Johnson & Johnson (JNJ.N) has put aside $400 million to resolve U.S. state consumer protection actions as part of its broader $8.9 billion plan to settle claims that its Baby Powder and other talc items cause cancer. Does talc contain amphibole asbestos.

J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm will pay various types of cancer sufferers in bankruptcy settlement. Does talc contain amphibole asbestos. J&J has said that its Talc products are safe and will not cause cancer. LTL’s bankruptcy plan will pay $400 million into an additional trust to settle lawsuits filed from state attorney generals claiming that J&J had violated state unfair business practices and consumer protection laws by misleading consumers regarding the security of its talc-based products.

A number of states had already initiated consumer protection measures against J&J before LTL’s first bankruptcy filing prevented those investigations from taking place in 2021. Does talc contain amphibole asbestos. New Mexico and Mississippi had already filed suits in the past against Johnson & Johnson before then and states like Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative requests or subpoenas, according to LTL’s court papers.

New Mexico and Mississippi have taken steps to halt the bankruptcy of LTL as well as cancer patients as well as their counterparts from the U.S. Justice Department’s watchdog on bankruptcy, who argue that a profit-making business like J&J is not eligible for bankruptcy protections designed for struggling debtors.
The first attempt by LTL to resolve the bankruptcy cases was dismissed after similar arguments, when a U.S. appeals court determined it was not LTL wasn’t in “financial distress” and therefore not eligible to receive bankruptcy relief. Does talc contain amphibole asbestos. LTL declared bankruptcy a second time in just two hours following the dismissal, arguing the second bankruptcy was different as it was able to borrow less and more support for a settlement.

New Mexico and Mississippi said in their motion to dismiss LTL’s new bankruptcy violates the law enforcement powers of the state by trying to unilaterally cap LTL’s liability to state consumer protection actions.

LTL’s filings for the new year also contained more information on how the company would evaluate and settle cancer claims when the bankruptcy plan is approved.

The largest amount of money under the settlement will be $500,000 for people diagnosed with cancer of the mesothelioma ovary before age 45. Does talc contain amphibole asbestos. The second payment would be $260,000 for those diagnosed with advanced ovarian cancer before age 45.

The proposed settlement will offer discounts based on the nature and severity of the cancer, the person’s age, the history of usage of talc and other variables. Does talc contain amphibole asbestos. For instance someone who regularly used talc products weekly, had an ovarian cancer family history, cancer and was diagnosed Stage II cancer of the ovary at the age of 55 may be eligible to receive a payment of $21,125 under the settlement plan.

Judge decides J&J and talc opponents to discuss settlement negotiations.

After another round of hearings in Johnson &Johnson’s attempt to utilize a Texas Two-Step bankruptcy strategy to resolve talc litigation and federal bankruptcy judge Michael Kaplan has ordered the firm and the people who opposed the plan to enter into settlement talks, Bloomberg reports.

With its second bankruptcy attempt for LTL Management, a subsidiary created by J&J to hold the claims–the company offered a settlement of $8.9 billion. Does talc contain amphibole asbestos. While one firm representing plaintiffs is in favor of the proposal, another group is opposed to the offer.

The previous week, the opposition group, dubbed”The Official Committee of Talc Claimants, urged the bankruptcy court to dismiss the case by argument that LTL is not a factor in financial hardship.

“The filing is a desperate and legally deficient attempt by a tiny number of law firms to block claimants from voting on the resolution plan, a plan the vast majority of claimants support,” J&J’s litigation chief Erik Haas, said in a statement. Does talc contain amphibole asbestos. “The law firms involved in these filings have interests in finance that do not align with, diverge from, and are in opposition to the interests that their customers. We’ll submit a response before the court of appeals.”

Does talc contain amphibole asbestos. Clay Thompson, a lawyer for MRHFM that boasts more than mesothelioma clients who have sued J&J claimed that J&J’s second bankruptcy attempt is likely to fail.

“J&J sends out press releases about how wonderful the plan is but simultaneously insisting that the plan’s details, including what each sick person will receive,” Thompson said in a statement. “What does the company have to keep secret?”

