Johnson & Johnson (JNJ.N) has set aside $400 million to resolve U.S. state consumer protection actions as part of its broader $8.9 billion effort to settle claims that its Baby Powder and other talc items cause cancer. Is cornstarch safe to use as talc.

J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company intends to pay different types of cancer victims as part of bankruptcy settlement. Is cornstarch safe to use as talc. J&J has declared that its products containing talc are safe and do not cause cancer. J&J is seeking an additional time to conclude more than 38,000 cases in bankruptcy and prevent new cases from being filed in the future.
LTL’s bankruptcy plans would deposit $400 million to an additional trust to settle claims filed with state attorneys general claiming that J&J was in violation of the state’s unfair commercial practices and consumer protection laws, by deceiving consumers regarding the dangers of its talc products.

Some states had started consumer protection lawsuits against J&J prior to the first bankruptcy filing prevented these investigations from moving forward in 2021. Is cornstarch safe to use as talc. New Mexico and Mississippi had already launched lawsuits with Johnson & Johnson before then as well as the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas, according to LTL’s court filings.

New Mexico and Mississippi have decided to declare LTL’s bankruptcy unfinished in a joint move with cancer victims as well as the U.S. Justice Department’s watchdog on bankruptcy, who have argued that a successful business like J&J cannot benefit from bankruptcy protections intended for people with debt problems.
The first time LTL attempted to settle the bankruptcy cases was dismissed following similar arguments. In the end, a U.S. appeals court determined that LTL wasn’t in “financial trouble” and ineligible for bankruptcy protection. Is cornstarch safe to use as talc. LTL had filed for bankruptcy again in just two hours following the dismissal, arguing its second attempt was different as it had less money available and had more support for the possibility of settling.

New Mexico and Mississippi said in their motion to dismiss LTL’s latest bankruptcy violation of state law enforcement authorities by attempting unilaterally to cap LTL’s liability to state consumer protection actions.

The filings of LTL’s latest bankruptcy proceedings also include more information on how the company would evaluate and pay for cancer claims if the bankruptcy plan is approved.

The most significant payments under the settlement would be $500,000 for those diagnosed with cancer of the mesothelioma ovary before age 45 and $260,000 for people diagnosed with ovarian cancer that is terminal before age 45.

From there, the proposed settlement applies discounts depending on the nature and severity of the cancer, the person’s age, previous talc use and other factors. Is cornstarch safe to use as talc. For instance, a woman who used daily talc products, had an ancestral history of ovarian cancer, and was diagnosed with an ovarian cancer stage II when she was 55 might qualify to receive a payout of $21,125 according to the plan.

Judge orders J&J and talc opponents to take part in settlement talks.

Following another round of hearings in Johnson & Johnson’s attempt to implement a Texas Two-Step bankruptcy strategy to resolve talc litigation and federal bankruptcy judge Michael Kaplan has ordered the company and those opposing the plan to hold negotiations to settle the matter, Bloomberg reports.

With its second bankruptcy bid for LTL Management, a subsidiary created by J&J to manage the claims company made a settlement offer of $8.9 billion. Is cornstarch safe to use as talc. While one firm representing plaintiffs support the deal, another group is opposed to the offer.

This week, the opposition group, dubbed”The Official Committee of Talc Claimants requested the bankruptcy court for dismissal of the matter asserting that LTL can not be considered in financial distress.

“The filing is an unjust and legally flawed attempt by a few of law firms to prevent claimants from voting on the resolution, which that the overwhelming majority of claimants favor,” J&J’s litigation chief Erik Haas, said in a statement. Is cornstarch safe to use as talc. “The law firms behind this filing have financial interests that are in conflict with, differ from and are in opposition to the interests of their clients. We’ll be submitting an answer an appeal to the appellate court.”

“J&J issue press releases that boast about how amazing the plan is but simultaneously requesting that details of the plan, such as what the individual sick individuals would receive–be kept secret,” Thompson said in a statement. “What is J&J’s plan to keep secret?”

