J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company plans to pay different kinds of cancer sufferers in bankruptcy settlement. April 13, 2023: Update on the big story is that there’s an $8.9 billion over the next 25 year period settlement offered. Lawyers representing cancer victims involved in MDL class action MDL class action have pledged to fight the settlement with Talc claimants. Why? They argue that J&J should negotiate a larger settlement or settle individual claims if the latest bankruptcy is declared unconstitutional.
But there’s a separate set of lawyers who are not part of the top leadership in the class action. They have amassed many thousands of cases. The group is seeking to settle with what they believe is lower than what the victims should be paid. The argument they make is twofold. First, they argue the settlement, which is about 100 million dollars on average per plaintiff – is fair.
This argument isn’t easy to make. The second argument is more force: victims should not afford to wait any longer and need the money immediately.
April 12 2023 Update: Some people are seeking out how J&J can go through bankruptcy once more. The answer is complicated and complex. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future talc lawsuits conclusively. In other words, it believes it can pay less if there is an element of bankruptcy that puts pressure to settle. Does talc actually cause cancer. Moving past 400 years of American history, the firm believes that bankruptcy is beneficial to all parties because it distributes settlements more fairly and efficiently than trial courts, in which some litigants receive substantial awards while others receive nothing.
The gist in this 3rd Circuit decision was this is not a matter of the profit-making company that has a subsidiary to take the legal risk and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. However, it also stated that the subsidiary was not in financial difficulty due to the fact that J&J promised unlimited funding.
Then J&J did not hesitate to take advantage of the unlimited funding aspect of the agreement and didn’t promise to offer unlimited funding for the litigation. J&J claims that its revised financing arrangements with its subsidiary will address concerns of the appellate court, while providing funds for claims. It’s as if giving victims less money would solve the problem at hand.
Lawyers representing cancer patients who oppose the deal counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous decision. Hyperbole is not exempt attorneys representing the victims claim it the most significant “fraudulent move of assets in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. However, it’s a means to try and push the $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10 2023 Update: Bloomberg offers an informative piece on a law that has been passed in New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) concerning talc products in exchange for a portion of any wins. J&J has now offered to pay $8.9 billion in settlements for all lawsuits.
The involvement of funders is public knowledge due to the New Jersey court rule requiring the disclosure of certain information about outside funding backers. This rule is intended to address the rising calls for regulation of litigation funders. J&J is facing more than 60,000 claims when you combine federal and state child powder-related lawsuits. Third-party financing in mass tort cases has pros and cons. But there is no question that we are seeing the ways that third-party funding can even the playing field between individuals and big companies in the courtroom.
April 4, 2023 Update: It is interesting to watch the worm turn in this case. J&J has taken another blow this week, when it was found that the Third Circuit denied J&J’s request to continue the automatic stay in the meantime that J&J appeals a bankruptcy ruling in the U.S. Supreme Court. Automatic stays have stopped thousands of talcum powder cases and stopped new lawsuits from arising ever since J&J started the controversial process to spin the talc liabilities off into a bankrupt entity over a year back. J&J wanted to see it remain in effect until its SCOTUS appeal. But the answer was no.

March 16th 2023 Update: with the bankruptcy stay being in effect, the first new cases were filed and incorporated into the class action for talcum powder MDL in the space of a year. Seven new talc lawsuits were brought into the MDL during the month of March and brought the total number of cases in the pending process up to 37,522.
February 25 2023 Update The following information is available: A Congressmen from Tennessee is now calling for the U.S. Government Accountability Office (GAO) begin an investigation into the cost J&J talc products have cost the government over the decades.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc-based products for many years, while tax dollars were spent treating those injured by exposure to the chemicals. The demand comes just weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
