J&J’s worldwide vice president of litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a statement in the appeals court saying that the filing is an “desperate and legally deficient effort” by a small number of law firms who have conflicts of financial interests.
May 1st 2023 Update: One common question that people ask is how the plaintiffs’ lawyers and their clients turn around $8.9 billion. Of course, that is quite a sum. But there are plenty of victims. Does Johnson and Johnson still use talc. They are a great claims for plaintiffs. We were reminded recently when two talc cases resulted in big verdicts for the plaintiffs. J&J states that the bankruptcy settlement receives “significant backing” from companies representing around 60,000 claimants. It is fair to say that lawyers representing plaintiffs and victims are divided over this $8.9 billion offer for settlement.

April 13 2023 update: the big story is that there’s an $8.9 billion over the course of 25 years offer for settlement. Lawyers representing cancer patients who are part of MDL class action MDL collective action pledged to challenge the settlement Talc claimants. Why? They argue that it’s too little money for the those suffering from cancer who are 70,000. Does Johnson and Johnson still use talc. The lawyers say that J&J could negotiate a greater settlement or litigate individual claims if the most recent bankruptcy is thrown out.
But there is another group of lawyers that is not part of the leadership in that class action. The lawyers collectively have accumulated tens of thousands of cases. The group is seeking to settle with what they believe is less than the victims deserve. Their argument appears to be twofold. The first is that they claim the settlement – about 100,000 dollars per plaintiff is fair.
It’s a difficult argument to argue. But their second argument has more force: the victims can now not wait and they want to get their money right now.
April 12 2023 Update: People are looking for ways J&J can go through bankruptcy again. The answer is complex and convoluted. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future talc lawsuits conclusively. It believes it can pay less should there be an element of bankruptcy that puts pressure to negotiate a settlement. Does Johnson and Johnson still use talc. Moving past hundreds of years of American past, the company asserts that bankruptcy benefits all parties because it distributes settlement payments more evenly and effectively than trial courts, where some litigants receive significant awards while others receive nothing.
The main thrust of the 3rd Circuit decision was this isn’t a case that involves an enterprise that is profitable, forming an entity to assume the legal liability and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. However, the court also ruled that the entity was financially trouble because J&J offered unlimited financing.
Thus, J&J jumped on the funding unlimited part of the agreement and didn’t make any promises to offer unlimited funding for litigation. J&J claims that its revised financing arrangements with its subsidiary will address concerns of the appeals court while providing funds for claims. As if offering victims lesser money could solve the underlying issue.
Attorneys representing cancer victims who oppose the agreement counter this by arguing that the plaintiff is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s decision. The hyperbole wasn’t spared: victims’ lawyers call this the biggest “fraudulent move that has occurred in United States history.”
Despite all the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way of trying to push this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10 2023, Update Bloomberg provides an insightful piece on a law that has been passed of New Jersey that is shedding new light on litigation funding in the baby powder class action lawsuit. J&J has now offered an offer of $8.9 billion to settle any lawsuits.
The involvement of the funders is publicly available due to an New Jersey court rule requiring the disclosure of certain information about funders outside the state. The rule aims to respond to the increasing calls for regulation of the litigation funders. J&J has to deal with more than 60,000 lawsuits when you take into account state and federal Baby Powder lawsuits. Third-party funding of mass tort cases has its pros and pros and. There is no doubt that we are seeing how third-party funding can level the playing field for individuals and large corporations in court.
April 4, 2023 Update: It is enjoyable to see the worm turning in this case. J&J has taken another blow this week when it was found that the Third Circuit denied J&J’s request to extend the automatic stay while J&J appeals an order granting bankruptcy at the U.S. Supreme Court. Automatic stays have froze hundreds of cases involving talcum powder and stopped any new lawsuits from arising ever since J&J launched the controversial attempt to spin talc-related liabilities into a bankrupt entity over one year ago.
