New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy in a joint move with cancer victims and their counterparts from the U.S. Justice Department’s watchdog on bankruptcy, who have claimed that a lucrative business like J&J can’t benefit from bankruptcy protections meant for the struggling debtors.
LTL’s first attempt at resolving the bankruptcy cases was dismissed following similar arguments, when a U.S. appeals court decided it was not LTL had not been in “financial trouble” and therefore not eligible for bankruptcy protection. Does J&J talc contain asbestos. LTL made a new bankruptcy application within two hours of the dismissal, arguing its second attempt was different because there was less money available and more backing for the possibility of settling.

New Mexico and Mississippi said in their motion to dismiss LTL’s new bankruptcy violates the state’s law enforcement authority by seeking to unilaterally limit LTL’s liability to state consumer protection actions.

LTL’s filings for the new year also contained more information on how the company plans to evaluate and pay claims for cancer if the bankruptcy plan is approved.

For example the case of a woman who used talc products on a weekly basis, who had an ancestral history of ovarian cancer and was diagnosed with the stage 2 ovarian cancer when she was 55 may qualify for a $21,125 payment under the settlement plan.

Judge decides J&J and talc opponents discuss settlement negotiations.

Following another round of hearings in Johnson & Johnson’s attempt to utilize a Texas Two-Step bankruptcy strategy for talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the company and those opposing the plan to hold negotiations to settle the matter, Bloomberg reports.

With its second bankruptcy attempt for LTL Management, a subsidiary created by J&J to settle claims – the company offered a settlement of $8.9 billion. Does J&J talc contain asbestos. While a group of law firms representing plaintiffs agree with the settlement, a different group opposes the move.

In the last week, an opposition group, which is known as the Official Committee of Talc Claimants, urged the bankruptcy court for dismissal of the matter argument that LTL can not be considered to be in financial trouble.

“The filing is an unjust and legally flawed attempt by a handful of law firms to try to stop claimants from deciding on the resolution plan–a plan that the vast majority of claimants approve of,” J&J’s litigation chief Erik Haas, said in an announcement. Does J&J talc contain asbestos. “The law firms who filed this filing have financial interests that conflict with, diverge from and are in opposition to the interests they represent. We’ll soon submit a response an appeal to the appellate court.”

Does J&J talc contain asbestos. Clay Thompson, a lawyer for MRHFM which has more than 80 mesothelioma clients who have filed lawsuits against J&J and J&J, has said that J&J’s second bankruptcy attempt will fail.

“J&J sends out press releases that boast about how amazing its plan is while simultaneously insisting that the plan’s details, including what the individual sick individuals would receive–be kept secret,” Thompson said in the statement. “What does the company have to hide?”

Kaplan has instructed both sides to devise a second strategy for reorganization, under the oversight of two mediators.

The court in February of 2022 Kaplan acknowledged J&J’s recourse to Chapter 11 to hasten a settlement that would free the company from the hundreds of thousands of claims related to its talcum-based products.

But in the month of January, a federal appeals court overturned the verdict, ruling that the business could not be considered to be in “financial financial distress.”

When J&J’s attempt to contest the U.S. Supreme Court was dismissed the same month, J&J applied for its first bankruptcy two hours later. In response to that move, Kaplan froze the lawsuits for 60 calendar days to decide whether or not to approve to file for bankruptcy again.

J&J’s omnipotent profit engine fails after $6.9B cost of litigation involving talc.

Through 2 Chapter 11 attempts, J&J has bought 19 months during which cases have been in limbo. Does J&J talc contain asbestos. The company wants claimants to decide whether they want to accept the settlement. J&J will require 75% support for the deal to pass.

Alongside the group of talc lawyers that criticized the company’s bankruptcy as well, the U.S. Trustee is an arm of the U.S. Department of Justice, also filed an application to dismiss LTL’s second bankruptcy case.

In a letter filed this week, U.S. Trustee Andrew R. Vara wrote that the doors of bankruptcy courts are “open to honest but unfortunate debtors.” These doors “are not available to anyone that lack a legitimate bankruptcy purpose or that seek to abuse the bankruptcy process to hinder or delay their creditors,” Vara continued.

To its credit, J&J maintains there is no definitive evidence to suggest that its products containing talc, such as the famous baby powder, can cause cancer. J&J has taken its products off of the market, first to be available in North America in 2020–and the rest of the world this year.

