Johnson & Johnson (JNJ.N) has put the amount of $400 million for resolving U.S. state consumer protection actions as part of a wider $8.9 billion effort to settle allegations that its Baby Powder and other talc products cause cancer. Is lush talc asbestos free.

J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm intends to pay for different types of cancer victims in bankruptcy settlement. Is lush talc asbestos free. J&J has declared that its products containing talc are safe and won’t cause cancer. J&J is seeking another time to settle more than 38,000 lawsuits brought in bankruptcy, and to prevent any new cases from being filed in the near future.
The bankruptcy plan of LTL would pay $400 million into an additional trust to settle lawsuits filed by state attorneys general alleging that J&J did not comply with laws against unfair business practices in the State of New York and consumer protection laws by misleading consumers regarding the safety of its talc products.

Many states had initiated consumer protection actions against J&J prior to the time that LTL’s bankruptcy filing stopped these investigations from moving forward in 2021. Is lush talc asbestos free. New Mexico and Mississippi had already launched suits in the past against Johnson & Johnson before then as well as the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative subpoenas or demands in LTL’s court papers.

New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy, joining cancer victims and their counterparts from the U.S. Justice Department’s bankruptcy watchdog, who argue that a profit-making firm like J&J does not qualify for bankruptcy protections aimed at the struggling debtors.
LTL’s first attempt at resolving the lawsuits in bankruptcy was dismissed following similar arguments. In the end, a U.S. appellate court determined the LTL wasn’t in “financial financial distress” and was not eligible of bankruptcy protection. Is lush talc asbestos free. LTL filed a second bankruptcy less than two hours after that dismissal, arguing that the second bankruptcy was different as it had less money available and had more support for a settlement.

New Mexico and Mississippi said in their motion to dismiss that LTL’s bankruptcy renewal violates the law enforcement powers of the state by attempting unilaterally to cap the liability of the company for state consumer protection measures.

LTL’s new filings also included more information about how the company would evaluate and settle cancer claims if the bankruptcy plan is approved.

The highest payments under the settlement would be $500,000 for those diagnosed with terminal mesothelioma before the age of 45, and $260,000 for those who have been diagnosed with ovarian cancer that is terminal prior to age 45.

From there, the proposed settlement provides discounts based on the severity and type of cancer, an individual’s age, history of talc use and other factors. Is lush talc asbestos free. For instance an individual who was using talc products weekly, had an ancestral history of ovarian cancer and was diagnosed with stage II ovarian cancer when she was 55 might qualify to receive a payout of $21,125 under the plan.

Judge gives order to J&J and talc opponents to take part in settlement talks.

Following another round of hearings in Johnson & Johnson’s effort to employ a Texas Two Step bankruptcy strategy to resolve talc litigation and federal bankruptcy judge Michael Kaplan has ordered the firm and the people who opposed the plan to enter into negotiations to settle the matter, Bloomberg reports.

With its second bankruptcy attempt for LTL management, a subsidiary founded by J&J to handle the claims company offered a settlement of $8.9 billion. Is lush talc asbestos free. While a firm representing plaintiffs supports the proposal, another group is against the settlement.

This week, the opposition group, known as”The Official Committee of Talc Claimants and urging the bankruptcy court to dismiss this case by saying that LTL is not a factor in financial hardship.

“The filing is an incredibly legal and ineffective attempt by a handful of law firms to try to block claimants from voting on the resolution plan–a plan the vast majority of claimants support,” J&J’s litigation chief Erik Haas, said in a statement. Is lush talc asbestos free. “The law firms involved in the filing are pursuing financial interests which do not align with, differ from and oppose the interests which their clientele. We’ll be submitting an answer to the appellate court.”

Is lush talc asbestos free. Clay Thompson, a lawyer for MRHFM which boasts more than mesothelioma clients who have sued J&J, said that the second bankruptcy attempt of J&J will fail.

“J&J issues press releases about how great its plan is, while insisting that the details of its plan–including the treatment each sick person will receive,” Thompson said in an announcement. “What do they have to hide?”

Kaplan has instructed the sides to develop a new restructuring plan, with the supervision from two mediators.

As of February 2022 Kaplan stated that J&J’s recourse to Chapter 11 to hasten a settlement that would relieve J&J from the thousands of lawsuits concerning its talcum products.

But in January of this year, an appeals court of the federal government overturned the verdict, ruling that the company was not able to be considered in “financial distress.”

After J&J’s contest the U.S. Supreme Court was turned down at the end of April J&J was granted a second petition for bankruptcy roughly two hours later. In response to that move, Kaplan froze the lawsuits for 60 days to decide whether to grant the second bankruptcy.

J&J’s unstoppable profit engine sputters after $6.9B settlement charge for talc.

