuit to consider their case and then send it back the lower court, with instructions for dismissing the bankruptcy. Johnson amendment lawsuit. They also requested that the stoppage of tort litigation against J&J allow the litigation to continue.
LTL has filed for Chapter 11 protection once again after its bankruptcy filing was rejected in the Third Circuit earlier this year and offered an $8.9 billion payment. The committee believes that the recent ruling allowing LTL’s 2nd Chapter 11 to continue, in addition to halting trials against J&J and J&J, requires the immediate Third Circuit review. The US Trustee also asked that be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a reply to the appeals court calling the request a “desperate and legally inadequate plan” by a small number of law firms who have different financial interests.
May 1, 2023 Update: One common question that people ask is how could plaintiffs and their attorneys turn down $8.9 billion. Of course, it’s an immense amount of money. However, there are lots of victims. Johnson amendment lawsuit. These are an excellent arguments for plaintiffs. We were reminded of this recently with two talc trials led to huge verdicts for the plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon resulted in the verdict that was $18.1 million. In the same month, a different mesothelioma-related talc case went to trial at South Carolina and resulted in an award of $29 million to the plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. one of the most prominent suppliers of talc in the U.S.
April 30th 2023 Update: In the year 2023, when J&J first attempted to drag the talcum powder lawsuit into bankruptcy, it did so with an offer to reserve $2 billion for settlements. The sum was ridiculously low. There was no one among the talc victims who believed in the proposal. This time, however, J&J has increased the offer to $8.9 if the talc plaintiffs are willing to accept bankruptcy settlements and also has the support of a substantial part of the talc-related plaintiffs as well as their lawyers. Johnson amendment lawsuit. But 75% of the plaintiffs in the talc category, which is needed for approval of the bankruptcy plan is not an easy task since there are so many lawyers with large stocks of baby powder lawsuits that are opposed in favor of the deal.

What can be done to end the impasse? More billions.
April 25 2023 Update Talc cancer claimants have sought a court order to reject their Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially strained. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Johnson amendment lawsuit. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January and said that LTL was not eligible for bankruptcy relief because it did not show financial distress.

The claimants argue that LTL’s 2nd Chapter 11 case is an abuse of the bankruptcy system, and that it is being pursued in bad faith. J&J says the bankruptcy settlement receives “significant support” from companies representing approximately 60,000 claimants. It is fair to say that the plaintiffs’ attorneys and victims ‘ lawyers are divided on what they believe is an $8.9 billion offer for settlement.

April 21st, 2023 Update A bankruptcy judge ruled in favor of Johnson & Johnson must face new lawsuits alleging that the company sold a baby powder that contained a chemical that causes cancer. Although trials for Talc lawsuits are suspended for at least 60 calendar days, new lawsuits can be filed, and lawyers are able to begin preparing their cases. Johnson amendment lawsuit. Judges expressed skepticism about J&J’s absurd attempt to revive its strategy with a second bankruptcy case.

April 13, 2023 Update: most important story is that there’s an $8.9 billion over the course of 25 years offer for settlement. Lawyers representing cancer victims in MDL class action MDL collective action promised to fight the settlement alongside those who claim talc. Why? They think it is not enough for those suffering from cancer who are 70,000. Johnson amendment lawsuit. These lawyers argue that J&J should seek a bigger settlement or pursue individual claims in the event that the latest bankruptcy is declared unconstitutional.

There is a different group of lawyers outside of the leadership of the class action. They have amassed tens of thousands of cases. They want to settle the case now for what many argue is less than these victims deserve. The argument they make is twofold. First, they argue that the settlement, which is about 100,000 dollars per plaintiff – is fair.

It’s a difficult argument to prove. However, their second argument has more force: the victims can now not wait and they want to get their money right now.

April 12 2023 Update: Many are looking for ways J&J could file for bankruptcy once more. The answer is complex and confusing. Let’s try to simplify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only means to resolve both current and future talc lawsuits conclusively. That is, it believes that it will be less expensive if there is the bankruptcy element which applies pressure to negotiate a settlement. Johnson amendment lawsuit. Moving past more than 400 years in American history, the firm believes that bankruptcy is beneficial to everyone by dispersing settlement payments more evenly and effectively than trial courts where some litigants receive significant payouts, while others are left with nothing.

The gist in the 3rd Circuit decision was this is not a case of one that makes a profit, but a subsidiary to take the legal liability and declare bankruptcy Congress thought of when drafting its Bankruptcy Code. But it also said it was not in financial difficulty due to the fact that J&J assured it of unlimited funding.
This is why J&J did not hesitate to take advantage of the unlimited funding part of the holding and didn’t make any promises to fund unlimited lawsuits. J&J claims that its revised financing arrangements with its subsidiary address the appeals court’s concerns, while providing funds for claims. As if providing victims with less money would solve the overall issue.

Lawyers representing cancer victims who oppose the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s earlier ruling. The hyperbole wasn’t spared attorneys representing the victims claim it the largest “fraudulent move that has occurred in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really believe that this bankruptcy will last. It is however a method of pushing this $8.9 billion settlement, and to keep the pressure on plaintiffs.

April 10 2023, Update Bloomberg has an interesting report on a brand new law of New Jersey that is shedding new light on the funding of litigation in the Class action suit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) over talc products in exchange for a share of any winnings. J&J has now offered that it will pay $8.9 billion to settle lawsuits.

The involvement of the funders is public information because of an New Jersey court rule requiring the release of certain details regarding outside funding backers. The rule aims to address the rising calls for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you include state and federal child powder-related lawsuits. Third-party funding in mass tort claims has both pros and pros and. However, there is no doubt that we are seeing how third-party financing can help level the playing field for individuals and large corporations in court.

April 4, 2023 Update: It is fun to watch the worm turning in this case. J&J was hit again this week when the Third Circuit denied J&J’s request to keep the automatic stay in place during the time that J&J appeals an order granting bankruptcy in the U.S. Supreme Court. The automatic stay has halted the cases of talcum powder in a number of years and prevented the filing of new lawsuits ever since J&J started the controversial process to spin talc-related liabilities off into a bankrupt subsidiary over a year back. Johnson amendment lawsuit. When it was decided that the 3rd Circuit ruled that this bankruptcy was not legal some months ago, the stay was removed. J&J had hoped to have it remain in effect until its SCOTUS appeal. The answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance of the Supreme Court is willing even to hear the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay being officially lifted, the very first new cases were filed and incorporated into the Talcum Powder class action MDL in just over a year. Seven new talc lawsuits have been joined to the MDL over the last month which brings the total number of cases pending to 37,522.

February 25, 2023 Update The following information is available: A Congressmen from Tennessee is now demanding that be the U.S. Government Accountability Office (GAO) begin an investigation into the cost J&J product containing talc has cost the government over the many years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of failing to recognize the dangers of its talc products over decades while tax dollars were used to treat those who were injured through exposure to the products. The demand comes just weeks after J&J’s loss to the 3rd Circuit Court of Appeals.

Johnson amendment lawsuit. J&J must begin making reasonable settlement proposals to victims to begin to put all of this behind. It is a stain on one of the most prestigious businesses.

February 14 2023 Update: In a hearing today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