J&J intends to steer clear of the expense of going to trial. J&J has won the majority of cases decided in court, however certain losses have been extremely harsh.
A well-known trial in Missouri resulted in a $4.7 billion judgment against the drug manufacturer and was later lowered to $2.1 billion following appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine trial cases in talc which are on appeal or have been resolved. Out of 41 trials, 32 have ended in winning for J&J as well as mistrials or plaintiff verdicts that were dismissed after appeal. Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Does J&J Talc Contain Asbestos

June 2, 2023 Update: During the asbestos talc case that took place in California yesterday, some technical glitches interrupted the opening statements made by defense attorneys. Does J&J talc contain asbestos. The jurors, attending from their homes via Zoom, did hear Johnson & Johnson’s lawyer voice his skepticism about the 70s science affirming the presence of asbestos in their product, but the session abruptly ended.

In the meantime, the plaintiff had the opportunity to present the first of their witnesses, Arthur Langer. Langer explained that the occurrence of other minerals alongside the talc’s mineral content is inevitable. He said that his team informed J&J in the year 1971 about the presence of chrysotile asbestos in the company’s talc, albeit at just 0.1 percent. He also found more asbestos in the year 1976.

June 1, 2023 Update: Does J&J talc contain asbestos. A trial for the first time since J&J took the decision to disband its talc segment and file for bankruptcy marks a pivotal moment for the ongoing lawsuit controversy. Trial started on Monday in the harrowing trial of a young plaintiff who was diagnosed with an extremely rare and aggressive form of mesothelioma earlier this year. a diagnosis lawyers on both sides believe is a grave tragedy.

Opening statements revealed the huge differences between the sides’ narrative. The attorney representing the plaintiff took aim on Johnson & Johnson, alleging that the company employed deceitful techniques in its research practices and throughout the litigation procedure. As per the lawyer, Johnson & Johnson tried to alter the definition of asbestos, in spite of internal documents from 1998 and 1994 that show asbestos fibers in the plaintiff’s tissue are included.

Johnson & Johnson’s precarious $8.9 billion settlement is hanging in the balance as we course of this trial. Despite the particularity of this mesothelioma lawsuit and its distinctive issues in comparison to other talcum powder lawsuits, a verdict favoring the plaintiff could inflict the company with a major setback in its hopes of broad acceptance of their proposed settlement with plaintiffs.

May 31st 2023: Update from Johnson and Johnson’s bankrupt talc unit is defending the second Chapter 11 filing in the face of challenges from talc injury claimants. In an opposition filed with the New Jersey bankruptcy court, the subsidiary argued that the situation was distinct from the earlier filing. It also emphasized the unprecedented commitment to $8.9 billion from J&J the largest settlement ever made in any bankruptcy case that involves mass tort. Does J&J talc contain asbestos. Not mentioned: how the size of the settlement implies that it is a fair settlement. J&J also claimed that it received support from several plaintiffs’ legal firms representing over the 60,000 plaintiffs. This is hard to verify but it’s likely to be false.

May 24, 2023 Update: Since Johnson & Johnson’s bankruptcy in 2021 filing, the very first trial regarding its cosmetic talc items allegedly that contain asbestos is scheduled to start jury selection on Monday, May 24, California at Alameda County Superior Court, a historically good location for plaintiffs. The plaintiff claims that his mesothelioma was triggered by asbestos exposure from J&J’s products, an allegation J&J does not deny. The trial also involves six retailers accused of selling talc-containing products.

May 22nd, 2023 Update: Lawyers involved in the 2nd J&J talc bankruptcy are now disputing who should be appointed to the position of the future claims representative, a role that is critically essential to the resolution of the Talc claims. Does J&J talc contain asbestos. Randi Ellis, a lawyer who regularly appears in MDLs throughout the United States was appointed as the claims representative during the first bankruptcy. J&J’s defense team wants Ellis to be appointed in that position again, but lawyers for the talc plaintiffs are objecting on the grounds that Ellis has an unrelated conflict of interest that should prevent her from being appointed to that post in the future. The conflict stems from the fact that Ellis was reportedly involved in drafting the hotly litigated second bankruptcy, which raises questions about her capacity to be neutral. The reality is this bankruptcy could be tossed out anyway.

May 17, 2023 Update The pretend company J&J created for the talc bankruptcy disclosed to an New Jersey bankruptcy court that they have designated $400 million to settle allegations made by states who accuse the company of misleading advertising for its talc-based products. Does J&J talc contain asbestos. It’s a $8.5 billion settlement for cancer patients. It is hard to imagine any scenario in which J&J will be able to push these baby powder settlements through with these numbers. While J&J’s $8.5 billion offer might seem like a lot of money initially, it will not look good when you look at the numbers. The proposed settlement based on our rough calculations would not offer victims anything more than a median settlement of $100,000 per instance. That’s not enough.