Kaplan has instructed both sides to create a restructuring plan, with the supervision by two mediators.

On February 20, 2022 Kaplan stated that J&J’s recourse to Chapter 11 to hasten a settlement that would release J&J from the hundreds of thousands of claims concerning its talcum products.

However, in January of this year, a federal appeals court overturned the decision, deciding that the business could not be considered to be in “financial difficulty.”

The J&J’s plan to appeal to the U.S. Supreme Court was turned down the same month, J&J was granted a second petition for bankruptcy two hours after. In response, Kaplan froze the lawsuits for 60 days in order to determine whether or not to approve another bankruptcy.

J&J’s omnipotent profit engine fails after $6.9B talc litigation charge.

With Two Chapter 11 attempts, J&J has bought 19 months during which cases have been suspended. Is cornstarch safe to use as talc. The company would like claimants to accept their settlement. J&J would need 75% support for the deal to go through.

In addition to the group of talc lawyers that criticized the company’s bankruptcy play as well, the U.S. Trustee, an arm of the U.S. Department of Justice, also filed motions to dismiss LTL’s second bankruptcy case.

In a filing this week, U.S. trustee Andrew R. Vara wrote that the bankruptcy courts are “open to honest but unfortunate debtors.” Those doors “are not open to parties that do not have a legitimate reason or want to abuse the bankruptcy process to hinder or delay their creditors.” Vara continued.

On the other hand, J&J maintains there is no definitive evidence to suggest that its talc products, including its popular baby powder cause cancer. J&J has been taking the products of the market–first for North America in 2020–and the remainder of the globe later this year.

J&J intends to steer clear of the expense of going to trial. J&J has won the majority of the cases that were decided during trial, however, some losses have been very harsh.
A highly-publicized trial in Missouri led to a $4.7 billion verdict against the drugmaker, which was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine trial involving talc that are in appeal or concluded. Out of 41 trials 32 have ended in winning for J&J as well as mistrials or verdict of a plaintiff overturned upon appeal. Is cornstarch safe to use as talc. Separately, the company in 2020 negotiated to settle nearly 1000 cases at a cost of $100 million, Bloomberg announced at that time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Cornstarch Safe To Use As Talc

June 2 2023 Update: In the trial for asbestos-containing talc at the trial in California yesterday, technical glitches interrupted the opening statements made by defense attorneys. Is cornstarch safe to use as talc. Jurors who were watching from home on Zoom but did not hear Johnson &Johnson’s lawyer express skepticism about the 70s science asserting the presence of asbestos in their product before the trial was abruptly closed.

In the meantime, the plaintiff was able to present an initial witness Arthur Langer. Langer stated that the presence of other minerals alongside the talc mineral is a given. He said that his team informed J&J in 1971 of the presence of chrysotile asbestos the company’s talc, albeit in just 0.1 percent. He also uncovered more asbestos in 1976.

June 1st, 2023 Update: Is cornstarch safe to use as talc. First trial after J&J has decided to separate its talc section and declaring bankruptcy is an important turning point of the ongoing litigation saga. Trial began yesterday in the heartbreaking case of a young 24-year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma earlier this year. which lawyers on both sides of the argument agree is a harrowing tragedy.

Opening statements revealed distinct differences between each side’s story. The plaintiff’s attorney took aim on Johnson & Johnson, alleging the use of deceitful tactics in research practices and throughout the litigation procedure. The attorney claims that, according to Johnson & Johnson attempted to alter the definition of asbestos despite internal documents from 1978 and 1994 showing that asbestos fibers in the tissue of the plaintiffs are included.

Johnson &J’s highly uncertain $8.9 billion settlement proposal hangs in the balance with the progress of this trial. Despite the distinct nature of this mesothelioma case and its distinctive issues in comparison to other talcum powder lawsuits ruling in favor of the plaintiff could result in the company with a major setback in its expectations of widespread acceptance of their proposed settlement with plaintiffs.

