J&J’s proposed settlement with talc would pay the sum of $400 million US state AGs. Are All Talcs Dangerous Or Just Johnson And Johnson .

Johnson & Johnson (JNJ.N) has put aside $400 million to settle U.S. state consumer protection actions as part of a broader $8.9 billion effort to settle allegations that its Baby Powder and other talc-based product causes cancer. Are all talcs dangerous or just Johnson and Johnson.

J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company intends to pay different types of cancer victims as part of the bankruptcy settlement. Are all talcs dangerous or just Johnson and Johnson. J&J has claimed that its Talc products are safe and will not cause cancer. J&J is seeking the second time to end more than 38,000 lawsuits filed in bankruptcy, as well as prevent new lawsuits from being filed in the near future.
LTL’s bankruptcy plans would deposit $400 million to a separate trust for claims brought in state courts by attorneys general claiming that J&J violated laws against unfair business practices in the State of New York and consumer protection laws by misinforming consumers about the safety of its talc products.

A number of states had already initiated consumer protection actions against J&J prior to LTL’s bankruptcy filing stopped these investigations from progressing in 2021. Are all talcs dangerous or just Johnson and Johnson. New Mexico and Mississippi had already filed suits for damages against Johnson & Johnson before then and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas according to court papers.

New Mexico and Mississippi have decided to declare LTL’s bankruptcy unfinished along with cancer sufferers as well as The U.S. Justice Department’s bankruptcy watchdog, who have claimed that a lucrative company like J&J cannot benefit from bankruptcy protections designed for the struggling debtors.
LTL’s first attempt at resolving the bankruptcy cases was dismissed following similar arguments. A U.S. appellate court decided the LTL had not been in “financial difficulty” and thus not eligible to receive bankruptcy relief. Are all talcs dangerous or just Johnson and Johnson. LTL had filed for bankruptcy again within two hours of the dismissal, arguing the second bankruptcy was different in that it had less money available and had more support for a settlement.

New Mexico and Mississippi said in their motion for dismissal that LTL’s bankruptcy renewal violates state law enforcement powers by attempting unilaterally to cap the liability of the company for state consumer protection measures.

LTL’s new filings also included more details on how the company plans to evaluate and pay for cancer claims in the event that the bankruptcy plan is approved.

The largest amount of money under the settlement would be $500,000 for people diagnosed with cancer of the mesothelioma ovary before age 45. Are all talcs dangerous or just Johnson and Johnson. The second payment would be $260,000 for those who have been diagnosed with ovarian cancer that is terminal before age 45.

From there, the proposed settlement offers discounts based on the severity and type of cancer, the individual’s years of age, their history of using talc and other factors. Are all talcs dangerous or just Johnson and Johnson. For example someone who regularly used the talc product on a regular basis, had the family history of ovarian cancer, and was diagnosed with the stage 2 ovarian cancer when she was 55 may be eligible for a $21,125 payout under the plan.

Judge ordains J&J, talc opponents to engage in settlement talks.

Following another hearing in Johnson & Johnson’s attempt to utilize a Texas Two-Step bankruptcy strategy to settle talc lawsuits and federal bankruptcy judge Michael Kaplan has ordered the firm and the people who opposed the plan to hold settlement talks, Bloomberg reports.

The second time it attempted to file for bankruptcy for LTL Management, a subsidiary set up by J&J to settle claims – the company proposed a settlement of $8.9 billion. Are all talcs dangerous or just Johnson and Johnson. While one firm representing plaintiffs is in favor of the settlement, a different group opposes the deal.

Earlier this week, the opposition group, called the Official Committee of Talc Claimants requested the bankruptcy court to disqualify the petition saying that LTL is not considered to be to be in financial trouble.

“The filing is a desperate and legally ineffective attempt by a handful of law firms to try to block claimants from voting on the resolution plan, a plan that the overwhelming majority of claimants favor,” J&J’s litigation chief Erik Haas, said in a statement. Are all talcs dangerous or just Johnson and Johnson. “The law firms that are behind this filing have financial interests that conflict with, differ from and oppose the interests they represent. We’ll soon submit an answer in the appeals court.”

