J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company intends to pay different types of cancer victims as part of bankruptcy settlement. Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc litigations in a definitive manner. Attorneys representing cancer patients who oppose the agreement counter this argument by saying that it is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous decision. Hyperbole did not go unnoticed attorneys representing the victims claim it the largest “fraudulent deal ever in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. But it’s a way to try and push the $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10 2023 Update Bloomberg is running an intriguing article about a new law that has been passed in New Jersey that is shedding new light on litigation funding in the class action lawsuit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) regarding talc products, in exchange for a percentage of any settlements. J&J is now willing to pay $8.9 billion to settle all lawsuits.
The funders’ involvement is made public because of a New Jersey court rule requiring the release of certain details about funding sources outside of the. This rule is intended to respond to the increasing calls for the regulation of lawsuit funders. J&J has to deal with more than 60,000 lawsuits when you add up federal and state baby powder lawsuits. Third-party funding of mass tort cases is not without its pros and cons. But there is no question that we are witnessing how third-party funding can level the playing field between individuals as well as large corporations in court.
