Does talc cause asbestos. J&J has declared that its products containing talc are safe and do not cause cancer. J&J is seeking another time to settle more than 38,000 lawsuits brought in bankruptcy, and to prevent any new cases from being filed in the future.
LTL’s bankruptcy plans would deposit $400 million to a separate trust for claims made in state courts by attorneys general alleging that J&J violated laws against unfair business practices in the State of New York and consumer protection laws by misinforming consumers regarding the security of its talc-based products.

Many states had initiated consumer protection actions against J&J prior to the time that LTL’s bankruptcy filing prevented those investigations from proceeding in 2021. Does talc cause asbestos. New Mexico and Mississippi had already launched lawsuits against Johnson & Johnson before then and states like Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative requests or subpoenas in LTL’s court papers.

New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy as well as cancer patients as well as those affected by cancer and the U.S. Justice Department’s bankruptcy watchdog. have argued that a profitable company like J&J cannot benefit from bankruptcy protections aimed at struggling debtors.
The first attempt by LTL to resolve the bankruptcy lawsuits was rejected after the same arguments. The U.S. appeals court determined it was not LTL was not in “financial distress” and ineligible of bankruptcy protection. Does talc cause asbestos. LTL declared bankruptcy a second time within two hours of the decision to dismiss, arguing that the second bankruptcy was different due to the fact that there was less money available and had a greater chance of securing a settlement.

New Mexico and Mississippi said in their motion to dismiss that LTL’s latest bankruptcy violation of state law enforcement powers by attempting unilaterally to cap the liability of the company in state consumer protection laws.

LTL’s new filings also included more details on how the company would evaluate and pay cancer claims should the bankruptcy plan be approved.

The most significant payments under the settlement would be $500,000 for people diagnosed with mesothelioma that is terminal before age 45 and $260,000 for those diagnosed with ovarian cancer that is terminal before age 45.

From there, the proposed settlement applies discounts depending on the severity and type of the cancer, the person’s age, the history of the use of talc, and other aspects. Does talc cause asbestos. For instance, a woman who used talc products weekly, had the family history of ovarian cancer and was diagnosed an ovarian cancer stage II at age 55 could be in line for a $21,125 payout under the settlement plan.

Judge gives order to J&J, talc opponents to participate in settlement talks.

Following another round of hearings in Johnson &Johnson’s attempt to use a Texas Two-Step bankruptcy strategy to settle talc lawsuits, federal bankruptcy Judge Michael Kaplan has ordered the company as well as those who oppose the move to conduct negotiations to settle the matter, Bloomberg reports.

With its second bankruptcy bid for LTL Management–a subsidiary established by J&J to hold the claims–the company proposed a settlement of $8.9 billion. Does talc cause asbestos. While a firm representing plaintiffs supports the settlement, a different group opposes the move.

This week, the opposition group, called the Official Committee of Talc Claimants and urging the bankruptcy court for dismissal of the matter by argument that LTL can not be considered in financial distress.

“The filing is a desperate and legally deficient attempt by a small number of law firms to prevent claimants from voting on the resolution plan, a plan the vast majority of claimants are in favor of,” J&J’s litigation chief Erik Haas, said in a statement. Does talc cause asbestos. “The law firms behind their filing are financially oriented and have conflicts that are in conflict with, diverge from and contravene those of their clients. We’ll soon submit a response to the appellate court.”

Does talc cause asbestos. Clay Thompson, a lawyer for MRHFM, which is home to more than mesothelioma patients who have sued J&J, said that J&J’s second bankruptcy attempt will fail.

“J&J sends out press releases that boast about how amazing the plan is but simultaneously insisting that the plan’s details, including what individual sick people would actually receive — be kept private,” Thompson said in an announcement. “What do they have to hide?”

Kaplan has instructed both sides to devise a second arrangement plan under the oversight and supervision of mediators.

