April 13th 2023 update: the biggest announcement is an $8.9 billion over 25 years settlement offer. Lawyers representing cancer patients who are part of MDL class action MDL collective action vowed to fight the settlement along with those who claim talc. Why? April 12 2023 Update: Many are looking for ways J&J can go through bankruptcy again. The answer is complicated and convoluted. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future talc litigations in a definitive manner. In other words, it believes it can pay less in the event of an element of bankruptcy that puts pressure to settle. Is makeup with talc safe. Moving past 400 years of American time, the business believes that bankruptcy is beneficial to all parties because it distributes settlement payments more equitably and more efficiently than trial courts where some litigants receive significant settlements while others get nothing.

The hyperbole wasn’t spared attorneys representing the victims claim it the most significant “fraudulent deal in United States history.”
Despite the legal jargon, J&J does not really think that the bankruptcy will endure. It is however a method of pushing this $8.9 billion settlement to keep the pressure on plaintiffs.
April 10, 2023 update: Bloomberg offers an informative report on a brand new law of New Jersey that is shedding new light on the funding of litigation in the baby powder class action lawsuit. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) over talc products in exchange for a share of any settlements. J&J is now offering that it will pay $8.9 billion in settlements for all lawsuits.
The funders’ involvement is public information because of a New Jersey court rule requiring the disclosure of certain information about outside funding backers.
