J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm intends to pay different types of cancer sufferers in a bankruptcy settlement. May 22, 2023 Update: Lawyers involved in the second J&J talc bankruptcy are now fighting over who should be appointed to the role of a future claims representative. April 13, 2023: Update on the biggest news is the $8.9 billion over the course of 25 year period settlement offered. Lawyers representing cancer victims in the MDL Class Action have promised to fight the settlement along with talc claimants. Why? They think it is not enough to pay for 70 000 cancer patients. There is a different group of lawyers outside of the leadership in this class action. These lawyers have collectively amassed the equivalent of tens of thousands of lawsuits. They want to settle for what is believed to be lower than what the victims should be paid. Their argument appears to be twofold. First, they argue that the settlement – which amounts to the equivalent of $100,000 per plaintiff – is fair.

This is an argument that is difficult to argue. The second argument is more substance: the victims will be no longer patient and demand their money now.

April 12 2023 Update: Many are seeking out how J&J can file for bankruptcy again. The answer is complex and complicated. But let’s try to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only method to address both present and future lawsuits involving talc conclusively. In other words, it believes it can pay less when there is a bankruptcy element that creates pressure to negotiate a settlement. Does talc cause skin cancer. Going back to 400 years of American history, the company asserts that bankruptcy benefits all parties as it distributes settlement payments more equitably and effectively than trial courts where some litigants receive significant awards while others receive nothing.

The basic tenet of this 3rd Circuit decision was this isn’t a case that involves a profitable company making subsidiaries to meet the legal liability and declare bankruptcy – Congress had in mind when it came to drafting the Bankruptcy Code. It also clarified that the subsidiary was not in financial difficulty due to the fact that J&J promises unlimited funding.
So J&J took advantage of the funding unlimited part of the contract and didn’t make any promises to fund unlimited cases. The company claims that revised financing arrangements with its subsidiary address the appeals court’s concerns while still offering funds to pay claims. It’s as if giving victims less money would solve the underlying issue.

Lawyers representing cancer victims who do not agree with the agreement counter this argument by saying that it is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole did not go unnoticed the lawyers representing victims call it the biggest “fraudulent move ever in United States history.”

Despite the legal jargon, J&J does not really believe that this bankruptcy will last. But it’s a way to try and push the $8.9 billion settlement to keep the pressure on plaintiffs.

April 10, 2023 update: Bloomberg has an interesting article about a new law in New Jersey that is shedding new light on the funding of litigation in the suit for class actions. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) over talc products in exchange for a percentage of any settlements. J&J has now offered to pay $8.9 billion to settle lawsuits.

The involvement of funders is public information due to a New Jersey court rule requiring the release of certain details regarding outside funding backers. The rules aim to address the growing calls for regulation of the litigation funders. J&J has to deal with more than 60,000 lawsuits when you add up federal and state child powder-related lawsuits. Third-party funding of mass tort cases has both pros and pros and.