In February 2022, Kaplan confirmed J&J’s use of Chapter 11 to hasten a settlement that would release J&J from the tens of thousands of claims over its talcum products.

But in January of this year an appeals court of the federal government overturned the decision, deciding that the business could not be considered in “financial trouble.”

After J&J’s contest the U.S. Supreme Court was dismissed at the end of April J&J was granted a second petition for bankruptcy two hours later. In response, Kaplan froze the lawsuits for 60 calendar days to decide whether to allow another bankruptcy.

J&J’s unstoppable profit engine goes out of control after $6.9B talc litigation charge.

With two Chapter 11 attempts, J&J has been able to buy 19 months in which cases have been on hold. Does talc cause asbestos. J&J wants the claimants to accept their settlement. J&J needs 75% approval in order for the agreement to be accepted.

In addition to the group of talc lawyers who panned the company’s bankruptcy play and the U.S. Trustee which is a division of the U.S. Department of Justice is also submitting a motion to dismiss LTL’s second bankruptcy.

In a recent filing, U.S. Trustee Andrew R. Vara wrote that the doors of the bankruptcy court remain “open to honest, but naive debtors.” The doors “are not open to parties that don’t have a legitimate bankruptcy purpose or that seek to use bankruptcy to hinder or delay their creditors,” Vara continued.

On the other hand, J&J maintains there is no conclusive evidence that its talc products, including the famous baby powder, can cause cancer. J&J has adopted the products of the market, first in North America in 2020–and the rest of the world later this year.

J&J intends to steer clear of the costly business of going to trial. It has prevailed in the majority of the cases decided in court, however some losses have been punishing.
A high-profile trial in Missouri produced a $4.7 billion verdict against the drug company but was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
Overall, J&J has lost nine trial cases in talc which are being appealed or decided. Out of 41 trials 32 have resulted in a win by J&J as well as mistrials or plaintiff verdict that was reversed in appeal. Does talc cause asbestos. Additionally, the company in 2020 sought to settle nearly 1000 cases for the sum of $100 million. Bloomberg stated at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Does Talc Cause Asbestos

June 2 2023 Update: During the asbestos talc trial which took place in California yesterday, a couple of technical issues halted the opening statement by the defense attorneys. Does talc cause asbestos. Jurors watching at home via Zoom however, heard Johnson &Johnson’s lawyer express skepticism about the 70s science affirming the presence of asbestos in their product prior to the opening was abruptly ended.

Meanwhile, the plaintiff was able to introduce the first of their witnesses, Arthur Langer. Langer said that the presence of other minerals alongside talc is expected. He also testified that his team advised J&J in 1971 about the presence of chrysotile asbestos in the company’s talc, albeit with just 0.1 percent. He also uncovered more asbestos in 1976.

June 1st, 2023 Update Does talc cause asbestos. The first trial since J&J made the decision to split its Talc division and declare bankruptcy marks an important moment within the ongoing litigation story. The trial started yesterday in the heartbreaking trial of a young plaintiff, diagnosed with a rare and aggressive form of mesothelioma last year, an illness that lawyers on both sides believe is a tragic loss.

Opening statements laid bare huge differences between the sides’ story. The attorney representing the plaintiff aimed his ire towards Johnson & Johnson, alleging the use of deceptive methods in their research practices as well as throughout the litigation procedure. According to the attorney Johnson & Johnson attempted to alter asbestos’ definition, in spite of internal documents dating from 1978 and 1994 showing that fibers discovered in the tissue of the plaintiffs are included.

Johnson & Johnson’s uncertain $8.9 billion settlement is hanging in the balance with the development of the trial. Despite the distinct nature of the mesothelioma trial and its distinctive issues in comparison to other talcum powder lawsuits ruling in favor of the plaintiff could cause an enormous setback for J&J’s hopes of broad acceptance of the settlement they have proposed among plaintiffs.