Kaplan has directed the parties to come up with another strategy for reorganization, under the supervision from two mediators.

On February 20, 2022 Kaplan stated that J&J’s use of Chapter 11 to hasten a settlement that would release the company from the tens of thousands of claims over its talcum products.

But in the month of January, an appeals court of the federal government overturned the verdict, ruling that the business could not be considered to be in “financial difficulty.”

In the event that J&J’s request to make an appeal before the U.S. Supreme Court was dismissed in April, J&J applied for its first bankruptcy about two hours later. In response, Kaplan froze the lawsuits for 60 days to decide whether to allow an additional bankruptcy.

J&J’s unstoppable profit engine sputters after $6.9B talc litigation charge.

With Two Chapter 11 attempts, J&J has purchased 19 months of which the cases were in limbo. Does talc contain amphibole asbestos. J&J wants the claimants to decide whether they want to accept the settlement. J&J would need 75% approval for the deal to pass.

Alongside the group of talc attorneys who have panned the company’s bankruptcy and the U.S. Trustee, a branch belonging to the U.S. Department of Justice has also filed an application to dismiss LTL’s second bankruptcy case.

In a letter filed this week, U.S. Trustee Andrew R. Vara wrote that the the bankruptcy court remain “open to honest, but naive debtors.” These doors “are not available to anyone that lack a legitimate bankruptcy goal or who seek to take advantage of the bankruptcy process to hinder or delay their creditors,” Vara continued.

In its own words, J&J maintains there is no proof conclusive that their talc products, including its popular baby powder can cause cancer. J&J has taken its products off of the market–first in North America in 2020–and the remainder of the globe later this year.

J&J wants to avoid the cost of going to trial. The company has won most of the cases that were decided in court, however certain losses have been extremely harsh.
A highly-publicized trial in Missouri ended in a $4.7 billion verdict against the drugmaker and was later lowered to $2.1 billion following appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
Overall, J&J has lost nine trial involving talc that are on appeal or have been resolved. Out of 41 trials 32 have ended in a win by J&J or a mistrial, or plaintiff verdict that was reversed after appeal. Does talc contain amphibole asbestos. Separately, the company in 2020 moved to settle more than 1,000 cases worth the sum of $100 million. Bloomberg stated at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Does Talc Contain Amphibole Asbestos

June 2 2023 Update: During the trial for asbestos-containing talc in California yesterday, some technical issues disrupted the opening statement by the defense attorneys. Does talc contain amphibole asbestos. Jurors from their homes via Zoom but did not hear Johnson &Johnson’s lawyer express doubts about the 70s research asserting the presence of asbestos in their product before the opening was abruptly ended.

The plaintiff was able to introduce the first of their witnesses, Arthur Langer. Langer explained that the existence of other minerals alongside talc is expected. He said that his team had notified J&J in the year 1971 about the presence of asbestos chrysotile in the talc manufactured by the company, though at less than 0.1 percent. He also found more asbestos in 1976.

June 1, 2023 Update: Does talc contain amphibole asbestos. This is the first court trial that has taken place since J&J took the decision to disband its talc segment and file for bankruptcy marks an important moment within the ongoing lawsuit saga. The trial started yesterday in the harrowing case of a young 24 year-old plaintiff, diagnosed with an extremely rare and aggressive form of mesothelioma last year, an illness that lawyers on both sides acknowledge is a harrowing tragedy.

Opening statements revealed the stark differences in each side’s story. The attorney representing the plaintiff aimed his ire at Johnson & Johnson, alleging the use of deceitful tactics in research practices and throughout the litigation process. The attorney claims that, according to, the company tried to manipulate asbestos’ definition, in spite of internal documents from 1978 and 1994 showing that asbestos fibers that were found in the plaintiff’s tissue are included.

Johnson &J’s tangled $8.9 billion settlement offer hangs in the balance with the progress of this trial. Despite the distinctive nature of this mesothelioma case and its unique challenges compared to other lawsuits involving talcum powder ruling in favor of the plaintiff could cause an enormous setback for J&J’s hope of gaining broad acceptance for their proposed settlement among plaintiffs.