With the two Chapter 11 attempts, J&J has purchased 19 months of which the cases were in limbo. Is lush talc asbestos free. J&J wants the claimants to decide whether they want to accept the settlement. J&J will require 75% support for the settlement to be approved.

Alongside the group of talc attorneys who have panned LTL’s bankruptcy plan in the U.S. Trustee, the U.S. Trustee which is a division of the U.S. Department of Justice, also filed an application to dismiss the second bankruptcy case of LTL.

In a recent filing, U.S. Trustee Andrew R. Vara wrote that the bankruptcy are “open to honest but unfortunate debtors.” These doors “are not open to parties who do not have a legitimate bankruptcy reason or want to abuse the bankruptcy process to delay or hinder their creditors,” Vara continued.

On the other hand, J&J maintains there is no proof conclusive that their Talc products, which includes its iconic baby powder, cause cancer. J&J has adopted the products of the market, first on North America in 2020–and the rest of the world later this year.

J&J seeks to avoid the cost of going to court. The company has won the majority of cases that were decided in court, however some losses have been very punishing.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Lush Talc Asbestos Free

June 2 2023 Update: At the trial for asbestos-containing talc that took place in California yesterday, some technical issues halted the opening statements made by defense attorneys. Is lush talc asbestos free. Jurors who were watching at home via Zoom and hearing the Johnson &Johnson’s lawyer express doubt about the science of the 70s affirming the presence of asbestos in their product before the opening was abruptly ended.

The plaintiff was able to introduce its first expert witness Arthur Langer. Langer explained that the existence of other minerals in the talc’s mineral content is inevitable. He testified that his team advised J&J in the year 1971 of the presence of chrysotile asbestos the company’s talc, albeit with just 0.1 percent. He also discovered more asbestos in 1976.

June 1st, 2023 Update: Is lush talc asbestos free. This is the first court trial that has taken place since J&J made the decision to split its talc division, and then declare bankrupt marks a pivotal moment of the ongoing lawsuit saga. Trial started on Monday in the tragic trial of a young plaintiff who was diagnosed with an aggressive and rare form of mesothelioma in the past year, a diagnosis lawyers on both sides acknowledge is a tragic loss.

Opening statements revealed the huge differences between the sides’ narrative. The attorney for the plaintiff took aim against Johnson & Johnson, alleging that the company employed deceitful techniques in its research practices and throughout the litigation procedure. In the words of attorney Johnson & Johnson tried to alter asbestos’ definition, despite internal documents from 1998 and 1994 that show fibers discovered in the tissue of the plaintiffs are included.

Johnson &J’s highly uncertain $8.9 billion settlement is hanging in the balance with the development of the trial. Despite the unique nature of the mesothelioma trial and its distinctive issues in comparison to other talcum powder lawsuits ruling in favor of the plaintiff could result in an enormous setback for J&J’s expectations of widespread acceptance of the settlement they have proposed among plaintiffs.

May 31 2023: Update from Johnson and Johnson’s bankrupt talc division is defending it’s Second Chapter 11 filing in the facing challenges from the talc injury plaintiffs. In an objection submitted to the New Jersey bankruptcy court, it argued that the situation was distinct from the prior filing. The subsidiary emphasized the record-breaking commitment of $8.9 billion to J&J which is the largest ever settlement in a mass tort bankruptcy case. Is lush talc asbestos free. There was no mention of how the amount of the settlement signifies that it’s an equitable settlement. J&J also claimed that it received support from numerous plaintiffs’ law firms that represent over sixty thousand claimants. This is not easy to confirm but is probably incorrect.

May 24, 2023 Update: Since Johnson &J Johnson’s bankruptcy filing, the first trial on the cosmetic talc products it claims to comprised of asbestos is set to start jury selection Monday, California with Alameda County Superior Court, the most favored place for plaintiffs. The plaintiff asserts that his mesothelioma resulted from asbestos exposure in J&J’s product which the company is denying. The trial also includes six retailers accused of selling talc-containing products.

May 22, 2023 Update: Lawyers involved in the 2nd J&J talc bankruptcy are now battling over who should be chosen to fill the post of the claims representative in the future, the role is crucially critical to resolving claim for talc. Is lush talc asbestos free. Randi Ellis, a lawyer who regularly appears in MDLs throughout the country was appointed as the claims representative in the first bankruptcy. J&J’s defense team wants Ellis to be appointed in that position and again, but attorneys for the talc plaintiffs are objecting on the grounds that Ellis has conflicts of interest which should stop her from holding that position once more. The conflict stems from the reality that Ellis was involved in the creation of the hotly contesting second bankruptcy, which raises doubts regarding her capacity to remain neutral. It’s true that this bankruptcy is likely to be dismissed in the end.