May 31, 2023 Update: Johnson and Johnson’s bankrupt talc business was able to defend the second Chapter 11 filing in the facing challenges from injured talc claimants. In an opposition filed with the New Jersey bankruptcy court, J&J’s subsidiary claimed that the filing was distinct from the prior filing. It highlighted the extraordinary commitment to $8.9 billion by J&J, the largest settlement ever in an bankruptcy case involving mass torts. Does talc cause asbestos. Not mentioned: how the size of the settlement implies that it is an equitable settlement. J&J also claimed support from various plaintiffs’ law firms that represent over 600,00 claimants. This is not easy to confirm but is probably incorrect.

May 24, 2023 Update: Since Johnson &J Johnson’s bankruptcy filing, the first trial concerning its cosmetic talc items allegedly comprised of asbestos is set to start jury selection on Monday in California in Alameda County Superior Court, the most favored jurisdiction for plaintiffs. The plaintiff claims his mesothelioma resulted from asbestos exposure in J&J’s product, an allegation that the company has denied. The trial also includes six retailers accused of selling talc products.

May 22nd, 2023 Update: Lawyers involved in the second J&J talc bankruptcy are battling over who should be appointed to the post of the claims representative in the future, an important role important to resolving the Talc claims. Does talc cause asbestos. Randi Ellis, a lawyer who regularly appears in MDLs throughout the United States, was appointed as the claims representative during the first bankruptcy. J&J’s defense attorneys want Ellis to be appointed to this position and again, but attorneys for the plaintiffs in talc are arguing because Ellis has an unrelated conflict of interest which should stop her from being appointed to that post in the future. The conflict stems from the issue that Ellis was believed to have been involved in drafting the hotly contesting second bankruptcy, which raises questions about her ability to be neutral. The reality is this bankruptcy will likely to get dismissed anyway.

May 17, 2023 Update The pretend company J&J formed for the talc bankruptcy disclosed to the New Jersey bankruptcy court that they have designated $400 million as a settlement for allegations made by states who accuse J&J of misleading marketing for its talc product. Does talc cause asbestos. This amounts to an $8.5 billion settlement for cancer victims. It’s difficult to imagine the scenario in which J&J will be able to push the settlements of baby powder through in these figures. While J&J’s proposed $8.5 billion offer might seem like a lot of money initially, it may not look good after you calculate the figures. This settlement offer based on our rough calculations – would not pay victims much more than a median settlement of $100,000 per case. This isn’t enough.

May 15, 2023 Update J&J is potentially facing a suit from an advocacy group representing cancer victims. Does talc cause asbestos. The group claims that J&J intentionally withdrew an $61.5 billion contract for funding that it had with its company subsidiary LTL Management LLC, to simulate financial distress and validate the unit’s Chapter 11 bankruptcy filing. The group argues that this act amounts to a fraudulent transfer of right to compensation for victims. They are planning to study J&J’s actions after the announcement of the decision to dismiss LTL’s first bankruptcy case.

May 10, 2023 Update: Next week in it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments in a motion dismiss the second bankruptcy filing from J&J company LTL Management. In the meantime this bankruptcy court has issued an Order that requires both parties to participate in a new settlement negotiation hoping that the global settlement can be brokered.

May 5, 2023 Update: Talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to many lawsuits claiming that its talc products cause cancer from asbestos exposure. Does talc cause asbestos. Over 2,700 people have sued the firm and it has been paying $1 million per month to defend itself. The company’s most recent $29 million verdict at the Supreme Court of South Carolina forced it to file for bankruptcy protection, arguing that assets should be distributed in an equitable manner between the claimants of talc instead of being taken in the hands of the receiver. Other talc suppliers have also filed for bankruptcy due to litigation.

May 4 2023 Update U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to resume talks with lawyers who have rejected the proposed $8.9 billion settlement offer. The court in Trenton, New Jersey yesterday, the parties gathered in court to discuss next steps in another bankruptcy proceeding. Judge Kaplan has pushed for further settlement talks.