May 31st, 2023 Update: Johnson and Johnson’s bankrupt talc unit strongly defended the 2nd Chapter 11 filing in the opposition of victims of talc injuries. In an opposition filed with the New Jersey bankruptcy court, J&J’s subsidiary claimed that the filing was distinct from the prior filing. It also emphasized the unprecedented commitment to $8.9 billion by J&J the largest settlement ever in any bankruptcy case that involves mass tort. Does talc contain amphibole asbestos. There was no mention of how the amount of the settlement means it is an equitable settlement. J&J also claimed that it received support from several plaintiffs’ legal companies representing over sixty thousand claimants. It is difficult to confirm but likely incorrect.

May 24 2023 Update: Following Johnson & Johnson’s 2021 bankruptcy filing, the first trial concerning the cosmetic talc products it claims to that contain asbestos is scheduled to start jury selection Monday, California within the Alameda County Superior Court, the most favored court for plaintiffs. The plaintiff claims that his mesothelioma is the result of asbestos exposure through J&J’s products which the company denies. The trial also includes six retailers who are accused of selling talc-containing products.

May 22nd, 2023 Update Lawyers involved in the second J&J talc bankruptcy are now fighting over who should be chosen to fill the position of future claims representative, an important role critical to resolving claim for talc. Does talc contain amphibole asbestos. Randi Ellis, a lawyer who regularly appears in MDLs throughout the United States, was appointed as the claims representative during the first bankruptcy. J&J’s defense team would like Ellis to be appointed in that position in the future, however lawyers representing the talc plaintiffs are objecting on the grounds that Ellis has conflicts of interest which would prohibit her from assuming that position again. The dispute stems from issue that Ellis was involved in drafting the controversially contested second bankruptcy, which raises concerns regarding her capacity to remain neutral. However, the reality is that this bankruptcy is likely to be dismissed regardless.

May 17, 2023 Update The pretend company J&J created for the talc litigation bankruptcy told a New Jersey bankruptcy court that they had allocated $400 million to settle allegations made by states who accuse the company of misleading advertising for its talc product. Does talc contain amphibole asbestos. That’s an $8.5 billion settlement for cancer patients. It’s difficult to imagine the scenario in which J&J could push the settlements of baby powder through in these figures. While J&J’s $8.5 billion offer seems like a huge sum initially, it does not look great after you calculate the figures. This settlement proposal – by our rough calculations, would not provide victims with much more than a median settlement of $100,000 per instance. That is not enough.

May 15th 2023, Update J&J might be facing suit from an advocacy group representing cancer patients. Does talc contain amphibole asbestos. The group claims that J&J deliberately retracted a $61.5 billion fund-raising agreement in conjunction with its affiliate, LTL Management LLC, to simulate financial stress and verify the unit’s Chapter 11 bankruptcy filing. The group claims that this move amounts to a fraudulent transfer of right to compensation for victims. They are planning to study J&J’s actions as a result of the denial of LTL’s first bankruptcy case.

May 10 2023 Update: Next week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to dismiss the second bankruptcy filing that was filed by J&J subsidiaries LTL Management. However, in the meantime, LTL Management has filed an order requiring both sides to take part in a new settlement negotiation in the hope that a global settlement deal can reached.

May 5, 2023 Update: The talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging that its Talc products caused cancer through asbestos exposure. Does talc contain amphibole asbestos. Over 2700 people have sued the company and it is spending $1 million a month to defend itself. The company’s recent $29 million settlement at the Supreme Court of South Carolina forced it to apply for bankruptcy protection and argue that assets should be distributed in an equitable manner between talc claimants rather than being taken from the receiver. Other suppliers of talc have declared bankruptcy because of litigation.

May 4 2023 Update: U.S. The bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to restart settlement discussions with lawyers who rebuffed Johnson & Johnson’s $8.9 billion agreement. The court in Trenton, New Jersey yesterday, the parties appeared in court to discuss the next steps to take in this second case of bankruptcy. Judge Kaplan pushed more settlement talks.

