J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday which outlines how the company will pay various types of cancer victims in bankruptcy settlement. Does Johnson and Johnson use talc. J&J has stated that its Talc products are safe, and won’t cause cancer. It’s trying for a second time to resolve more than 38,000 lawsuits filed in bankruptcy, and to prevent any new cases from arising in the future.
LTL’s bankruptcy plans would deposit $400 million into a separate trust for claims made from state attorney generals alleging that J&J had violated states’ unfair practices and consumer protection laws by misinforming consumers regarding the safety of its talc products.
Many states had initiated consumer protection actions against J&J prior to LTL’s bankruptcy filing stopped these investigations from progressing in 2021. Does Johnson and Johnson use talc. New Mexico and Mississippi had already brought suit against Johnson & Johnson before then as well as the states of Arizona, Maryland, North Carolina, Texas and Washington had issued subpoenas or civil investigative demands in LTL’s court papers.
New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy, joining cancer victims and their counterparts from the U.S. Justice Department’s bankruptcy watchdog. They have argued that a profitable company such as J&J cannot benefit from bankruptcy protections intended for those struggling with debt.
The first attempt by LTL to resolve the bankruptcy lawsuits was dismissed after similar arguments. A U.S. appellate court decided that LTL had not been in “financial financial distress” and therefore not eligible to receive bankruptcy relief. Does Johnson and Johnson use talc. LTL made a new bankruptcy application within two hours of that dismissal, arguing that its second attempt was different as it had less money available and had more support for a settlement.
New Mexico and Mississippi said in their motion to dismiss that LTL’s new bankruptcy violates state law enforcement powers by seeking to unilaterally limit the liability of the company in state consumer protection actions.

LTL’s new filings also included more information on how the company would evaluate and pay claims for cancer should the bankruptcy plan be approved.
The maximum amount under the settlement would be $500,000 for people diagnosed with mesothelioma that is terminal before the age of 45, and $260,000 for those who have been diagnosed with advanced ovarian cancer before age 45.

Judge orders J&J, talc opponents to discuss settlement negotiations.
Following another round of hearings in Johnson & Johnson’s effort to implement a Texas Two-Step bankruptcy strategy to resolve talc litigation and federal bankruptcy judge Michael Kaplan has ordered the firm and the people who opposed the plan to enter into negotiations to settle the matter, Bloomberg reports.
In its second bankruptcy effort for LTL Management–a subsidiary established by J&J to hold the claims–the company offered a settlement amounting to $8.9 billion. Does Johnson and Johnson use talc. While a firm representing plaintiffs supports the deal, another group opposes the move.
Earlier this week, the opposition group, known as the Official Committee of Talc Claimants requested the bankruptcy court for dismissal of the matter asserting that LTL is not considered to be in financial hardship.
“The filing is a desperate and legally deficient attempt by a handful of law firms to try to stop claimants from voting on the resolution plan–a plan that the overwhelming majority of claimants favor,” J&J’s litigation chief Erik Haas, said in an announcement. Does Johnson and Johnson use talc. “The law firms involved in their filing are financially oriented and have conflicts that are in conflict with, diverge from, and infringe on the rights they represent. We’ll soon submit a response in the appeals court.”
Does Johnson and Johnson use talc. Clay Thompson, a lawyer for MRHFM, which is home to more than patients with mesothelioma who have filed lawsuits against J&J claimed that J&J’s second bankruptcy effort will fail.
“J&J issues press releases about how wonderful its plans are, but is insisting that the details of its plan–including the treatment the individual sick individuals would receive — be kept private,” Thompson said in an announcement. “What is J&J’s plan to conceal?”
Kaplan has instructed the sides to devise a second arrangement plan under the supervision from two mediators.
On February 20, 2022 Kaplan affirmed the ability of J&J’s use of Chapter 11 to hasten a settlement that would relieve the company from the thousands of lawsuits over its talcum products.
However, in the month of January, a federal appeals court overturned the ruling, ruling that the business could not be considered to be in “financial difficulty.”
In the event that J&J’s request to challenge the U.S. Supreme Court was denied at the end of April J&J was granted a second petition for bankruptcy about two hours later. In response to that move, Kaplan froze the lawsuits for 60 days, allowing the company to decide whether or not to approve to file for bankruptcy again.

In a letter filed this week, U.S. trustee Andrew R. Vara wrote that the doors of the bankruptcy court are “open to honest but unfortunate debtors.” Those doors “are not open to any parties that do not have a legitimate purpose or that seek to abuse the bankruptcy process to hinder or delay their creditors,” Vara continued.