Are all talcs dangerous or just Johnson and Johnson. Clay Thompson, a lawyer for MRHFM that is home to more than patients with mesothelioma who have filed lawsuits against J&J, said that J&J’s second bankruptcy attempt is likely to fail.

“J&J publishes press release describing how fantastic the plan is but simultaneously insisting that the plan’s details, including what individual sick people would actually receive–be kept secret,” Thompson said in the statement. “What does the company have to cover up?”

Kaplan has commanded the parties to devise a second strategy for reorganization, under the oversight and supervision of mediators.

In February 2022, Kaplan stated that J&J’s recourse to Chapter 11 to hasten a settlement that would free the company from the thousands of lawsuits regarding its talcum products.

In the month of January, an appeals court in the United States overturned the decision, deciding that the business could not be considered to be in “financial financial distress.”

After J&J’s make an appeal before the U.S. Supreme Court was turned down in April, J&J applied for its first bankruptcy roughly two hours after. In response to that move, Kaplan froze the lawsuits for 60 days to decide whether to grant to file for bankruptcy again.

J&J’s unstoppable profit machine sputters after $6.9B talc litigation charge.

With 2 Chapter 11 attempts, J&J has bought 19 months during which the cases were in limbo. Are all talcs dangerous or just Johnson and Johnson. The company wants claimants to accept their settlement. J&J needs 75% acceptance for the deal to pass.

In addition to the group of talc lawyers who criticised the company’s bankruptcy and the U.S. Trustee, a branch that is part of the U.S. Department of Justice was also the one to file an appeal to dismiss LTL’s bankruptcy second case.

In a filing this week, U.S. trustee Andrew R. Vara wrote that the bankruptcy courts are “open to honest, but naive debtors.” These doors “are not open to parties that do not have a legitimate goal or who seek to use bankruptcy to delay or hinder their creditors.” Vara continued.

To its credit, J&J maintains there is no proof conclusive that their Talc-based products, such as the famous baby powder, can cause cancer. J&J has taken its products off of the market–first in North America in 2020–and the remainder of the globe later this year.

J&J intends to steer clear of the costly business of going to trial. The company has won the majority of cases decided at trial, but some losses have been punitive.
A well-known trial in Missouri ended in a $4.7 billion judgment against the drug manufacturer, which was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine trial cases in talc which are appealing or settled. Out of 41 trials 32 ended with the favor of J&J, a mistrial or plaintiff verdict that was reversed after appeal. Are all talcs dangerous or just Johnson and Johnson. Separately, the company has announced plans to settle more than 1000 cases for 100 million dollars, Bloomberg announced at that time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Are All Talcs Dangerous Or Just Johnson And Johnson

June 2 2023 Update: During the asbestos talc trial which took place in California yesterday, technical issues interrupted the opening statements made by defense lawyers. Are all talcs dangerous or just Johnson and Johnson. Jurors watching from their homes via Zoom, did hear Johnson & Johnson’s lawyer expressing skepticism about the 70s science claiming asbestos was present in their product, but the trial was abruptly closed.

The plaintiff could introduce the first of their witnesses, Arthur Langer. Langer explained that the occurrence of other minerals in talc is inevitable. He also testified that his team had notified J&J in the year 1971 of the presence of chrysotile asbestos in the talc produced by the company, although at less than 0.1 percent. He also uncovered more asbestos in 1976.

June 1, 2023 Update: Are all talcs dangerous or just Johnson and Johnson. This is the first court trial that has taken place since J&J has decided to separate its talc segment and file for bankruptcy marks an important point for the ongoing lawsuit drama. Trial started on Monday in the heartbreaking case of a young 24-year-old plaintiff, diagnosed with an aggressive and rare form of mesothelioma last year. which lawyers on both sides acknowledge is a grave tragedy.

Opening statements revealed distinct differences between each side’s story. The plaintiff’s attorney took aim towards Johnson & Johnson, alleging the use of deceptive techniques in its research practices and throughout the litigation procedure. As per the lawyer the company tried to manipulate the definition of asbestos in spite of internal documents from the year 1978 and 1994 indicating that asbestos fibers that were found in the tissues of the plaintiff are part of.