May 31 2023: Update from Johnson and Johnson’s bankrupt talc business is defending their Second Chapter 11 filing in the face of challenges from victims of talc injuries. In a written objection to the New Jersey bankruptcy court, it argued that the filing was distinct from the first filing. It highlighted the extraordinary commitment to $8.9 billion by J&J which is the largest settlement ever made in the history of a mass tort bankruptcy. Is cornstarch safe to use as talc. There was no mention of how this amount signifies that it’s an equitable settlement. J&J also claimed support from several plaintiffs’ legal firms representing more than sixty thousand claimants. It is difficult to confirm however it is likely to be incorrect.

May 24 2023 Update: Following Johnson & Johnson’s bankruptcy in 2021 filing, the very first trial involving its cosmetic talc items allegedly that contain asbestos is scheduled to commence jury selection on Monday in California in Alameda County Superior Court, an historically reliable jurisdiction for plaintiffs. Plaintiff claims that mesothelioma was triggered by asbestos exposure from J&J’s products and the company is denying. The trial also includes six retailers accused of selling talc-containing products.

May 22, 2023 Update: Lawyers in the 2nd J&J talc bankruptcy are now battling over who should be appointed to the role of a future claims representative, which is vitally important to resolving the Talc claims. Is cornstarch safe to use as talc. Randi Ellis, a lawyer who regularly appears in MDLs all over the nation was appointed as the claims representative in the previous bankruptcy. J&J’s defense group wants Ellis to be named to the position and again, but attorneys for the talc plaintiffs are protesting on the grounds that Ellis has an unrelated conflict of interest which would prohibit her from taking on that role in the future. The issue stems from the possibility that Ellis was believed to have been involved in the drafting of the highly litigated second bankruptcy, which raises concerns about her capacity to be neutral. The reality is the bankruptcy will be dismissed regardless.

May 17, 2023 Update: The fake company J&J made up to settle the talc litigation bankruptcy told an New Jersey bankruptcy court that they had allocated $400 million to pay the claims of states that accuse the company of deceitful advertising for its talc product. Is cornstarch safe to use as talc. So that makes it an $8.5 billion settlement to cancer victims. It’s difficult to envision an eventuality where J&J can push these baby powder settlements through with these numbers. Although J&J’s $8.5 billion offer might seem like a lot initially, it does not appear appealing after you calculate the figures. This settlement proposal – by our estimates – will not provide victims with much more than an average settlement $100,000 per case. That’s not enough.

May 15th 2023 Update J&J might be facing lawsuit brought by an advocacy group representing cancer patients. Is cornstarch safe to use as talc. The group claims J&J intentionally canceled a $61.5 billion fund-raising agreement together with its parent company, LTL Management LLC, to simulate financial distress and validate the unit’s Chapter 11 bankruptcy filing. The group claims that this move is equivalent to a fraudulent transfer of the rights of victims’ compensation. They are planning to study J&J’s actions in the wake of the denial of the LTL’s bankruptcy case in its first instance.

May 10 2023 Update: During the next week this week, this week the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a petition to dismiss the second bankruptcy application of J&J subsidiaries LTL Management. However, in the meantime, LTL Management has filed an Order requiring both sides to take part in a second settlement mediation with the hopes of achieving a global settlement deal can been reached.

May 5th 2023 Update: Talc manufacturer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to several lawsuits alleging that its talc products cause cancer due to asbestos exposure. Is cornstarch safe to use as talc. Over 2700 people have sued the company and it has been spending $1 million a month to defend itself. The company’s recent $29 million settlement in South Carolina forced it to file for bankruptcy protection, arguing that assets should be distributed in an equitable manner among talc claimants instead of being seized in the hands of the receiver. Other suppliers of talc have filed for bankruptcy due to the litigation.

May 4 2023, Update U.S. The bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to resume talks with lawyers who rejected the company’s proposed $8.9 billion deal. It was in Trenton, New Jersey yesterday the parties gathered in court to discuss next steps for another bankruptcy proceeding and Judge Kaplan pushed more settlement talks.