To its credit, J&J maintains there is no definitive evidence to suggest that its talc products, including its iconic baby powder, cause cancer. J&J has taken the products from the market and will first launch them to be available in North America in 2020–and the remainder of the globe later this year.
J&J intends to steer clear of the cost of going to court. J&J has won the majority of the cases that were decided in court, however some losses have been very punishing.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Does Johnson And Johnson Use Talc
June 2 2023 Update: At an asbestos talc court trial held at the trial in California yesterday, a couple of technical issues disrupted the opening statements of the defense attorneys. Does Johnson and Johnson use talc. The jurors, attending at home via Zoom and hearing the Johnson & Johnson’s lawyer voice his doubt about the science of the 70s asserting the presence of asbestos in their product before the session abruptly ended.
Meanwhile, the plaintiff was able to present an initial witness Arthur Langer. Langer explained that the occurrence of additional minerals along with the talc’s mineral content is inevitable. He claimed that his group had notified J&J in 1971 of the presence of chrysotile asbestos the talc produced by the company, although with less than 0.1 percent. He also uncovered more asbestos in 1976.
June 1, 2023 Update: Does Johnson and Johnson use talc. First trial after J&J made the decision to split its Talc division, and then declare bankrupt marks an important point within the ongoing lawsuit controversy. Trial began yesterday in the poignant case of a young 24-year-old plaintiff, diagnosed with an aggressive and rare form of mesothelioma last year, which both sides acknowledge is a harrowing tragedy.
Opening statements laid bare distinct differences between each side’s story. The plaintiff’s attorney took aim towards Johnson & Johnson, alleging the use of deceitful techniques in its research practices and throughout the litigation process. According to the attorney the company attempted to manipulate the definition of asbestos, despite internal documents dating back to between 1978 and 1994 that showed fibers discovered in the plaintiff’s tissue are included.
Johnson & Johnson’s precarious $8.9 billion settlement offer hangs in the balance with the course of this trial. Despite the distinctive nature of the mesothelioma trial and its distinct issues compared to most talcum powder lawsuits, a verdict favoring the plaintiff could cause the company with a major setback in its hope of gaining broad acceptance for their proposed settlement with plaintiffs.
May 31st, 2023: Update from Johnson & Johnson’s bankrupt talc division is defending its Second Chapter 11 filing in the opposition of the talc injury plaintiffs. In an appeal to the New Jersey bankruptcy court, the subsidiary argued that the situation was vastly different from the first filing. It emphasized the unprecedented commitment of $8.9 billion by J&J as the largest ever settlement in a mass tort bankruptcy case. Does Johnson and Johnson use talc. The issue is not discussed: whether the size of the settlement indicates that it is a fair settlement. J&J also claimed that it received support from several plaintiffs’ legal firms that represent over 60,000 claimants. This is hard to verify but it’s likely to be false.
May 24, 2023 Update: Since Johnson and Johnson’s bankruptcy filing in 2021 filing, the first trial concerning its cosmetic talc items allegedly that contain asbestos is scheduled to start jury selection on Monday in California at Alameda County Superior Court, a historically good jurisdiction for plaintiffs. Plaintiff claims that mesothelioma resulted from asbestos exposure from J&J’s products which J&J does not deny. The trial also includes six retailers who are accused of selling talc-containing products.
May 22nd, 2023 Update: Lawyers involved in the 2nd J&J talc bankruptcy are now battling over who should be appointed to the role of future claims representative. This is a role that is critically essential in resolving the claims involving talc. Does Johnson and Johnson use talc. Randi Ellis, a lawyer who frequently appears in MDLs all over the nation, was appointed as the claims representative in the initial bankruptcy. J&J’s defense group wants Ellis to be appointed to this position and again, but attorneys for the talc plaintiffs have raised objections due to the fact that Ellis has an interest conflict that would prevent her from assuming that position again. The conflict stems from the reality that Ellis was apparently involved in the drafting of the highly disputable second bankruptcy, which raises doubts about her capability to remain neutral. However, the reality is that this bankruptcy will likely to be dismissed regardless.
May 17, 2023 Update The pretend company that J&J made up to settle the talc litigation bankruptcy has informed a New Jersey bankruptcy court that they have allocated $400 million to settle the claims of states that accuse the company of deceptive advertising for its talc product. Does Johnson and Johnson use talc. It’s a $8.5 billion settlement for cancer sufferers. It’s hard to imagine an eventuality where J&J will be able to push these settlements for babies in these figures. While J&J’s $8.5 billion offer sounds like a huge sum at first, it does not appear appealing when you consider the math. The proposed settlement based on our rough calculations, would not provide victims with much more than a median settlement of $100,000 per instance. It’s not enough.
