J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday which outlines how the company intends to pay for different types of cancer patients in an arrangement for bankruptcy. Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc-related lawsuits definitively. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of settlements. J&J has now offered an offer of $8.9 billion in settlements for all lawsuits.
The involvement of funders is public information due to an New Jersey court rule requiring the release of certain details regarding outside funding backers. The law is designed to tackle the growing demands for regulation of the litigation funders. J&J is facing more than 60,000 claims when you combine federal and state child powder-related lawsuits. Third-party financing in mass tort cases has its pros and cons. But there is no question that we are witnessing the ways that third-party funding can even the playing field between individual and large corporations in court.
April 4 2023 Update: It is interesting to watch the worm turning in this case. J&J has taken another blow this week when they were denied by the Third Circuit denied J&J’s request to extend the automatic stay during the time that J&J appeals an appeal in the U.S. Supreme Court. This automatic stay froze thousands of talcum cases and stopped new lawsuits from getting filed ever since J&J started the controversial process to spin the talc debts off into a bankrupt subsidiary more than a year ago.