This is the best way to settle these claims with J&J. A baby powder settlement could be made. Does talc contain amphibole asbestos. However, it will require more money, more billions of dollars – by Johnson & Johnson.

Lawyers are split on whether to accept the proposal and not every client sees the issue the same way their lawyer views it. Second bankruptcy cases are expected to fail as Judge Kaplan has set a date for a hearing in June to decide if he will discharge the bankruptcy for the 2nd time.

May 3 2023 Update The group of cancer patients who have sued Johnson & Johnson (J&J) asked an order from J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block the litigation involving talc products. The group representing the claimants has filed a motion this week asking that the Third Circuit to consider their case and then send it back before a court of lower jurisdiction, with instructions for dismissing the bankruptcy. Does talc contain amphibole asbestos. They also asked that stoppage of tort litigation against J&J be allowed to proceed.
LTL applied for Chapter 11 protection once again following the bankruptcy filing it made earlier was denied in the Third Circuit earlier this year with an $8.9 billion agreement. The committee believes that the recent ruling which allowed the second Chapter 11 to continue, and also stopping trials against J&J should be subject to urgent Third Circuit review. The US Trustee also requested that an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation Erik Haas, was quoted by Bloomberg saying that J&J intends to file a response in the appeals court declaring the filing a “desperate and legally insufficient plan” by a handful of law firms that have conflicts of financial interests.
May 1 2023 Update: One frequently asked question is how the plaintiffs’ lawyers and their clients turn off $8.9 billion. That’s of course a lot of money. There are a lot of victims. Does talc contain amphibole asbestos. They are a great arguments for plaintiffs. We were reminded of this recently in two talc trials which ended in large verdicts for the plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon was settled with the verdict worth $18.1 million. In the same month, a different mesothelioma trial involving talc was held for trials at South Carolina and resulted in a verdict of $29 million on behalf of the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. One of the largest manufacturers of talc in U.S.
April 30th, 2023 Update: When J&J first attempted to drag the litigation over talcum powder into bankruptcy, it did so with an offer to reserve $2 billion for settlements. The sum was ridiculously low. None of the talc plaintiffs agreed with the offer. This time, however, J&J has increased the offer to $8.9 if the talc plaintiffs will allow a bankruptcy settlement and they have the support of a substantial portion of the talc plaintiffs and their lawyers. Does talc contain amphibole asbestos. But with 75% of plaintiffs of talc are required to approve bankruptcy plans is a difficult road due to the sheer number of lawyers with huge inventory of baby powder-related lawsuits, opposed to the settlement.

What are the solutions to the impasse? More billions.
April 25, 2023, Update Talc cancer claimants have requested a judge to dismiss their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Does talc contain amphibole asbestos. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that LTL was not a candidate for bankruptcy relief because it failed to show financial trouble.

The claimants assert that LTL’s 2nd Chapter 11 case is an misuse of the bankruptcy system and that it’s being conducted in bad good faith. J&J asserts that the bankruptcy settlement receives “significant backing” from the firms that represent an estimated 60,000 plaintiffs. It’s fair to say that lawyers representing plaintiffs and victims ‘ lawyers are divided on what they believe is an $8.9 billion settlement offer.

April 21st, 2023 Update A bankruptcy judge has ruled in favor of Johnson & Johnson must face new lawsuits alleging that the company sold baby powder that was contaminated and causing cancer. Although trials for Talc lawsuits are suspended for a minimum period of 60 days but new lawsuits can be filed, and lawyers may begin to prepare their cases. Does talc contain amphibole asbestos. Judges expressed doubt about J&J’s attempt to revive its strategy by filing another bankruptcy case.

April 13, 2023 update: the most important story is that there’s an $8.9 billion over 25 years offer for settlement. Lawyers representing cancer victims who are part of the MDL class action have promised to challenge the settlement those who claim talc. Why? They feel it’s not enough to pay for more than 70,000 cancer victims. Does talc contain amphibole asbestos. These lawyers argue that J&J could negotiate a greater settlement or even litigate individual claims if the most recent bankruptcy is thrown out.