Johnson & Johnson’s precarious $8.9 billion settlement deal hangs in the balance with the progress of this trial. Despite the distinct nature of the mesothelioma trial and the unique issues it faces compared to the majority of talcum powder lawsuits and a decision in favor of the plaintiff could be an enormous setback for J&J’s expectations of widespread acceptance of their proposed settlement with plaintiffs.

May 31 2023 Update: Johnson & Johnson’s bankrupted talc unit has strongly defended it’s 2nd Chapter 11 filing in the face of challenges from the talc injury plaintiffs. In an appeal to the New Jersey bankruptcy court, J&J’s subsidiary claimed that the situation differed fundamentally from the first filing. It also emphasized the unprecedented commitment to $8.9 billion to J&J the largest settlement ever in an bankruptcy case involving mass torts. Are all talcs dangerous or just Johnson and Johnson. Not mentioned: how the magnitude of the settlement signifies that it’s an equitable settlement. J&J also claimed that it received support from numerous plaintiffs’ law firms representing over the 60,000 plaintiffs. This is not easy to confirm but is probably incorrect.

May 24 2023 Update: As of Johnson & Johnson’s 2021 bankruptcy filing, the first trial on its cosmetic talc products allegedly with asbestos content is scheduled to start jury selection Monday, California within the Alameda County Superior Court, which is a well-known location for plaintiffs. Plaintiff claims that mesothelioma was caused by asbestos exposure in J&J’s product which the company denies. The trial also involves six retailers accused of selling talc products.

May 22, 2023 Update: Lawyers involved in the 2nd J&J Talc bankruptcy are in a dispute over who should be chosen to fill the role of a the future claims representative, an important role important to resolving the claims involving talc. Are all talcs dangerous or just Johnson and Johnson. Randi Ellis, a lawyer who frequently appears in MDLs throughout the United States was appointed the claims representative in the previous bankruptcy. J&J’s defense team would like Ellis to be named to the position yet again, but the lawyers for the talc plaintiffs have raised objections due to the fact that Ellis has an interest conflict which should stop her from taking on that role once more. The issue stems from the reality that Ellis was reportedly involved in the creation of the hotly contesting second bankruptcy, which raises doubts about her capability to remain neutral. In reality, this bankruptcy will likely to be tossed out anyway.

May 17, 2023 Update The pretend company J&J created for the talc litigation bankruptcy informed a New Jersey bankruptcy court that they have designated $400 million to settle the claims made by states accusing J&J of misleading marketing for its talc product. Are all talcs dangerous or just Johnson and Johnson. So that makes it an $8.5 billion settlement for cancer patients. It is hard to imagine a scenario where J&J will be able to push the settlements of baby powder through given these numbers. While J&J’s $8.5 billion offer seems like a huge sum initially, it may not look very appealing after you calculate the figures. This settlement proposal – by our rough calculations – would not provide victims with much more than $100,000 per instance. That’s not enough.

May 15, 2023, Update J&J might be facing lawsuit from an advocacy group representing cancer victims. Are all talcs dangerous or just Johnson and Johnson. The group claims that J&J intentionally canceled an $61.5 billion funding agreement in conjunction with its affiliate, LTL Management LLC, to simulate financial stress and confirm the unit’s Chapter 11 bankruptcy filing. The group claims that this move amounts to a fraudulent transfer of the victims’ compensation rights. They intend to investigate J&J’s actions following of the decision to dismiss LTL’s first bankruptcy case.

May 10 2023 Update: During the next week, this week the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to dismiss the second bankruptcy filing of J&J subsidiaries LTL Management. However, in the meantime LTL Management has filed an Order that requires both parties to participate in a second settlement mediation to see if it will be possible to reach a global settlement agreement reached.

May 5th 2023 Update: Talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer through asbestos exposure. Are all talcs dangerous or just Johnson and Johnson. Over 2700 people have sued the company and it has been spending $1 million a month to defend its legal position. The company’s most recent $29 million verdict at the Supreme Court of South Carolina forced it to apply for bankruptcy protection and argue for an equitable distribution of assets between talc claimants rather than being taken over in the hands of the receiver. Other talc suppliers have also declared bankruptcy because of the litigation.

