Johnson & Johnson asserts that bankruptcy is the only method to resolve both current and future talc-related lawsuits definitively. Lawyers representing cancer patients who oppose the deal counter this by arguing that the plaintiff is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole is not exempt: victims’ lawyers call it the most significant “fraudulent transaction ever in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. But it is a way to try and push the $8.9 billion settlement to keep the pressure on plaintiffs.

Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) concerning talc products in exchange for a percentage of any wins. J&J is now willing the payment of $8.9 billion in settlements for all lawsuits.
The involvement of the funders is made public because of a New Jersey court rule requiring the disclosure of certain information regarding outside funding backers.