This is the answer to resolve these claims for J&J. The baby powder settlement is likely to be made. Is cornstarch safe to use as talc. However, it will require more money, more billions of dollars – by Johnson & Johnson.

Lawyers have a split opinion on whether or not to agree with the proposal and not every client views the issue in the same manner their attorney does. This second case of bankruptcy is expected to go nowhere the judge Kaplan has set a date for a hearing in June to decide whether to remove the bankruptcy after the second.

May 3 2023 Update A group of cancer victims who are suing Johnson & Johnson (J&J) requested to have the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail litigation over talc products. The committee representing talc claimants filed a motion on Tuesday asking the Third Circuit to consider their appeal and return the case to a lower court with instructions for dismissing the bankruptcy. Is cornstarch safe to use as talc. They also asked that the stoppage of tort litigation against J&J continue to proceed.
LTL filed for Chapter 11 protection once again after its bankruptcy filing was rejected in the Third Circuit earlier this year and offered an $8.9 billion payment. The committee argues that the recent ruling allowing LTL’s second Chapter 11 to continue, in addition to halting trials against J&J, warrants the immediate Third Circuit review. The US Trustee also requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation, Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a formal response in the appeals court, saying that the filing is a “desperate and legally flawed attempt” by a select group of law firms that have competing financial interests.
May 1st 2023 Update: A common question that people ask is how could plaintiffs and their attorneys turn down $8.9 billion. Of course, that is an immense amount of money. There are a lot of victims. Is cornstarch safe to use as talc. These are actually a good arguments for plaintiffs. We have been reminded of this recently with two talc trials ended in large verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon led to an award of $18.1 million. A month later, another talc mesothelioma case went to the court within South Carolina and resulted in a verdict of $29 million on behalf of the plaintiff. In both instances, the defendant was Whittaker, Clark & Daniels Inc. which is one of the leading suppliers of talc within the U.S.
April 30th 2023 Update: In the year 2023, when J&J initially tried to take the talcum powder litigation into bankruptcy, it came with an offer to set aside $2 billion for settlements. It was a ridiculously small amount. None of the talc plaintiffs agreed with it. This time around, however, J&J has increased the offer to $8.9 if the talc plaintiffs will allow a bankruptcy settlement and they have the support of a substantial part of the talc-related plaintiffs as well as their lawyers. Is cornstarch safe to use as talc. But 75% of the plaintiffs in the talc category, which is needed for approval of the bankruptcy plan is not an easy task since there are so many lawyers with massive stocks of baby powder lawsuits opposed against the proposed settlement.

What can be done to end the impasse? More billions.
April 25, 2023, Update Talc cancer claimants have requested a judge to disqualify their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Is cornstarch safe to use as talc. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January, saying LTL was not eligible for bankruptcy relief as it had not demonstrated financial difficulties.

The claimants assert that the 2nd Chapter 11 case is an overreach of the bankruptcy system and it’s being conducted in bad faith. J&J asserts that the bankruptcy settlement is backed by “significant backing” from the firms that represent about 60,000 potential claimants. It’s fair to say plaintiffs’ lawyers and the victims are split over the $8.9 billion amount of settlement offered.

April 21st, 2023 Update: A bankruptcy judge has decided that Johnson & Johnson must face new lawsuits alleging that the firm sold baby powder that was contaminated and causing cancer. While trials in the lawsuits involving talc are delayed for at least 60 days, new lawsuits can be filed, and lawyers will begin preparing their cases. Is cornstarch safe to use as talc. Judges expressed skepticism about J&J’s absurd attempt to revive its strategy with another bankruptcy case.

April 13, 2023 Update: most important story is that there’s an $8.9 billion over the course of 25 years offer for settlement. Lawyers representing cancer victims in MDL class action MDL collective action vowed to fight the settlement along with those who claim talc. Why? They believe it’s too little money for the those suffering from cancer who are 70,000. Is cornstarch safe to use as talc. These lawyers argue that J&J should negotiate a bigger settlement or pursue individual claims if the most recent bankruptcy is thrown out.

