Johnson & Johnson asserts that bankruptcy is the only option to address both present and future talc litigations in a definitive manner. It believes that it will be less expensive when there is an element of bankruptcy that puts pressure to settle. In a quest to cover hundreds of years of American history, the company believes that bankruptcy is beneficial to all parties as it distributes settlements more fairly and efficiently than trial courts, where some litigants receive significant awards while others receive nothing.
