In February 2022, Kaplan stated that J&J’s recourse to Chapter 11 to hasten a settlement that would release J&J from the hundreds of thousands of claims related to its talcum-based products.
In January of this year, a federal appeals court overturned the decision, deciding that the firm could not be considered to be in “financial financial distress.”

Opening statements revealed the huge differences between the sides’ narrative. The attorney for the plaintiff took aim at Johnson & Johnson, alleging that the company employed deceitful strategies in its research practices as well as throughout the litigation procedure. In the words of attorney, the company attempted to manipulate the definition of asbestos despite internal documents from the year 1978 and 1994 indicating that asbestos fibers in the tissue of the plaintiffs are included.
Johnson &J’s highly uncertain $8.9 billion settlement is hanging in the balance with the progress of this trial. Does all baby powder have talc in it. Randi Ellis, a lawyer who regularly appears in MDLs throughout the United States was appointed the claims representative in the first bankruptcy. J&J’s defense team wants Ellis to be appointed in that position again, but lawyers for the talc plaintiffs are protesting to the claim that Ellis has a conflict of interest that should prevent her from holding that position in the future. The conflict stems from the possibility that Ellis was apparently involved in the creation of the hotly contesting second bankruptcy, which raises concerns regarding her capacity to remain neutral. In reality, this bankruptcy will likely to be dismissed regardless.
May 17, 2023 Update: The fake company J&J put together for the talc litigation bankruptcy informed a New Jersey bankruptcy court that they have designated $400 million to settle claims brought by states accusing the company of deceptive advertising for its talc-based products. Does all baby powder have talc in it. So that makes it an $8.5 billion settlement for cancer victims. It’s hard to imagine a scenario where J&J could push these baby powder settlements through in these figures. Although J&J’s $8.5 billion offer might seem like a huge sum initially, it does not look good when you look at the numbers. This settlement offer based on our estimates – will not provide victims with much more than a median settlement of $100,000 per instance. This isn’t enough.
May 15, 2023 Update: J&J is potentially facing a lawsuit from an advocacy group representing cancer patients. Does all baby powder have talc in it. The group contends that J&J deliberately retracted an $61.5 billion funding agreement that it had with its company subsidiary LTL Management LLC, to create the appearance of financial hardship and verify the unit’s Chapter 11 bankruptcy filing. The group claims that this move is equivalent to a fraudulent transfer of the rights of compensation for victims. The company’s latest $29 million verdict at the Supreme Court of South Carolina forced it to file for bankruptcy protection, arguing for an equitable distribution of assets among talc claimants instead of being taken by the receiver. Other suppliers of talc have been forced to file for bankruptcy as a result of legal proceedings.
May 4, 2023 Update U.S. bankruptcy judge Michael Kaplan has directed Johnson & Johnson to resume talks with lawyers who rebuffed the company’s $8.9 billion offer for settlement. In Trenton, New Jersey yesterday, the parties gathered in court to discuss next steps for another bankruptcy proceeding. Judge Kaplan pushed more settlement talks.
This is the solution to resolve the claims of J&J. A baby powder settlement could be completed. Does all baby powder have talc in it. But it will require more money – billions of dollars from Johnson & Johnson.
Lawyers are split on whether to take the proposal or not and not all clients see the issue in the same manner their lawyer does. A second bankruptcy proceeding is expected to be a failure the judge Kaplan has set a date for a hearing in June to decide if he will remove the bankruptcy after the second.
May 3, 2023 Update: A group representing cancer victims who are suing Johnson & Johnson (J&J) demanded that they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail the litigation surrounding talc-based products. The committee representing talc claimants has filed a motion this week, asking the Third Circuit to consider their case and to send it back an earlier court, with instructions to discharge the bankruptcy. Does all baby powder have talc in it. They also asked that the halted tort litigation against J&J continue to continue.
LTL filed for Chapter 11 protection once again after its first bankruptcy filing was denied by the Third Circuit earlier this year, offering an $8.9 billion deal. The committee says that the recent ruling, which allows LTL’s second Chapter 11 to continue, and also stopping trials against J&J should be subject to the immediate Third Circuit review. The US Trustee also requested that be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation, Erik Haas, was quoted by Bloomberg saying that J&J intends to file a reply to the appeals court calling the request a “desperate and legally insufficient attempt” by a few of law firms that have conflicting financial interests.
May 1st, 2023 Update: One common question that people ask is how could plaintiffs and their attorneys turn on $8.9 billion. Of course, that’s an enormous amount of money. There are a lot of victims. Does all baby powder have talc in it. And these are really good case for plaintiffs. We were reminded recently by two talc-related trials that led to huge verdicts for plaintiffs. In February, a talcum powder mesothelioma trial in Oregon resulted in the verdict in the amount of $18.1 million. A month later, another mesothelioma talc case was brought to trial within South Carolina and resulted in a verdict of $29million on behalf of the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. which is one of the largest suppliers of talc in the U.S.
April 30th 2023 Update: J&J initially attempted to pull the talcum powder litigation into bankruptcy, it came with an offer to reserve $2 billion for settlements. This was an absurdly low amount. None of the talc plaintiffs supported it. This time, J&J has increased the offer to $8.9 for talc-related plaintiffs if they accept a bankruptcy settlement and also has the support of a large section of the talc victims as well as their lawyers. Does all baby powder have talc in it. However, 75% of plaintiffs who are a talc, which is required to approve bankruptcy plans is not an easy task because of the number of lawyers who have massive stocks of baby powder-related lawsuits, opposed towards the agreement.