May 15th 2023, Update J&J is potentially facing a suit from an advocacy group representing cancer victims. Does Johnson and Johnson use talc. The group claims J&J intentionally withdrew a $61.5 billion fund-raising agreement that it had with its company subsidiary LTL Management LLC, to create the appearance of financial hardship and verify the unit’s Chapter 11 bankruptcy filing. The group claims that this move is a fraud transfer of the rights of compensation for victims. They will investigate J&J’s actions following of the dismissal of the LTL’s bankruptcy case in its first instance.
May 10 2023 Update: During the next week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to reject the second bankruptcy filing from J&J company LTL Management. However, in the meantime this bankruptcy court has issued an order calling for both parties to take part in a settlement mediation hoping that a global settlement deal can come to fruition.
May 5, 2023 Update: The talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer through asbestos exposure. Does Johnson and Johnson use talc. Over 2,700 people have sued the company and it is spending $1 million a month on legal defense. The company’s recent $29 million verdict in South Carolina forced it to pursue bankruptcy protection, and arguing for an equitable distribution of assets among talc claimants instead of being taken by the receiver. Other talc suppliers have also been forced to file for bankruptcy as a result of litigation.
May 4, 2023, Update U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to relaunch settlement discussions with lawyers who rebuffed the company’s proposed $8.9 billion settlement offer. It was in Trenton, New Jersey yesterday, the parties gathered in court to discuss next steps to take in another bankruptcy proceeding and Judge Kaplan was pushing for more settlement discussions.
This is the best way to resolve these claims for J&J. A settlement for baby powder can get done. Does Johnson and Johnson use talc. However, it’ll require more money, more billions of dollars by Johnson & Johnson.
Lawyers are divided on whether or not to agree with the proposal and not all clients see the situation the same way their attorney does. This second case of bankruptcy is bound to fail, and Judge Kaplan has scheduled a hearing for June to decide if he will discharge the bankruptcy for the 2nd time.
May 3, 2023 Update The group of cancer victims suing Johnson & Johnson (J&J) asked to have J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail litigation over talc products. The committee representing talc claimants made a motion Tuesday, asking that the Third Circuit to consider their case and send it back before a court of lower jurisdiction, with instructions to dismiss the bankruptcy. Does Johnson and Johnson use talc. The committee also requested that the stopped tort litigation against J&J allow the litigation to proceed.
LTL has filed for Chapter 11 protection once again following its bankruptcy filing that was rejected in the Third Circuit earlier this year which offered a $8.9 billion payment. The committee believes that the recent ruling, which allows LTL’s 2nd Chapter 11 to continue, in addition to halting trials against J&J, warrants immediate Third Circuit review. The US Trustee also requested that an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a formal response in the appeals court, saying that the filing is a “desperate and legally deficient attempt” by a handful of law firms with different financial interests.
May 1 2023 Update: A question people keep asking is how plaintiffs and their lawyers turn around $8.9 billion. Of course, that is an immense amount of money. But there are plenty of victims. Does Johnson and Johnson use talc. And these are really good case for plaintiffs. We were reminded recently in two talc trials which ended in large verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon led to a verdict that was $18.1 million. The following month, a second mesothelioma trial involving talc was held for hearing within South Carolina and resulted in a verdict of $29 million in favor of plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. One of the top suppliers of talc within the U.S.
April 30 2023 Update: When J&J first tried to bring the talcum powder litigation into bankruptcy, it was met with the option of putting aside $2 billion for settlements. It was a ridiculously small amount. There was no one among the talc victims who were in favor of the offer. This time, J&J has increased the offer to $8.9 if the talc plaintiffs will allow a bankruptcy settlement and they also have the support of a substantial section of the talc victims and their lawyers. Does Johnson and Johnson use talc. But 75% of the plaintiffs who are a talc, which is required to approve bankruptcy plans It’s a long and difficult process since there are so many lawyers with massive collections of baby powder lawsuits that are opposed in favor of the deal.
What can be done to end the impasse? More billions.
April 25 2023, Update Talc cancer claimants have demanded a judge disqualify the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, insisting that the company is not financially strained. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Does Johnson and Johnson use talc. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company was not eligible for bankruptcy relief as it did not show financial distress.
The plaintiffs argue that the 2nd Chapter 11 case is an misuse of the bankruptcy system and it is being pursued in bad faith. J&J says the bankruptcy settlement is backed by “significant support” from the firms that represent around 60,000 plaintiffs. It’s safe to say that the plaintiffs’ attorneys and the victims are split over what they believe is an $8.9 billion deal.
