May 1st, 2023 Update: One frequently asked question is how the plaintiffs’ lawyers and their clients turn down $8.9 billion. Of course, that is an immense amount of money. There are a lot of victims. How is talc bad for you. These are actually a good case for plaintiffs. We were reminded of this last week by two talc-related trials that led to huge verdicts for plaintiffs. In February, a talcum powder mesothelioma trial in Oregon led to the verdict that was $18.1 million. The following month, a second mesothelioma-related talc case went to the court in South Carolina and resulted in an award of $29 million to the plaintiff. How is talc bad for you. However, 75% of plaintiffs in the talc category, which is necessary for bankruptcy plan approval is a difficult road due to the sheer number of lawyers with vast collections of baby powder-related lawsuits, opposed against the proposed settlement.
What is the solution to this impasse? More billions.
April 25, 2023 Update: Talc plaintiffs have asked a judge to reject their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. How is talc bad for you. It was the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company was not eligible for bankruptcy relief because it had not demonstrated financial trouble.
The plaintiffs argue that LTL’s third Chapter 11 case is an overreach of the bankruptcy system and the case is being handled in bad faith. J&J asserts that the bankruptcy settlement is backed by “significant backing” from companies representing an estimated 60,000 people who are claiming. It’s safe to say that lawyers representing plaintiffs and the victims are split over their disagreement over the $8.9 billion offer for settlement.
April 21st, 2023 Update A bankruptcy judge has ruled the company Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. Even though trials for talc lawsuits are paused for a minimum period of 60 days but new lawsuits can be filed, and lawyers are able to begin preparing their cases. How is talc bad for you. The judge expressed skepticism over J&J’s pathetic attempt to relaunch its strategy in a second bankruptcy case.
April 13, 2023 update: the most important story is that there’s an $8.9 billion over 25 years of settlement. Lawyers representing cancer patients within the MDL group action pledged to challenge the settlement those who claim talc. Why? They think it is not enough money for more than 70,000 cancer victims. How is talc bad for you. These lawyers argue that J&J should negotiate a bigger settlement or pursue individual claims if the most recent bankruptcy is dismissed.
However, there is a second set of lawyers who are not part of the leadership in this class action. They have amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle today in what many believe to be less than the victims deserve. Their argument appears to be twofold. First, they argue that the settlement of around 100,000 dollars per plaintiff is fair.
This is an argument that is difficult to present. The second argument is more force: the victims can no longer wait and want to get their money right now.
April 12, 2023 Update: People are wondering if J&J can file for bankruptcy again. The answer is complex and complex. Let’s try to clarify it simply.
Johnson & Johnson asserts that bankruptcy is the only method to resolve both current and future talc-related lawsuits definitively. Also, it thinks it can get a lower rate if there is a bankruptcy component that applies pressure to negotiate a settlement. How is talc bad for you. Moving past the 400-year span of American history, the company argues that bankruptcy benefits all parties by distributing settlements more fairly and more efficiently than trial courts which are where litigants get significant award while others do not.
The basic tenet in this 3rd Circuit decision was this is not a matter of the profit-making company that has a subsidiary to take the legal risk and declare bankruptcy Congress thought of when drafting its Bankruptcy Code. However, it also stated that the entity was in financial distress due to the fact that J&J offered unlimited financing.
Thus, J&J decided to go with the unlimited funding aspect of the contract and didn’t promise to provide unlimited funding for lawsuits. J&J claims that its revised financing arrangements with its subsidiary address appeals court’s concerns while still supplying funds for claim payments. As if offering victims lesser money could solve the overall issue.
Attorneys representing cancer victims who do not agree with the agreement counter the agreement with what is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s decision. Hyperbole is not exempt the lawyers representing victims call it the most significant “fraudulent transfer ever in United States history.”
Despite the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method to try and push the $8.9 billion settlement, and to keep pressure on plaintiffs.
April 10, 2023, Update Bloomberg offers an informative article on a new law of New Jersey that is shedding new light on litigation funding in the baby powder Class action suit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a portion of any settlements. J&J has now offered the payment of $8.9 billion to settle all lawsuits.
The involvement of the funders is public information because of an New Jersey court rule requiring the release of certain details regarding outside funding backers. The rule aims to respond to the increasing calls for the regulation of litigation funders. J&J is facing more than 60,000 claims when you include federal and state Baby Powder lawsuits. Third-party funding for mass tort lawsuits has both pros and pros and. But there is no question that we are seeing how third-party funding can level the playing field between people and big corporations in the courtroom.
April 4, 2023 Update: It is interesting to watch the worm turn in this litigation. J&J has taken another blow this week when the Third Circuit denied J&J’s request to extend the automatic stay as J&J appeals an order granting bankruptcy in the U.S. Supreme Court. This automatic stay frozen hundreds of cases involving talcum powder and prevented new lawsuits from arising ever since J&J started the controversial process to spin the talc debts into a bankrupt subsidiary over one year back. How is talc bad for you. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient a few months ago, the stay was revoked. J&J had hoped to have it continued pending the SCOTUS appeal. But, no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that is that the Supreme Court is willing even to hear the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay having been fully lifted, the first new cases have been filed and transferred into the talcum powder class action MDL in over one year. Seven new talc cases were added to the MDL over the last month which brings the total number of cases that are pending to 37,522.
February 25, 2023 Update: A Congressmen from Tennessee is now requesting that authorities from the U.S. Government Accountability Office (GAO) launch an investigation into the cost J&J Talc products have cost the government in the years.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of failing to recognize the dangers of its talc product for decades while tax dollars were utilized to treat people injured by exposure to the products. The lawsuit comes just a few weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
How is talc bad for you. J&J needs to start making reasonable settlement proposals for victims in order in putting this behind it. It is a stain on one of the top firms.
