April 13th, 2023 Update: The most important announcement is an $8.9 billion over 25 years settlement offer. Lawyers representing cancer victims in the MDL collective action pledged to challenge the settlement Talc claimants. Why? They believe it’s not enough for 70 000 cancer patients. The group is seeking to settle the case now with what they believe is far less than what these victims deserve. Their argument is twofold. April 12, 2023 Update: People are asking how J&J can go through bankruptcy once more. The answer is complicated and convoluted. Let’s try to clarify it simply.
Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future talc litigations in a definitive manner. Also, it believes it can pay less if there is an element of bankruptcy that puts pressure for a settlement. Does talc give you cancer. Going back to the 400-year span of American time, the business believes that bankruptcy is beneficial to all parties because it distributes settlements more equally and effectively than trial courts, where litigants are awarded significant payouts, while others are left with nothing.
The main thrust in this 3rd Circuit decision was this is not a matter of one that makes a profit, but a subsidiary to take the legal responsibility and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a share of any winnings. J&J has now offered that it will pay $8.9 billion in settlements for all lawsuits.
The involvement of funders is publicly available due to a New Jersey court rule requiring the disclosure of certain information about funders outside the state. This rule is intended to address the rising calls for regulation of litigation funders. February 25, 2023 Update: A Congressmen from Tennessee has now demanded that authorities from the U.S. Government Accountability Office (GAO) start an investigation into the amount J&J product containing talc has cost the government over the years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of failing to recognize the dangers of its talc products over long while tax dollars spent on treating people who suffered injuries from exposure to the chemicals. The lawsuit comes just a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