May 17th, 2023 Update: The pretend company that J&J put together to handle the bankruptcy of talc told an New Jersey bankruptcy court that they have allocated $400 million as a settlement for claims made by states accusing the company of misleading advertising for its talc products. Is lush talc asbestos free. This amounts to an $8.5 billion settlement for cancer victims. It’s hard to imagine the scenario in which J&J will be able to push the settlements of baby powder through at these numbers. While J&J’s proposed $8.5 billion offer may seem like a lot of money initially, it may not look good after you calculate the figures. The settlement plan based on our rough calculations would not provide victims with much more than an average settlement $100,000 per instance. That’s not enough.

May 15th, 2023 Update: J&J could be facing lawsuit brought by an advocacy group representing cancer victims. Is lush talc asbestos free. The group contends that J&J deliberately retracted a $61.5 billion fund-raising agreement in conjunction with its affiliate, LTL Management LLC, to create the appearance of financial hardship and confirm the unit’s Chapter 11 bankruptcy filing. The group argues that this act amounts to a fraudulent transfer of victims’ compensation rights. They plan to explore J&J’s actions in the wake of the dismissal of the LTL’s bankruptcy case in its first instance.

May 10 2023 Update: The following week this week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy petition filed from J&J subsidiaries LTL Management. In the meantime, however, it has approved an Order which requires both sides to participate in a second settlement mediation to see if an international settlement agreement can be brokered.

May 5th, 2023: Update on Talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products cause cancer due to asbestos exposure. Is lush talc asbestos free. Over 2,700 people have sued the firm and it is spending $1 million a month to defend itself. The company’s recent $29 million settlement at the Supreme Court of South Carolina forced it to seek bankruptcy protection, arguing for an equitable distribution of assets among talc claimants instead of being seized in the hands of the receiver. Other suppliers of talc have declared bankruptcy because of the litigation.

May 4, 2023 Update: U.S. The bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to resume negotiations with lawyers who rebuffed the proposed $8.9 billion settlement offer. At Trenton, New Jersey yesterday, the parties gathered in court to discuss next steps to take in the second bankruptcy case. Judge Kaplan has pushed for further settlement talks.

This is the answer to resolve these claims for J&J. A baby powder settlement could be achieved. Is lush talc asbestos free. However, it’ll require additional money – perhaps billions of dollars – of Johnson & Johnson.

Lawyers are divided over whether to take the proposal or not and not every client views the situation the same way their attorney does. The second bankruptcy case is expected to fail with Judge Kaplan has scheduled a hearing for June to decide whether to close the case for the third time.

May 3 2023 Update A group of cancer victims suing Johnson & Johnson (J&J) demanded an order from J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block the litigation surrounding talc-based products. The group of talc claimants filed a motion on Tuesday asking the Third Circuit to consider their appeal and return the case an earlier court with instructions to dismiss the bankruptcy. Is lush talc asbestos free. They also asked that the stopped tort litigation against J&J continue to proceed.
LTL filed for Chapter 11 protection once again following the bankruptcy filing it made earlier was denied by the Third Circuit earlier this year and offered a $8.9 billion payment. The committee argues that the recent ruling allowing the second Chapter 11 to continue, as well as halting the trials against J&J should be subject to the immediate Third Circuit review. The US Trustee has also requested it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation, Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a formal response in the appeals court saying that the filing is an “desperate and legally deficient attempt” by a few of law firms who have different financial interests.
May 1st 2023 Update: A question people keep asking is how plaintiffs and their lawyers turn off $8.9 billion. Of course, it’s a lot of money. But there are a lot of victims. Is lush talc asbestos free. These are an excellent cases for plaintiffs. We were reminded of this recently by two talc-related trials that have resulted in huge verdicts for plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon was settled with a verdict worth $18.1 million. The following month, a second mesothelioma trial involving talc was held for the court in South Carolina and resulted in a verdict of $29million for the plaintiff. In both instances, the defendant was Whittaker, Clark & Daniels Inc., one of the leading producers of talc in the U.S.
April 30th, 2023 Update: When J&J first attempted to drag the talcum powder litigation into bankruptcy, it was met with the option of putting aside $2 billion to settle the case. This was an absurdly low amount. The talc plaintiffs had not agreed with the offer. However, this time, J&J has increased the offer to $8.9 If the talc plaintiffs accept a bankruptcy settlement and they also have the support of a substantial part of the talc-related plaintiffs and their lawyers. Is lush talc asbestos free. But with 75% of plaintiffs who are a talc, which is required to approve bankruptcy plans, it a tough road since there are so many lawyers with vast collections of baby powder lawsuits that are opposed in favor of the deal.

What can be done to end the impasse? More billions.
April 25, 2023 Update: Talc plaintiffs have asked a judge to dismiss their Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, saying the company is not financially distressed. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Is lush talc asbestos free. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that LTL was not a candidate for bankruptcy relief as it had not demonstrated financial difficulties.