April 21st, 2023 Update A bankruptcy judge ruled that Johnson & Johnson must face new lawsuits alleging that the firm sold tainted baby powder causing cancer. Although trials for the talc lawsuits have been suspended for a minimum period of 60 days but new lawsuits can be filed and lawyers are able to begin preparing their cases. Does Johnson and Johnson use talc. Judges expressed doubt about J&J’s attempt to relaunch its strategy in a second bankruptcy case.
April 13th, 2023 update: the big story is that there’s an $8.9 billion over 25 years offer for settlement. Lawyers representing cancer victims who are part of MDL class action MDL class action have vowed to fight the settlement alongside those who claim talc. Why? They argue that it’s too little money for the 70 000 cancer patients. Does Johnson and Johnson use talc. These lawyers believe that J&J should seek a bigger settlement or even litigate individual claims if the latest bankruptcy is thrown out.
There is a different group of lawyers outside of the leadership of that class action. They have amassed tens of thousands of cases. The group is seeking to settle in what many believe to be less than these victims deserve. Their argument appears to be twofold. The first is that they claim the settlement, which is about an average of $100,000 per plaintiff is fair.
That is a hard argument to make. However, their second argument has more substance: the victims will no longer wait and want to get their money right now.
April 12 2023 Update: Many are wondering if J&J is able to file for bankruptcy once more. The answer is complex and convoluted. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future talc lawsuits conclusively. Also, it thinks it will pay less should there be the bankruptcy element which applies pressure for a settlement. Does Johnson and Johnson use talc. Going back to 400 years of American time, the business argues that bankruptcy benefits everyone by dispersing settlement payments more evenly and effectively than trial courts where litigants are awarded significant payouts, while others are left with nothing.
The main thrust in the 3rd Circuit decision was this is not a matter of the profit-making company that has a subsidiary to take the legal burden and declare bankruptcy – something Congress thought of when drafting its Bankruptcy Code. However, the court also ruled the company was financially crisis due to the fact that J&J promises unlimited funding.
Thus, J&J decided to go with the unlimited funding part of the holding and didn’t promise that it would provide unlimited funds for cases. The company says that its revised financing arrangements with its subsidiary address the concerns of the appeals court while offering funds to pay claims. In the hope that offering victims less money would solve the underlying issue.
Attorneys representing cancer victims who are against the agreement argue this with what you conclude is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole was not spared by the victims’ lawyers, who call it the most significant “fraudulent transaction in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe that this bankruptcy will last. It is however a method of trying to push this $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10 2023, Update Bloomberg provides an insightful article about a new law in New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) over talc products in exchange in exchange for a portion of winnings. J&J is now offering to pay $8.9 billion to settle all lawsuits.
The funders’ involvement is publicly available due to a New Jersey court rule requiring the release of certain details about funders outside the state. The rules aim to respond to the increasing calls for regulation of litigation funders. J&J has more than 60,000 claims when you include state and federal Baby Powder lawsuits. Third-party financing in mass tort cases has pros and cons. But there is no question that we are witnessing how third-party funding could level the playing field between individual and big corporations in the courtroom.
April 4, 2023 Update: It is pleasing to see the worm turning in this lawsuit. J&J was hit again this week, when an appeals court in the Third Circuit denied J&J’s request to keep the automatic stay in place in the meantime that J&J appeals a bankruptcy ruling in the U.S. Supreme Court. Automatic stays have froze thousands of talcum powder cases and stopped new lawsuits from being filed ever since J&J initiated the controversial effort to spin the talc liability off into a bankrupt subsidiary over one year back. Does Johnson and Johnson use talc. When it was decided that the 3rd Circuit ruled that this bankruptcy was not legal some months ago, the stay was removed. J&J wanted to see it remain in effect until hearing the SCOTUS appeal. But the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that is that the Supreme Court is willing even to hear the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay having been fully lifted, the first new cases have been filed and transferred into the class action involving talcum powder MDL in over one year. Seven new talc cases were added to the MDL during the month of March and brought the total number of pending cases up to 37,522.
February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now demanding that be the U.S. Government Accountability Office (GAO) begin an investigation into the cost J&J Talc products have cost the government in the many years.
Recently, in an open letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of failing to recognize the dangers of its talc products for years while tax dollars were spent treating those injured by exposure to the product. This lawsuit comes a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
Does Johnson and Johnson use talc. J&J has to begin making fair settlement offers for victims in order in putting this behind it. This is a blemish on one of the most prestigious firms.
February 14 , 2023 Update: At the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
