Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future talc-related lawsuits definitively. In other words, it believes that it will be less expensive if there is a bankruptcy element that creates pressure to negotiate a settlement. Hyperbole did not go unnoticed the lawyers representing victims call it the most significant “fraudulent deal ever in United States history.”

In spite of the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method to push for this $8.9 billion settlement through and maintain pressure on plaintiffs.
