It’s trying for another time to settle more than 38,000 lawsuits in bankruptcy, and to prevent any new cases from arising in the near future.
The bankruptcy plan of LTL would pay $400 million into a separate trust for claims filed by state attorneys general claiming that J&J did not comply with state unfair business practices and consumer protection laws, by deceiving consumers regarding the dangers of its talc products.

New Mexico and Mississippi have taken steps to halt the bankruptcy of LTL along with cancer sufferers as well as their counterparts from the U.S. Justice Department’s watchdog on bankruptcy, who argue that a profit-making company like J&J does not qualify for bankruptcy protections intended for those struggling with debt.
LTL’s first attempt at resolving the bankruptcy lawsuits was dismissed following similar arguments. In the end, a U.S. appellate court determined that LTL did not have “financial distress” and was not eligible to receive bankruptcy relief. How bad is talc. LTL declared bankruptcy a second time in just two hours following the dismissal, arguing the second bankruptcy was different in that it had less money available and had a greater chance of securing the possibility of settling.
New Mexico and Mississippi said in their motion for dismissal that LTL’s renewed bankruptcy violates state law enforcement powers by attempting unilaterally to cap the liability of the company for state consumer protection measures.

LTL’s recent filings also provided additional details about how the company would assess and pay claims for cancer in the event that the bankruptcy plan is approved.
The largest amount of money under the settlement would be $500,000 for people diagnosed with mesothelioma terminal prior to age 45 and $260,000 for those who have been diagnosed with terminal ovarian cancer prior to age 45.

The previous week, the opposition group, called”The Official Committee of Talc Claimants and urging the bankruptcy court to dismiss this case saying that LTL can not be considered in financial distress.
“The filing is a desperate and legally ineffective attempt by a few of law firms to try to block claimants from voting on the resolution, which that the overwhelming majority of claimants support,” J&J’s litigation chief Erik Haas, said in an announcement. How bad is talc. “The law firms who filed their filing are financially oriented and have conflicts that do not align with, differ from and infringe on the rights they represent. We will be submitting an answer to the appellate court.”
How bad is talc. Clay Thompson, a lawyer for MRHFM, which boasts more than mesothelioma victims who have sued J&J and J&J, has said that the second bankruptcy attempt of J&J failed.
“J&J issue press releases describing how fantastic the plan is but simultaneously demanding that plan details–including what individuals with illnesses would be treated to,” Thompson said in an email. “What does the company have to keep secret?”
Kaplan has instructed the sides to devise a second reorganization plan, under the oversight and supervision of mediators.
The court in February of 2022 Kaplan stated that J&J’s use of Chapter 11 to hasten a settlement that would relieve J&J from the hundreds of thousands of claims concerning its talcum products.
However, in the month of January, an appeals court in the United States overturned the verdict, ruling that the firm could not be considered to be in “financial difficulty.”
In the event that J&J’s request to make an appeal before the U.S. Supreme Court was dismissed the same month, J&J applied for its first bankruptcy about two hours later. In response to that move, Kaplan froze the lawsuits for 60 days in order to determine whether or not to approve an additional bankruptcy.

Vara wrote that the the bankruptcy court remain “open to honest, but naive debtors.” These doors “are not accessible to those that do not have a legitimate reason or want to abuse the bankruptcy process to hinder or delay their creditors,” Vara continued.
To its credit, J&J maintains there is no proof conclusive that their talc products, including its iconic baby powder, cause cancer. J&J has been taking the products of the market–first in North America in 2020–and the rest of the world this year.
J&J is determined to stay clear of the expense of going to trial. It has won the majority of cases that have been resolved at trial, but some losses have been very punitive.
A highly publicized trial in Missouri led to an $4.7 billion verdict against the drug maker, which was later reduced to $2.1 billion following appeals.

Meanwhile, the plaintiff had the opportunity to introduce its first expert witness Arthur Langer. Langer said that the presence of additional minerals along with the talc mineral is a given. He testified that his team had notified J&J in the year 1971 about the presence of asbestos chrysotile in the company’s talc, albeit at just 0.1 percent. The asbestos was discovered by him in 1976.