This is the way to settle these claims with J&J. A baby powder settlement can be completed. Does talc cause asbestos. But it will require more money – billions of dollars – of Johnson & Johnson.

Lawyers are split on whether or not to agree with the proposal and not all clients view this issue the same way their lawyer views it. A second bankruptcy proceeding is destined to fail the judge Kaplan has set a date for a hearing in June to determine whether to remove the bankruptcy after the second.

May 3 2023 Update The group of cancer patients who have sued Johnson & Johnson (J&J) requested for J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block litigation regarding talc-related products. The group representing claimants for talc filed a motion on Tuesday asking for the Third Circuit to consider their case and send it back an earlier court with instructions to dismiss the bankruptcy. Does talc cause asbestos. They also asked that the stoppage of tort litigation against J&J be allowed to proceed.
LTL applied for Chapter 11 protection once again following its bankruptcy filing that was rejected by the Third Circuit earlier this year with a $8.9 billion payment. The committee believes that the recent decision allowing LTL’s 2nd Chapter 11 to continue, in addition to halting trials against J&J is a reason for urgent Third Circuit review. The US Trustee requested the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation, Erik Haas, was quoted by Bloomberg declaring that J&J plans to file a reply in the appeals court saying that the filing is a “desperate and legally inadequate move” by a small number of law firms with conflicts of financial interests.
May 1 2023 Update: One question people keep asking is how plaintiffs and their lawyers be able to turn around $8.9 billion. Of course, it’s a lot of money. But there are a lot of victims. Does talc cause asbestos. These are an excellent arguments for plaintiffs. We have been reminded of this recently with two talc trials resulted in big verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon ended in the verdict of $18.1 million. The following month, a second mesothelioma talc case was brought to trial on the other side of South Carolina and resulted in a verdict of $29million on behalf of the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. One of the top suppliers of talc in the U.S.
April 30 2023 Update: When J&J first attempted to drag the talcum powder litigation into bankruptcy, it came with the option of putting aside $2 billion for settlements. This was an absurdly low amount. The talc plaintiffs had not believed in it. This time around, however, J&J has increased the offer to $8.9 in the event that the talc victims accept a bankruptcy settlement and also has the support of a large section of the talc victims as well as their lawyers. Does talc cause asbestos. But with 75% of talc plaintiffs, which is required for bankruptcy plan approval is not an easy task due to the sheer number of lawyers with vast stocks of baby powder lawsuits that are opposed in favor of the deal.

What are the solutions to the impasse? More billions.
April 25 2023 Update Talc plaintiffs have asked a judge to reject the Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially strained. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Does talc cause asbestos. It was the 3rd Circuit dismissed its first Chapter 11 case in January and said that LTL was not a candidate to receive bankruptcy relief because it failed to show financial difficulties.

The claimants argue that the Second Chapter 11 case is an overreach of the bankruptcy system, and that it’s being conducted in bad faith. J&J claims the bankruptcy settlement has “significant support” from companies representing an estimated 60,000 people who are claiming. It’s safe to say that lawyers representing plaintiffs and victims ‘ lawyers are divided on what they believe is an $8.9 billion deal.

April 21st, 2023 Update: A bankruptcy judge decided the company Johnson & Johnson must face new lawsuits alleging that the firm sold tainted baby powder causing cancer. While trials in talc lawsuits are paused for a minimum of 60 days, new lawsuits can be filed and lawyers may begin to prepare their cases. Does talc cause asbestos. Judges expressed skepticism about J&J’s ridiculous effort to revive its strategy by filing the second bankruptcy case.

April 13th 2023 Update: The biggest update is about the $8.9 billion over 25 years of settlement. Lawyers representing cancer victims who are part of MDL class action MDL collective action promised to fight the settlement alongside Talc claimants. Why? They argue that it’s not enough money for those suffering from cancer who are 70,000. Does talc cause asbestos. They argue that J&J should seek a bigger settlement or settle individual claims in the event that the latest bankruptcy is dismissed.