But there is another set of lawyers who are not part of the leadership of this class action. These lawyers have amassed many thousands of cases. This group wants to settle for what is believed to be lower than what the victims should be paid. Their argument appears to be twofold. The first is that they claim the settlement – about 100,000 dollars per plaintiff is fair.

It’s a difficult argument to argue. However, their second argument has more force: victims should not afford to wait any longer and need to get their money right now.

April 12 2023 Update: People are asking how J&J is able to file for bankruptcy again. The answer is complex and complex. However, let’s attempt to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc litigations in a definitive manner. It believes it can pay less when there is the bankruptcy element which applies pressure to settle. Is cornstarch safe to use as talc. In a quest to cover more than 400 years in American history, the company asserts that bankruptcy benefits all parties by distributing settlements more fairly and more efficiently than trial courts where some litigants receive significant settlements while others get nothing.

The main thrust in this 3rd Circuit decision was this is not a case – one that makes a profit, but an entity to assume the legal responsibility and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. But it also said that the subsidiary was not in financial trouble due to the fact that J&J offered unlimited financing.
Then J&J decided to go with the funding unlimited part of the deal but did not pledge to offer unlimited funding for lawsuits. J&J claims that its new financing agreements with its subsidiary will address appeals court’s concerns, while offering claim payment funds. As if providing victims with less money will solve the problem at hand.

Attorneys representing cancer patients who oppose the agreement counter this argument by saying that it is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous decision. Hyperbole did not go unnoticed attorneys representing the victims claim it the largest “fraudulent deal ever in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. But it’s a way to try and push the $8.9 billion settlement through and maintain pressure on plaintiffs.

April 10 2023 Update Bloomberg is running an intriguing article about a new law that has been passed in New Jersey that is shedding new light on litigation funding in the class action lawsuit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) regarding talc products, in exchange for a percentage of any settlements. J&J is now willing to pay $8.9 billion to settle all lawsuits.

The funders’ involvement is made public because of a New Jersey court rule requiring the release of certain details about funding sources outside of the. This rule is intended to respond to the increasing calls for the regulation of lawsuit funders. J&J has to deal with more than 60,000 lawsuits when you add up federal and state baby powder lawsuits. Third-party funding of mass tort cases is not without its pros and cons. But there is no question that we are witnessing how third-party funding can level the playing field between individuals as well as large corporations in court.

April 4 2023 Update: It is interesting to watch the worm turning in this lawsuit. J&J suffered another setback this week when an appeals court in the Third Circuit denied J&J’s request to keep the automatic stay in place during the time that J&J appeals a bankruptcy ruling at the U.S. Supreme Court. This automatic stay froze hundreds of cases involving talcum powder and stopped any new lawsuits from arising ever since J&J initiated the controversial effort to spin talc-related liabilities into a bankrupt entity over a year ago. Is cornstarch safe to use as talc. When it was decided that the 3rd Circuit ruled that this bankruptcy was not legal only a few months back, the stay was revoked. J&J wanted to see it stayed in place until hearing the SCOTUS appeal. The answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that for the Supreme Court is willing even to accept the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay being in effect, the first new cases were filed and incorporated into the class action involving talcum powder MDL in the space of a year. Seven new talc lawsuits were added to the MDL during the month of March, bringing the total number of cases that are pending to 37,522.

February 25, 2023 Update This morning, a Congressmen from Tennessee has now demanded that The U.S. Government Accountability Office (GAO) initiate an investigation into how much J&J talc products have cost the government over the many years.
in a letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the risks of its talc products for years while tax dollars were spent on treating people who suffered injuries from exposure to the chemicals. The lawsuit comes just a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.

Is cornstarch safe to use as talc. J&J has to begin making reasonable settlement proposals for victims in order getting this behind it. This is a disgrace to one of the world’s greatest businesses.

February 14 2023 Update: During an appearance today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
