Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc-related lawsuits definitively. Moving past the 400-year span of American history, the company argues that bankruptcy benefits everyone by dispersing settlement payments more evenly and effectively than trial courts, which are where litigants get significant payouts, while others are left with nothing.

Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. But it’s a way of pushing this $8.9 billion settlement to keep the pressure on plaintiffs.
