April 12 2023 Update: Many are seeking out how J&J can file for bankruptcy again. The answer is complex and complicated. But let’s try to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only method to address both present and future lawsuits involving talc conclusively. In other words, it believes it can pay less when there is a bankruptcy element that creates pressure to negotiate a settlement. Lawyers representing cancer victims who do not agree with the agreement counter this argument by saying that it is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole did not go unnoticed the lawyers representing victims call it the biggest “fraudulent move ever in United States history.”

Despite the legal jargon, J&J does not really believe that this bankruptcy will last. But it’s a way to try and push the $8.9 billion settlement to keep the pressure on plaintiffs.

April 10, 2023 update: Bloomberg has an interesting article about a new law in New Jersey that is shedding new light on the funding of litigation in the suit for class actions. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) over talc products in exchange for a percentage of any settlements. J&J has now offered to pay $8.9 billion to settle lawsuits.

The involvement of funders is public information due to a New Jersey court rule requiring the release of certain details regarding outside funding backers. The rules aim to address the growing calls for regulation of the litigation funders. J&J has to deal with more than 60,000 lawsuits when you add up federal and state child powder-related lawsuits.