June 1, 2023 Update: How bad is talc. A trial for the first time since J&J made the decision to split its Talc section and declaring bankruptcy is an important point of the ongoing lawsuit story. Trial began yesterday in the heartbreaking trial of a young plaintiff, diagnosed with an aggressive and rare form of mesothelioma last year, a diagnosis lawyers on both sides of the argument agree is a grave tragedy.
Opening statements laid bare huge differences between the sides’ story. The attorney for the plaintiff took aim towards Johnson & Johnson, alleging the use of deceptive methods in their research practices as well as throughout the litigation procedure. As per the lawyer, the company attempted to manipulate the definition of asbestos, despite internal documents from 1978 and 1994 showing that asbestos fibers found in plaintiff’s tissue are included.
Johnson &J’s tangled $8.9 billion settlement proposal hangs in the balance with the development of the trial. Despite the particularity of the mesothelioma trial and its distinct issues compared to other lawsuits involving talcum powder A verdict in favor of the plaintiff could cause a serious setback to J&J’s hopes for broad acceptance of the settlement they have proposed among plaintiffs.
May 31, 2023: Update from Johnson and Johnson’s bankrupt talc unit is defending its two-time Chapter 11 filing in the in the face of challenges from victims of talc injuries. In an appeal to the New Jersey bankruptcy court, it argued that the situation was vastly different from the previous filing. It also emphasized the unprecedented commitment to $8.9 billion to J&J, the largest ever settlement in the history of a mass tort bankruptcy. How bad is talc. It was not mentioned how this amount indicates that it is a fair settlement. J&J also claimed that it received support from several plaintiffs’ legal firms that represent over 600,00 claimants. This is hard to verify however it is likely to be incorrect.
May 24 2023 Update: In the wake of Johnson and Johnson’s bankruptcy filing in 2021 filing, the very first trial on the cosmetic talc products it claims to that contain asbestos is scheduled to start jury selection on Monday, May 24, California in Alameda County Superior Court, the most favored place for plaintiffs. The plaintiff claims that his mesothelioma resulted from asbestos exposure from J&J’s products which the company does not deny. The trial also includes six retailers who are accused of selling talc-based products.
May 22, 2023 Update: Lawyers in the 2nd J&J Talc bankruptcy are currently fighting over who should be chosen to fill the role of a future claims representative, a role that is critically essential in resolving the claim for talc. How bad is talc. Randi Ellis, a lawyer who is frequently involved in MDLs throughout the country, was appointed as the claims representative during the first bankruptcy. J&J’s defense team wants Ellis to be named to the position yet again, but the lawyers for the talc plaintiffs are objecting due to the fact that Ellis has an unrelated conflict of interest that would prevent her from being appointed to that post for the second time. This conflict is rooted in the issue that Ellis was believed to have been involved in drafting the controversially contested second bankruptcy, which raises doubts about her capacity to be neutral. The reality is this bankruptcy is likely to be tossed out anyway.
May 17, 2023 Update The pretend company that J&J formed for the talc litigation bankruptcy has informed a New Jersey bankruptcy court that they have allocated $400 million to settle the allegations made by states who accuse the company of misleading advertising for its talc products. How bad is talc. That’s an $8.5 billion settlement for cancer sufferers. It’s difficult to envision a scenario where J&J can push these baby powder settlements through with these numbers. While J&J’s $8.5 billion offer sounds like a lot initially, it may not look very appealing when you consider the math. The settlement plan based on our rough calculations, would not offer victims anything more than an average settlement $100,000 per instance. That’s not enough.
May 15, 2023 Update: J&J could be facing lawsuit by an advocacy group representing cancer victims. How bad is talc. The group argues that J&J deliberately retracted the $61.5 billion fund-raising agreement with its subsidiary, LTL Management LLC, to create the appearance of financial hardship and validate the unit’s Chapter 11 bankruptcy filing. The group asserts this action is equivalent to a fraudulent transfer of right to compensation for victims. They plan to explore J&J’s actions as a result of the decision to dismiss LTL’s first bankruptcy suit.
May 10 2023 Update: The following week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to reject the second bankruptcy filing that was filed by J&J subsidiary LTL Management. However, in the meantime, the bankruptcy has issued an order that requires both parties to take part in a settlement mediation with the hopes of achieving an international settlement agreement can be been reached.
