Johnson & Johnson (JNJ.N) has put aside $400 million to address U.S. state consumer protection actions as part of its larger $8.9 billion plan to settle claims that its Baby Powder and other talc-based items cause cancer. Is all talc bad.

J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday which outlines how the company will pay various types of cancer sufferers in the bankruptcy settlement. It’s trying for a second time to resolve more than 38,000 cases in bankruptcy and prevent new cases from being filed in the near future.
The bankruptcy plan of LTL would pay $400 million to a separate trust for claims brought from state attorney generals alleging that J&J violated states’ unfair practices as well as consumer protection laws by misinforming consumers regarding the safety of its talc products.

Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future lawsuits involving talc conclusively. In other words, it thinks it will pay less should there be a bankruptcy element that creates pressure to settle. Going back to the 400-year span of American history, the firm argues that bankruptcy benefits everyone by dispersing settlements more equally and more efficiently than trial courts which are where litigants get significant payouts, while others are left with nothing.