May 4, 2023 Update U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to relaunch negotiations with lawyers who rejected the company’s $8.9 billion agreement. At Trenton, New Jersey yesterday, the parties appeared before a judge to discuss the next steps in this second case of bankruptcy and Judge Kaplan pushed more settlement talks.

This is the answer to settle these claims for J&J. A baby powder settlement could be made. Are all talcs dangerous or just Johnson and Johnson. However, it’ll require more money – billions of dollars from Johnson & Johnson.

Lawyers are divided on whether or not to agree with the proposal and not every client sees the issue the same way their attorney does. The second bankruptcy case is likely to go nowhere with Judge Kaplan has set a date for a hearing in June to decide whether to remove the bankruptcy after the second.

May 3, 2023 Update The group of cancer patients who have sued Johnson & Johnson (J&J) asked that J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt litigation over talc products. The group representing claimants for talc made a motion Tuesday, asking to the Third Circuit to consider their case and send it back to a lower court with instructions to discharge the bankruptcy. Are all talcs dangerous or just Johnson and Johnson. The committee also requested that the stopped tort litigation against J&J allow the litigation to continue.
LTL applied for Chapter 11 protection once again following its bankruptcy filing that was denied in the Third Circuit earlier this year which offered the possibility of an $8.9 billion payment. The committee says that the recent ruling which allowed LTL’s second Chapter 11 to continue, in addition to halting trials against J&J is a reason for the immediate Third Circuit review. The US Trustee requested the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a statement in the appeals court, characterizing the filing as a “desperate and legally deficient plan” by a few of law firms who have competing financial interests.
May 1 2023 Update: A common question that people ask is how plaintiffs and their lawyers turn around $8.9 billion. That’s of course an enormous amount of money. But there are a lot of victims. Are all talcs dangerous or just Johnson and Johnson. And these are really good arguments for plaintiffs. We were reminded of this last week in two talc trials which have resulted in huge verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon led to a verdict that was $18.1 million. In the same month, a different mesothelioma talc case was brought to hearing in South Carolina and resulted in the verdict of $29 million to the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc., one of the most prominent producers of talc in the U.S.
April 30 2023 Update: J&J initially attempted to pull the lawsuit over talcum powder into bankruptcy, it came with an offer to set aside $2 billion for settlements. It was a ridiculously small amount. All of the talc plaintiffs agreed with the proposal. This time around, however, J&J has increased the offer to $8.9 If the talc plaintiffs will allow a bankruptcy settlement and also has the support of a substantial segment of the talc plaintiffs and their lawyers. Are all talcs dangerous or just Johnson and Johnson. However, 75% of plaintiffs in the talc category, which is required to approve bankruptcy plans It’s a long and difficult process due to the sheer number of lawyers with vast inventories of baby powder lawsuits opposed against the proposed settlement.

What are the solutions to the impasse? More billions.
April 25 2023 Update: Talc cancer claimants have sought a court order to dismiss their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, insisting that the company is not financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Are all talcs dangerous or just Johnson and Johnson. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January and said that the company was not eligible for bankruptcy relief since it was unable to demonstrate financial stress.

The claimants assert that the second Chapter 11 case is an abuse of the bankruptcy system and that it’s being conducted in bad faith. J&J states that the bankruptcy settlement receives “significant support” from firms representing around 60,000 plaintiffs. It’s safe to say that lawyers representing plaintiffs and the victims are split over this $8.9 billion settlement offer.

April 21, 2023 Update: A bankruptcy judge has decided in favor of Johnson & Johnson must face new lawsuits alleging that the firm sold tainted baby powder causing cancer. Although trials for the talc lawsuits have been suspended for a minimum of 60 days but new lawsuits can be filed, and lawyers are able to begin preparing their cases. Are all talcs dangerous or just Johnson and Johnson. Judges expressed skepticism about J&J’s absurd attempt to revive its strategy by filing the second bankruptcy case.