May 15th 2023 update: J&J might be facing lawsuit by an advocacy group that represents cancer patients. Does J&J talc contain asbestos. The group claims J&J deliberately withdrew an $61.5 billion financing agreement that it had with its company subsidiary LTL Management LLC, to simulate financial distress and validate the unit’s Chapter 11 bankruptcy filing. The group argues that this act could be interpreted as a fraudulent transfer of the rights of victims’ compensation. They plan to explore J&J’s actions as a result of the decision to dismiss the first bankruptcy case of LTL.

May 10 2023 Update: The following week next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to dismiss the second bankruptcy filing by J&J company LTL Management. In the meantime, however the bankruptcy has issued an Order calling for both parties to participate in a new settlement mediation hoping that an international settlement agreement can be come to fruition.

May 5, 2023 Update: Talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to several lawsuits alleging that its talc products cause cancer due to asbestos exposure. Does J&J talc contain asbestos. More than 2700 people have filed lawsuits against the company and it is spending $1 million a month on legal defense. The company’s most recent $29 million settlement in South Carolina forced it to file for bankruptcy protection, arguing for a fair distribution of assets to talc claimants, rather than being taken in the hands of the receiver. Other talc suppliers have also been forced to file for bankruptcy as a result of legal proceedings.

May 4 2023 Update: U.S. The bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to restart negotiations with lawyers who rejected the company’s proposed $8.9 billion offer for settlement. In Trenton, New Jersey yesterday, the parties appeared in court to discuss the next steps in the second bankruptcy case. Judge Kaplan pushed more settlement talks.

This is the answer to settle these claims with J&J. A baby powder settlement could be completed. Does J&J talc contain asbestos. However, it’ll require additional money – perhaps billions of dollars by Johnson & Johnson.

Lawyers are split on whether to accept the proposal and not all clients view the situation the same way their attorney does. The second bankruptcy case is destined to go nowhere and Judge Kaplan has set a date for a hearing in June to decide whether to remove the bankruptcy after the second.

May 3, 2023 Update: A group of cancer patients suing Johnson & Johnson (J&J) requested for the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block litigation regarding talc-related products. The group representing the claimants has filed a motion this week asking for the Third Circuit to consider their case and to send it back the lower court with instructions to dismiss the bankruptcy. Does J&J talc contain asbestos. They also asked that the lawsuit against the halted torts of J&J be allowed to proceed.
LTL has filed for Chapter 11 protection once again following the bankruptcy filing it made earlier was denied by the Third Circuit earlier this year and offered the possibility of an $8.9 billion settlement. The committee believes that the recent ruling, which allows LTL’s 2nd Chapter 11 to continue, and also stopping trials against J&J should be subject to urgent Third Circuit review. The US Trustee has also requested it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation, Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a response in the appeals court, characterizing the filing as an “desperate and legally insufficient effort” by a few of law firms with competing financial interests.
May 1, 2023 Update: One question people keep asking is how could the plaintiffs’ lawyers and their clients turn off $8.9 billion. Of course, it’s an immense amount of money. However, there are lots of victims. Does J&J talc contain asbestos. These are an excellent arguments for plaintiffs. We were reminded recently with two talc trials led to huge verdicts for plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon resulted in the verdict in the amount of $18.1 million. In the same month, a different mesothelioma-related talc case went to hearing in South Carolina and resulted in the verdict of $29 million on behalf of the plaintiff. Both cases were defended by Whittaker, Clark & Daniels Inc. one of the most prominent suppliers of talc within the U.S.
April 30 2023 Update: In the year 2023, when J&J initially attempted to pull the lawsuit over talcum powder into bankruptcy, they came with the option of putting aside $2 billion to settle the case. This was an absurdly low amount. The talc plaintiffs had not were in favor of the offer. This time, J&J has increased the offer to $8.9 in the event that the talc victims accept a bankruptcy settlement and they have the support of a substantial portion of the talc plaintiffs and their lawyers. Does J&J talc contain asbestos. But 75% of the plaintiffs of talc are needed for approval of the bankruptcy plan is not an easy task with so many lawyers with large collections of baby powder-related lawsuits, opposed towards the agreement.

What could solve the impasse? More billions.
April 25, 2023 Update: Talc cancer claimants have asked a judge to reject the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, saying the company is not financially troubled. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Does J&J talc contain asbestos. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company was not eligible for bankruptcy relief because it had not demonstrated financial difficulties.

The claimants contend that LTL’s second Chapter 11 case is an abuse of the bankruptcy system and that it is being pursued in bad good faith. J&J claims the bankruptcy settlement is backed by “significant backing” from companies representing approximately 60,000 claimants. It’s fair to say plaintiffs’ lawyers and victims ‘ lawyers are not united over this $8.9 billion deal.

