Johnson & Johnson asserts that bankruptcy is the only option to address both present and future talc litigations in a definitive manner. In a quest to cover hundreds of years of American history, the company believes that bankruptcy is beneficial to all parties as it distributes settlements more fairly and efficiently than trial courts, where some litigants receive significant awards while others receive nothing.
The essence of this 3rd Circuit decision was this is not a case of one that makes a profit, but a subsidiary to take the legal burden and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code.