April 13 2023: Update on the most important announcement is an $8.9 billion over 25 year period settlement offered. Lawyers representing cancer victims within the MDL group action pledged to fight the settlement alongside talc claimants. Why? They argue that it’s not enough to pay for 70 000 cancer patients. Are all talcs dangerous or just Johnson and Johnson. These lawyers believe that J&J should seek a bigger settlement or pursue individual claims if the latest bankruptcy is declared unconstitutional.

However, there is a second lawyer group that isn’t part of the leadership of this class action. These lawyers have amassed hundreds of thousands of cases. The group is seeking to settle for what is believed to be less than these victims deserve. Their argument is twofold. They argue that the settlement – about 100,000 dollars per plaintiff is fair.

It’s a difficult argument to prove. But their second argument has more substance: the victims will now not wait and they want to get their money right now.

April 12 2023 Update: Some people are seeking out how J&J can file for bankruptcy once more. The answer is complex and confusing. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc lawsuits conclusively. Also, it believes it can pay less if there is an element of bankruptcy that puts pressure to settle. Are all talcs dangerous or just Johnson and Johnson. Going back to 400 years of American past, the company believes that bankruptcy is beneficial to all parties as it distributes settlement payments more evenly and effectively than trial courts, in which some litigants receive substantial payouts, while others are left with nothing.

The essence of the 3rd Circuit decision was this is not a case – a profitable company making an affiliate to accept the legal risk and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. It also clarified the company was financially difficulty because J&J promises unlimited funding.
So J&J took advantage of the unlimited funding part of the deal and didn’t make any promises to offer unlimited funding for cases. J&J claims that its revised financing arrangements with its subsidiary will address appeals court’s concerns, while offering claim payment funds. In the hope that offering victims less money will solve the underlying issue.

Attorneys representing cancer patients who are against the agreement argue the agreement with what is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole was not spared: victims’ lawyers call it the biggest “fraudulent transfer of assets in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. However, it’s a means of trying to push this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10 2023 Update Bloomberg is running an intriguing piece on a law that has been passed of New Jersey that is shedding new light on the funding of litigation in the baby powder suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) concerning talc products in exchange for a percentage of any winnings. J&J has now offered that it will pay $8.9 billion in settlements for all lawsuits.

The involvement of funders is public knowledge because of an New Jersey court rule requiring the disclosure of certain information about funding sources outside of the. The rule aims to respond to the increasing calls for regulation of the litigation funders. J&J has to deal with more than 60,000 lawsuits when you combine state and federal Baby Powder lawsuits. Third-party funding of mass tort cases is not without its pros and cons. There is no doubt that we are seeing how third-party financing can help level the playing field between individual and large corporations in court.

April 4 2023 Update: It is interesting to watch the worm turning in this lawsuit. J&J was hit again this week when they were denied by the Third Circuit denied J&J’s request to continue the automatic stay in the meantime that J&J appeals an appeal to the U.S. Supreme Court. The automatic stay has halted the cases of talcum powder in a number of years and stopped any new lawsuits from arising ever since J&J began the controversial plan to spin talc-related liabilities into a bankrupt subsidiary over one year ago. Are all talcs dangerous or just Johnson and Johnson. When the 3rd Circuit ruled that this bankruptcy was not legal some months ago, the stay was revoked. J&J was hoping to have it remain in effect until its SCOTUS appeal. But the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that the Supreme Court is willing even to take up the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay now in effect, the first new cases have been filed and transferred into the class action involving talcum powder MDL in over one year. Seven new talc cases were added to the MDL during the month of March increasing the number of cases in the pending process up to 37,522.

February 25, 2023 Update: A Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) start an investigation into how much J&J product containing talc has cost the government over the many years.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of failing to recognize the dangers of its talc product for decades while tax dollars were spent treating those injured by exposure to the product. This lawsuit comes a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Are all talcs dangerous or just Johnson and Johnson. J&J has to begin making reasonable settlements to victims to begin to put all of this behind it. This is a disgrace to one of the world’s greatest companies.

February 14 2023 Update: In an appearance today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