But there is another lawyer group that isn’t part of the leadership in this class action. These lawyers have amassed the equivalent of tens of thousands of lawsuits. This group wants to settle in what many believe to be less than the victims deserve. Their argument appears to be two-fold. The first is that they claim the settlement – which amounts to the equivalent of $100,000 per plaintiff is fair.

That is a hard argument to prove. But their second argument has more force: victims should no longer wait and want the money immediately.

April 12 2023 Update: Some people are seeking out how J&J could file for bankruptcy again. The answer is complicated and confusing. Let’s try to simplify it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to address both present and future talc-related lawsuits definitively. In other words, it believes that it will be less expensive in the event of the bankruptcy element which applies pressure to negotiate a settlement. Does talc contain amphibole asbestos. Driving past hundreds of years of American history, the firm asserts that bankruptcy benefits all parties as it distributes settlements more equally and more efficiently than trial courts in which some litigants receive substantial award while others do not.

The gist in the 3rd Circuit decision was this is not a case of one that makes a profit, but an entity to assume the legal liability and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code. However, it also stated that the subsidiary was not financially trouble because J&J offered unlimited financing.
Then J&J decided to go with the unlimited funding portion of the contract and did not promise that it would provide unlimited funds for litigation. The company claims that its modified financing arrangements with its subsidiary address concerns of the appeals court while supplying funds for claim payments. As if offering victims lesser money could solve the overarching problem.

Lawyers representing cancer victims who oppose the agreement counter this by arguing that the plaintiff is the legal argument. Does talc contain amphibole asbestos. They counter with legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier ruling. The hyperbole wasn’t spared: victims’ lawyers call this the biggest “fraudulent transaction of assets in United States history.”

Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. However, it’s a means to try and push the $8.9 billion settlement, and to keep pressure on plaintiffs.

April 10, 2023, Update Bloomberg has an interesting article about a new law within New Jersey that is shedding new light on litigation funding in the baby powder plaintiffs in the class action. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) regarding talc products, in exchange for a share of any settlements. J&J is now offering that it will pay $8.9 billion to settle all lawsuits.

The funders’ involvement is publicly available due to the New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rules aim to respond to the increasing calls for the regulation of lawsuit funders. J&J is facing more than 60,000 claims when you add up federal and state child powder-related lawsuits. Third-party funding for mass tort lawsuits is not without its pros and cons. There is no doubt that we are seeing how third-party funding could level the playing field between people as well as large corporations in the courtroom.

April 4, 2023 Update: It is pleasing to see the worm turn in this case. J&J was hit again this week, when the Third Circuit denied J&J’s request to keep the automatic stay in place as J&J appeals a bankruptcy ruling in the U.S. Supreme Court. This automatic stay stopped thousands of talcum cases and prevented new lawsuits from being filed ever since J&J launched the controversial attempt to spin the talc liabilities into a bankrupt entity over a year ago. Does talc contain amphibole asbestos. When it was decided that the 3rd Circuit ruled that this bankruptcy was invalid only a few months back, the stay was removed. J&J was hoping to have it remain in effect until an appeal to the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that of the Supreme Court is willing even to hear the appeal? Low.
March 16 2023 Update: With the bankruptcy stay being officially lifted, the first new cases have been filed and transferred into the class action for talcum powder MDL in the space of a year. Seven new talc lawsuits have been included in the MDL over the last month increasing the number of cases in the pending process up to 37,522.

February 25, 2023 Update 2023 Update: A Congressmen from Tennessee is now calling for authorities from the U.S. Government Accountability Office (GAO) initiate an investigation into how much J&J Talc products have cost the government over the decades.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc product for decades while tax dollars were used to treat those who were injured through exposure to the chemicals. This lawsuit comes a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Does talc contain amphibole asbestos. J&J has to begin making reasonable settlement offers to victims to begin to put all of this behind it. It’s a mark on one of the top firms.

February 14 2023 Update: During the hearing held today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