What can be done to end the impasse? More billions.
April 25, 2023 update: Talc Cancer victims have sought a court order to reject the Chapter 11 case filed by LTL Management LLC, a absurdly made-up Johnson & Johnson subsidiary, insisting that the company is not financially troubled. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Does all baby powder have talc in it. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company was not eligible for bankruptcy relief since it did not show financial trouble.
The claimants contend that the 2nd Chapter 11 case is an fraud on the bankruptcy system and it’s being conducted in bad faith. J&J claims the bankruptcy settlement receives “significant backing” from firms representing about 60,000 potential claimants. It’s fair to say that plaintiffs’ lawyers and the victims are split over the $8.9 billion amount of settlement offered.
April 21st, 2023 Update A bankruptcy judge decided that Johnson & Johnson must face new lawsuits alleging that the firm sold tainted baby powder causing cancer. Although the trials for talc lawsuits are paused for a minimum period of 60 days however, new lawsuits may be filed and lawyers may begin to prepare their cases. Does all baby powder have talc in it. The judge expressed skepticism over J&J’s attempt to revive its plan with the second bankruptcy case.
April 13, 2023 Update: biggest announcement is an $8.9 billion over 25 year period settlement offered. Lawyers representing cancer victims involved in MDL class action MDL collective action vowed to challenge the settlement those who claim talc. Why? They believe it’s not enough money for more than 70,000 cancer victims. Does all baby powder have talc in it. These lawyers argue that J&J should negotiate a bigger settlement or litigate individual claims if the latest bankruptcy is dismissed.
There is a different group of lawyers that is not part of the leadership group in the class action. These lawyers have collectively amassed tens of thousands of cases. The group is seeking to settle with what they believe is lower than what the victims should be paid. Their argument is twofold. First, they argue that the settlement – about 100,000 dollars per plaintiff – is fair.
That is a hard argument to argue. However, their second argument has more teeth: victims can no longer wait and want their money today.
April 12, 2023 Update: People are wondering if J&J can file for bankruptcy once more. The answer is complex and complex. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future lawsuits involving talc conclusively. It believes it can pay less when there is a bankruptcy component that applies pressure for a settlement. Does all baby powder have talc in it. Moving past hundreds of years of American history, the company claims that bankruptcy benefits all parties as it distributes settlements more equally and effectively than trial courts, where litigants are awarded significant payouts, while others are left with nothing.
The gist in this 3rd Circuit decision was this is not a matter of a profitable company making a subsidiary to take the legal liability and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. But it also said that the subsidiary was not in financial difficulty due to the fact that J&J promises unlimited funding.
So J&J decided to go with the funding unlimited part of the deal and did not promise to offer unlimited funding for the litigation. J&J claims that its modified financing arrangements with its subsidiary address the appeals court’s concerns while still supplying funds for claim payments. As if providing victims with lower amounts of money would resolve the problem at hand.
Attorneys representing cancer victims who are against the agreement argue the agreement with what is the legal argument. Does all baby powder have talc in it. They counter with legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole was not spared: victims’ lawyers call this the biggest “fraudulent transaction ever in United States history.”
Despite the legal jargon, J&J does not really believe that this bankruptcy will last. However, it’s a means to push for this $8.9 billion settlement through and maintain the pressure on plaintiffs.
April 10, 2023, Update Bloomberg has an interesting report on a brand new law within New Jersey that is shedding new light on the funding of litigation in the suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a percentage of any winnings. J&J is now offering the payment of $8.9 billion to settle any lawsuits.
The involvement of funders is public knowledge due to an New Jersey court rule requiring the release of certain details about funding sources outside of the. This rule is intended to respond to the increasing calls for regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you include federal and state infant powder litigation. Third-party funding in mass tort claims is not without its pros and cons. But there is no question that we are seeing how third-party funding can level the playing field between people and large corporations in court.
April 4 2023 Update: It’s fun to watch the worm turning in this case. J&J took another hit this week when an appeals court in the Third Circuit denied J&J’s request to keep the automatic stay in place in the meantime that J&J appeals a bankruptcy ruling before the U.S. Supreme Court. Automatic stays have stopped thousands of talcum powder cases and stopped any new lawsuits from arising ever since J&J began the controversial plan to spin the talc liabilities off into a bankrupt subsidiary more than a year ago. Does all baby powder have talc in it. When it was decided that the 3rd Circuit ruled that this bankruptcy was invalid a few months ago, the stay was removed. J&J wanted to see it continued pending an appeal to the SCOTUS appeal. But the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that is that the Supreme Court is willing even to consider the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay being in effect, the first new cases were filed and incorporated into the Talcum Powder class action MDL within a year. Seven new talc lawsuits have been brought into the MDL in the last month which brings the total number of pending cases up to 37,522.
February 25, 2023 Update: A Congressmen from Tennessee has now demanded that the U.S. Government Accountability Office (GAO) begin an investigation into the cost J&J products containing talc have cost the government in the years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the risks of its talc product for years while tax dollars were spent on treating people who suffered injuries from exposure to the product. The suit comes just a few days after J&J’s loss to the 3rd Circuit Court of Appeals.
Does all baby powder have talc in it. J&J should begin to make reasonable settlement proposals to victims, in order getting this behind. This is a blemish on one of the greatest businesses.
February 14 2023 Update: During an earlier hearing at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