However, there is a second group of lawyers that is not part of the top leadership in group action. These lawyers have collectively amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle now in what many believe to be far less than what these victims deserve. The argument they make is twofold. They argue that the settlement – which amounts to an average of $100,000 per plaintiff – is fair.

This argument isn’t easy to argue. However, their second argument has more substance: the victims will be no longer patient and demand to get their money right now.

April 12 2023 Update: Some people are seeking out how J&J is able to file for bankruptcy once more. The answer is complicated and convoluted. Let’s try to simplify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future talc litigations in a definitive manner. Also, it thinks it will pay less in the event of an element of bankruptcy that puts pressure to settle. Does talc cause asbestos. Going back to hundreds of years of American history, the company asserts that bankruptcy benefits all parties because it distributes settlement payments more equitably and efficiently than trial courts, which are where litigants get significant payouts, while others are left with nothing.

The main thrust in the 3rd Circuit decision was this isn’t a case that involves a profitable company making subsidiaries to meet the legal responsibility and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. But it also said it was not financially difficulty because J&J assured it of unlimited funding.
Then J&J took advantage of the funding unlimited part of the contract but did not pledge to offer unlimited funding for lawsuits. The company claims that its new financing agreements with its subsidiary addresses the appeals court’s concerns while still supplying funds for claim payments. As if providing victims with less money will solve the overarching problem.

Attorneys representing cancer victims who oppose the agreement counter this argument by saying that it is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier decision. The hyperbole wasn’t spared by the victims’ lawyers, who call it the biggest “fraudulent move in United States history.”

In spite of the legal jargon, J&J does not really believe that this bankruptcy will last. It is however a method of trying to push this $8.9 billion settlement through and maintain the pressure on plaintiffs.

April 10, 2023 update: Bloomberg provides an insightful article about a new law in New Jersey that is shedding new light on the funding of litigation in the Class action suit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a percentage of any winnings. J&J has now offered the payment of $8.9 billion in settlements for all lawsuits.

The involvement of the funders is publicly available because of a New Jersey court rule requiring the release of certain details regarding outside funding backers. This rule is intended to address the rising calls for regulation of the litigation funders. J&J is facing more than 60,000 claims when you include federal and state child powder-related lawsuits. Third-party financing in mass tort cases has pros and cons. However, there is no doubt that we are witnessing how third-party financing can help level the playing field between individuals and big companies in the courtroom.

April 4 2023 Update: It’s fun to watch the worm turning in this case. J&J suffered another setback this week when it was found that the Third Circuit denied J&J’s request to keep the automatic stay in place while J&J appeals a bankruptcy ruling at the U.S. Supreme Court. The automatic stay has froze thousands of talcum powder cases and stopped new lawsuits from arising ever since J&J started the controversial process to spin the talc debts off into a bankrupt entity over a year back. Does talc cause asbestos. After it was decided that the 3rd Circuit ruled that this bankruptcy was not legal some months ago, the stay was lifted. J&J wanted to see it remain in effect until its SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that of the Supreme Court is willing even to hear the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay having been officially lifted, the very first new cases have been filed and transferred into the class action involving talcum powder MDL within a year. Seven new talc cases were added to the MDL in the past month and brought the total number of pending cases up to 37,522.

February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now calling for the U.S. Government Accountability Office (GAO) initiate an investigation into the cost J&J products containing talc have cost the government over the years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the risks of its talc-based products for long while tax dollars spent on treating people who suffered injuries from exposure to the product. This lawsuit comes a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.

Does talc cause asbestos. J&J must begin making fair settlement offers to victims to begin in putting this behind. This is a disgrace to one of the most prestigious companies.

February 14 2023 Update: During an appearance today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
