Lawyers representing cancer patients who oppose the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole is not exempt attorneys representing the victims claim it the most significant “fraudulent move of assets in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. But it’s a way of trying to push this $8.9 billion settlement, and to keep pressure on plaintiffs.

Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) over talc products in exchange for a percentage of any wins. J&J has now offered the payment of $8.9 billion in settlements for all lawsuits.
The funders’ involvement is publicly available due to an New Jersey court rule requiring the disclosure of certain information about funding sources outside of the. This rule is intended to address the growing calls for the regulation of litigation funders. J&J is facing more than 60,000 claims when you add up state and federal baby powder lawsuits. Third-party financing in mass tort cases has both pros and cons. The automatic stay has halted hundreds of cases involving talcum powder and prevented the filing of new lawsuits ever since J&J began the controversial plan to spin the talc debts off into a bankrupt subsidiary over one year ago. J&J wanted to see it continue in the meantime of the SCOTUS appeal. The answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance of the Supreme Court is willing even to accept the appeal? Low.