April 21, 2023 Update: A bankruptcy judge decided that Johnson & Johnson must face new lawsuits alleging that the firm offered a baby powder with a contaminant that caused cancer. While trials in the lawsuits involving talc are delayed for a minimum of 60 days however, new lawsuits may be filed, and lawyers are able to begin preparing their cases. Does J&J talc contain asbestos. Judges expressed doubt about J&J’s attempt to revive its strategy with another bankruptcy case.

April 13th, 2023: Update on the major update is about the $8.9 billion over the next 25 year period settlement offered. Lawyers representing cancer patients in the MDL Class Action have promised to fight the settlement alongside talc claimants. Why? They think it is too little money for the 70,000 victims who have cancer. Does J&J talc contain asbestos. These lawyers believe that J&J could negotiate a greater settlement or even litigate individual claims in the event that the latest bankruptcy is dismissed.

But there’s a separate group of lawyers that is not part of the leadership in that class action. They have amassed hundreds of thousands of cases. This group wants to settle for what is believed to be far less than what these victims deserve. Their argument seems to be two-fold. They argue that the settlement – which amounts to the equivalent of $100,000 per plaintiff is fair.

This is an argument that is difficult to prove. But their second argument has more substance: the victims will not afford to wait any longer and need their money now.

April 12, 2023 Update: People are looking for ways J&J is able to file for bankruptcy again. The answer is complicated and confusing. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only option to address both present and future talc litigations in a definitive manner. It believes that it will be less expensive when there is an element of bankruptcy that puts pressure to settle. Does J&J talc contain asbestos. In a quest to cover hundreds of years of American history, the company believes that bankruptcy is beneficial to all parties as it distributes settlements more fairly and efficiently than trial courts, where some litigants receive significant awards while others receive nothing.

The essence of this 3rd Circuit decision was this is not a case of one that makes a profit, but a subsidiary to take the legal burden and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code. But it also said that the subsidiary was not financially distress because J&J assured it of unlimited funding.
Then J&J decided to go with the unlimited funding portion of the deal and didn’t promise that it would provide unlimited funds for cases. J&J claims that its updated financing arrangements with its subsidiary addresses the appeals court’s concerns while still offering funds to pay claims. In the hope that offering victims lower amounts of money would resolve the underlying issue.

Lawyers representing cancer patients who do not agree with the agreement counter this by arguing that the plaintiff is the legal argument. Does J&J talc contain asbestos. They counter with legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole was not spared: victims’ lawyers call this the biggest “fraudulent move of assets in United States history.”

In spite of the legal jargon, J&J does not really believe this bankruptcy will be able to last. However, it’s a means to try and push the $8.9 billion settlement, and to keep pressure on plaintiffs.

April 10 2023 Update Bloomberg has an interesting article on a new law within New Jersey that is shedding new light on litigation funding in the suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) concerning talc products in exchange in exchange for a portion of settlements. J&J is now willing the payment of $8.9 billion in settlements for all lawsuits.

The involvement of funders is publicly available because of a New Jersey court rule requiring the disclosure of certain information about funders outside the state. The rules aim to address the rising calls for regulation of the litigation funders. J&J is facing more than 60,000 claims when you include state and federal child powder-related lawsuits. Third-party funding of mass tort cases has both pros and cons. However, there is no doubt that we are witnessing how third-party financing can help level the playing field between people and big companies in court.

April 4 2023 Update: It’s fun to watch the worm turning in this litigation. J&J took another hit this week when an appeals court in the Third Circuit denied J&J’s request to keep the automatic stay in place as J&J appeals an order granting bankruptcy in the U.S. Supreme Court. The automatic stay has stopped thousands of talcum cases and stopped any new lawsuits from being filed ever since J&J started the controversial process to spin the talc liabilities into a bankrupt company over one year earlier. Does J&J talc contain asbestos. When it was decided that the 3rd Circuit ruled that this bankruptcy was invalid a few months ago, the stay was removed. J&J was hoping to have it remain in effect until its SCOTUS appeal. The answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that is that the Supreme Court is willing even to take up the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay now fully lifted, the first new cases were filed and incorporated into the class action for talcum powder MDL in just over a year. Seven new talc-related lawsuits were included in the MDL during the month of March, bringing the total number of cases that are pending to 37,522.

February 25, 2023 Update The following information is available: A Congressmen from Tennessee is now calling for authorities from the U.S. Government Accountability Office (GAO) begin an investigation to determine how much J&J talc products have cost the government over the many years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the dangers of its talc products for years while tax dollars were used to treat those who were injured through exposure to the products. The lawsuit comes just a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Does J&J talc contain asbestos. J&J must begin making reasonable settlements to victims to begin getting this behind it. This is a disgrace to one of the top businesses.

February 14 2023 Update: During a hearing today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