May 5, 2023 Update: The talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to many lawsuits claiming that its talc products cause cancer from asbestos exposure. How bad is talc. More than 2700 people have filed lawsuits against the company and it has been spending $1 million a month to defend its legal position. The company’s most recent $29 million settlement at the Supreme Court of South Carolina forced it to apply for bankruptcy protection and argue for equitable distribution of assets among talc claimants instead of being taken over through the receiver. Other talc suppliers have also filed for bankruptcy due to the litigation.
May 4, 2023 Update U.S. bankruptcy judge Michael Kaplan has directed Johnson & Johnson to resume settlement discussions with lawyers who rejected the proposed $8.9 billion offer for settlement. At Trenton, New Jersey yesterday, the parties appeared in court to discuss next steps in their second bankruptcy matter and Judge Kaplan has pushed for further settlement talks.
This is the solution to resolve the claims of J&J. A baby powder settlement can be made. How bad is talc. However, it will require more money – more billions of dollars from Johnson & Johnson.
Lawyers have a split opinion on whether or not to agree with the proposal and not all clients view this issue the same way their lawyer sees it. This second case of bankruptcy is likely to be a failure as Judge Kaplan has scheduled a hearing for June to determine if she will close the case for the third time.
May 3 2023 Update A group of cancer patients who have sued Johnson & Johnson (J&J) asked that J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation surrounding talc-based products. The committee representing talc claimants made a motion Tuesday requesting for the Third Circuit to consider their case and send it back an earlier court with instructions to discharge the bankruptcy. How bad is talc. They also asked that halted tort litigation against J&J should be permitted to proceed.
LTL requested Chapter 11 protection once again after its bankruptcy filing was rejected by the Third Circuit earlier this year, offering a $8.9 billion payment. The committee says that the recent ruling, which allows the second Chapter 11 to continue, as well as halting the trials against J&J and J&J, requires an immediate Third Circuit review. The US Trustee also asked that an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a reply to the appeals court characterizing the filing as a “desperate and legally inadequate effort” by a select group of law firms with conflicting financial interests.
May 1st 2023 Update: One most frequently asked question is how the plaintiffs’ lawyers and their clients turn off $8.9 billion. That’s of course quite a sum. But there are plenty of victims. How bad is talc. And these are really good case for plaintiffs. We were reminded of this recently in two talc trials which ended in large verdicts for the plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon ended in a verdict that was $18.1 million. In the same month, a different mesothelioma-related talc case went to trials within South Carolina and resulted in a verdict of $29 million in favor of plaintiff. In both instances, the defendant was Whittaker, Clark & Daniels Inc., one of the largest suppliers of talc in the U.S.
April 30th, 2023 Update: When J&J first tried to bring the lawsuit over talcum powder into bankruptcy, it came with an offer to put aside $2 billion to settle the case. It was a ridiculously small amount. There was no one among the talc victims who believed in it. This time around, however, J&J has increased the offer to $8.9 If the talc plaintiffs will allow a bankruptcy settlement and they also have the support of a substantial portion of the talc plaintiffs and their attorneys. How bad is talc. But 75% of the plaintiffs of talc are required to approve bankruptcy plans is a difficult road because of the number of lawyers who have massive stocks of baby powder lawsuits opposed to the settlement.
What is the solution to this impasse? More billions.
April 25, 2023, Update Talc patients have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, saying the company is not financially troubled. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. How bad is talc. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible for bankruptcy relief since it did not show financial difficulties.
The plaintiffs argue that LTL’s Second Chapter 11 case is an fraud on the bankruptcy system and that the case is being handled in bad faith. J&J says the bankruptcy settlement receives “significant support” from companies representing approximately 60,000 people who are claiming. It’s safe to say that the plaintiffs’ attorneys and victims are divided over their disagreement over the $8.9 billion settlement offer.
April 21st, 2023 Update A bankruptcy judge has decided the company Johnson & Johnson must face new lawsuits alleging that the company offered a baby powder with a contaminant that caused cancer. While trials in Talc lawsuits are suspended for a minimum of 60 days but new lawsuits can be filed, and lawyers will begin preparing their cases. How bad is talc. Judges expressed skepticism about J&J’s absurd attempt to revive its strategy with a second bankruptcy trial.