The claimants assert that the third Chapter 11 case is an fraud on the bankruptcy system and it’s being pursued in bad good faith. J&J claims the bankruptcy settlement is backed by “significant support” from companies representing around 60,000 claimants. It’s safe to say that the plaintiffs’ attorneys and the victims are split over their disagreement over the $8.9 billion offer for settlement.

April 21st, 2023 Update A bankruptcy judge decided the company Johnson & Johnson must face new lawsuits alleging that it offered a baby powder with a contaminant that caused cancer. Even though trials for Talc lawsuits are suspended for a minimum period of 60 days and new lawsuits are able to be filed and lawyers can begin preparing their cases. Is lush talc asbestos free. Judges expressed doubt about J&J’s absurd attempt to revive its strategy by filing a second bankruptcy trial.

April 13, 2023 Update: most important announcement is an $8.9 billion over the next 25 years settlement offer. Lawyers representing cancer victims within the MDL Class Action have pledged to fight the settlement with the talc claimants. Why? They feel it’s not enough to pay for 70 000 cancer patients. Is lush talc asbestos free. These lawyers believe that J&J should negotiate a bigger settlement or settle individual claims if the most recent bankruptcy is dismissed.

But there’s a separate group of lawyers outside of the leadership in that class action. The lawyers collectively have accumulated many thousands of cases. The group is seeking to settle the case now for what many argue is less than these victims deserve. Their argument is two-fold. The first is that they claim the settlement – which amounts to the equivalent of $100,000 per plaintiff – is fair.

It’s a difficult argument to make. But their second argument has more force: victims should now not wait and they want to get their money right now.

April 12 2023 Update: Some people are looking for ways J&J can go through bankruptcy again. The answer is complicated and confusing. Let’s try to clarify it simply.
Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future talc lawsuits conclusively. In other words, it thinks it will pay less when there is an element of bankruptcy that puts pressure to settle. Is lush talc asbestos free. Driving past more than 400 years in American past, the company believes that bankruptcy is beneficial to all parties by distributing settlements more equally and effectively than trial courts, in which some litigants receive substantial payouts, while others are left with nothing.

The main thrust of this 3rd Circuit decision was this is not a case of the profit-making company that has an affiliate to accept the legal responsibility and declare bankruptcy, which is what Congress thought of when drafting its Bankruptcy Code. But it also said that the entity was financially distress due to the fact that J&J offered unlimited financing.
So J&J decided to go with the unlimited funding part of the holding and did not promise to offer unlimited funding for cases. J&J claims that its revised financing arrangements with its subsidiary addresses the appeals court’s concerns, while offering claim payment funds. In the hope that offering victims lesser money could solve the underlying issue.

Attorneys representing cancer patients who do not agree with the agreement counter the agreement with what is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole is not exempt: victims’ lawyers call it the biggest “fraudulent move in United States history.”

Despite all the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it is a way of pushing this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10, 2023 Update Bloomberg offers an informative report on a brand new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) regarding talc products, in exchange for a share of any settlements. J&J is now willing that it will pay $8.9 billion to settle all lawsuits.

The involvement of funders is public knowledge due to the New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. The rules aim to respond to the increasing calls for regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you combine state and federal infant powder litigation. Third-party financing in mass tort cases has its pros and cons. However, there is no doubt that we are witnessing how third-party financing can help level the playing field between individual and big companies in court.

April 4 2023 Update: It is enjoyable to see the worm turning in this legal battle. J&J has taken another blow this week when the Third Circuit denied J&J’s request to keep the automatic stay in place during the time that J&J appeals a bankruptcy ruling before the U.S. Supreme Court. The automatic stay has froze thousands of talcum powder cases and stopped new lawsuits from arising ever since J&J initiated the controversial effort to spin the talc debts into a bankrupt company over a year earlier. Is lush talc asbestos free. When the 3rd Circuit ruled that this bankruptcy was not legal only a few months back, the stay was lifted. J&J wanted to see it continue in the meantime of an appeal to the SCOTUS appeal. However, the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that for the Supreme Court is willing even to take up the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay now in effect, the first new cases were filed and incorporated into the class action for talcum powder MDL within a year. Seven new talc lawsuits were joined to the MDL in the last month and brought the total number of cases in the pending process up to 37,522.

February 25, 2023 Update The following information is available: A Congressmen from Tennessee is now calling for the U.S. Government Accountability Office (GAO) launch an investigation into how much J&J products containing talc have cost the government in the years.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of not recognizing the risks of its talc-based products for decades while tax dollars were spent treating those injured by exposure to the chemicals. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.

Is lush talc asbestos free. J&J should begin to make reasonable settlement proposals for victims in order in putting this behind it. This is a blemish on one of the greatest companies.

February 14 2023 Update: During the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
