However, there is a second group of lawyers that is not part of the top leadership in that class action. These lawyers have collectively amassed many thousands of cases. They want to settle now in what many believe to be far less than what these victims deserve. Their argument is two-fold. They argue that the settlement – which amounts to the equivalent of $100,000 per plaintiff is fair.
That is a hard argument to argue. However, their second argument has more force: victims should be no longer patient and demand the money immediately.
April 12 2023 Update: Some people are wondering if J&J can file for bankruptcy again. The answer is complex and convoluted. However, let’s attempt to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future lawsuits involving talc conclusively. That is, it believes it can pay less should there be the bankruptcy element which applies pressure to negotiate a settlement. Does baby powder till have talc. Going back to 400 years of American history, the firm believes that bankruptcy is beneficial to all parties as it distributes settlement payments more equitably and effectively than trial courts in which some litigants receive substantial payouts, while others are left with nothing.
The essence in this 3rd Circuit decision was this is not a case of an enterprise that is profitable, forming an entity to assume the legal liability and declare bankruptcy Congress thought of when drafting its Bankruptcy Code. But it also said it was not financially crisis because J&J assured it of unlimited funding.
So J&J took advantage of the unlimited funding portion of the holding and did not promise to offer unlimited funding for the litigation. The company says that its new financing agreements with its subsidiary will address appeals court’s concerns while still providing funds for claims. In the hope that offering victims less money would solve the underlying issue.
Lawyers representing cancer victims who oppose the deal counter this with what you conclude is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed: victims’ lawyers call it the most significant “fraudulent move of assets in United States history.”
In spite of the legal jargon, J&J does not really believe that this bankruptcy will last. It is however a method to try and push the $8.9 billion settlement through and maintain pressure on plaintiffs.

J&J is now willing to pay $8.9 billion to settle all lawsuits.
The involvement of funders is public knowledge due to the New Jersey court rule requiring the release of certain details about funding sources outside of the. This rule is intended to respond to the increasing calls for the regulation of lawsuit funders. J&J has more than 60,000 claims when you take into account state and federal infant powder litigation. Third-party funding of mass tort cases is not without its pros and cons. However, there is no doubt that we are seeing how third-party funding could level the playing field between people and big corporations in court.
April 4, 2023 Update: It’s pleasing to see the worm turn in this litigation. J&J suffered another setback this week when an appeals court in the Third Circuit denied J&J’s request to continue the automatic stay while J&J appeals an appeal before the U.S. Supreme Court. It has froze hundreds of cases involving talcum powder and stopped any new lawsuits from arising ever since J&J started the controversial process to spin the talc liability into a bankrupt subsidiary more than a year earlier. J&J had hoped to have it stayed in place until the SCOTUS appeal. However, the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that is that the Supreme Court is willing even to consider the appeal? Low.

February 25 2023 Update The following information is available: A Congressmen from Tennessee is now demanding that authorities from the U.S. Government Accountability Office (GAO) start an investigation into the cost J&J product containing talc has cost the government over the many years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of not recognizing the risks of its talc products over decades while tax dollars were utilized to treat people injured by exposure to the product. The suit comes just a few days after J&J’s loss to the 3rd Circuit Court of Appeals.