April 13th, 2023: Update on the biggest news is the $8.9 billion over the course of 25 years settlement offer. Lawyers representing cancer patients in MDL class action MDL class action have vowed to challenge the settlement the talc claimants. Why? They believe it’s not enough money for those suffering from cancer who are 70,000. How bad is talc. The lawyers say that J&J should negotiate a larger settlement or litigate individual claims if the most recent bankruptcy is declared unconstitutional.
But there is another lawyer group that isn’t part of the leadership of that class action. The lawyers collectively have accumulated hundreds of thousands of cases. They want to settle now for what many argue is far less than what these victims deserve. Their argument seems to be twofold. The first is that they claim the settlement – which amounts to an average of $100,000 per plaintiff – is fair.
It’s a difficult argument to present. The second argument is more teeth: victims can not afford to wait any longer and need their money now.
April 12, 2023 Update: People are looking for ways J&J is able to file for bankruptcy once more. The answer is complicated and complicated. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only option to address both present and future talc litigations in a definitive manner. In other words, it thinks it will pay less in the event of a bankruptcy element that creates pressure for a settlement. How bad is talc. Going back to the 400-year span of American time, the business claims that bankruptcy benefits everyone by dispersing settlements more fairly and effectively than trial courts, which are where litigants get significant award while others do not.
The essence of the 3rd Circuit decision was this is not a case of the profit-making company that has an entity to assume the legal burden and declare bankruptcy – something Congress considered when it was drafting the Bankruptcy Code. However, it also stated that the entity was financially difficulty because J&J assured it of unlimited funding.
This is why J&J decided to go with the unlimited funding portion of the contract and did not promise to offer unlimited funding for cases. The company claims that its modified financing arrangements with its subsidiary addresses the concerns of the appeals court while offering funds to pay claims. As if providing victims with lower amounts of money would resolve the overarching problem.
Attorneys representing cancer patients who oppose the deal counter this with what you conclude is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s ruling. The hyperbole wasn’t spared by the victims’ lawyers, who call it the most significant “fraudulent transaction of assets in United States history.”
In spite of the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method of pushing this $8.9 billion settlement to keep the pressure on plaintiffs.
April 10 2023 Update: Bloomberg has an interesting article on a new law in New Jersey that is shedding new light on the funding of litigation in the baby powder Class action suit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) regarding talc products, in exchange for a portion of any profits. J&J is now willing that it will pay $8.9 billion to settle all lawsuits.
The involvement of the funders is made public due to an New Jersey court rule requiring the release of certain details about funding sources outside of the. This rule is intended to address the growing calls for the regulation of litigation funders. J&J faces over 60,000 claims when you combine federal and state baby powder lawsuits. Third-party funding in mass tort claims has pros and cons. There is no doubt that we are witnessing how third-party funding can level the playing field for individuals and large corporations in court.
April 4 2023 Update: It’s pleasing to see the worm turn in this litigation. J&J was hit again this week when the Third Circuit denied J&J’s request to extend the automatic stay while J&J appeals an appeal at the U.S. Supreme Court. The automatic stay has stopped the cases of talcum powder in a number of years and stopped new lawsuits from being filed ever since J&J launched the controversial attempt to spin talc-related liabilities off into a bankrupt company over one year back. How bad is talc. After the 3rd Circuit ruled that this bankruptcy was insufficient just a few months ago the stay was removed. J&J was hoping to have it continue in the meantime of its SCOTUS appeal. But, no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that for the Supreme Court is willing even to hear the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay now officially lifted, the very first new cases have been filed and transferred into the talcum powder class action MDL in over one year. Seven new talc cases were brought into the MDL over the last month, bringing the total number of cases that are pending to 37,522.
February 25 2023 Update This morning, a Congressmen from Tennessee is now calling for be the U.S. Government Accountability Office (GAO) begin an investigation into the cost J&J products containing talc have cost the government in the many years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the dangers of its talc products over decades while tax dollars were spent treating those injured by exposure to the chemicals. The lawsuit comes just a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
How bad is talc. J&J should begin to make fair settlement offers to victims to in putting this behind. This is a disgrace to one of the world’s greatest companies.
February 14 , 2023 Update: At an appearance today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
