Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future talc lawsuits conclusively. Driving past more than 400 years in American past, the company believes that bankruptcy is beneficial to all parties by distributing settlements more equally and effectively than trial courts, in which some litigants receive substantial payouts, while others are left with nothing.

April 10, 2023 Update Bloomberg offers an informative report on a brand new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) regarding talc products, in exchange for a share of any settlements. J&J is now willing that it will pay $8.9 billion to settle all lawsuits.

The involvement of funders is public knowledge due to the New Jersey court rule requiring the disclosure of certain information regarding outside funding backers.
