J&J’s proposed settlement with talc would be worth $440 million US state AGs. Is Non Talc Baby Powder Safe .

Johnson & Johnson (JNJ.N) has set aside $400 million to settle U.S. state consumer protection actions as part of a larger $8.9 billion effort to settle allegations that it’s Baby Powder and other talc-based products cause cancer. Is non talc baby powder safe.

J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm will pay various types of cancer patients in bankruptcy settlement. Is non talc baby powder safe. J&J has claimed that its Talc products are safe, and won’t cause cancer. J&J is seeking the second time to end more than 38,000 lawsuits in bankruptcy, as well as prevent new lawsuits from being filed in the future.
LTL’s bankruptcy plans would deposit $400 million to an additional trust to settle claims filed in state courts by attorneys general alleging that J&J had violated state unfair business practices and consumer protection laws by misleading consumers about the security of its talc-based products.

Many states had initiated consumer protection measures against J&J before LTL’s first bankruptcy filing prevented these investigations from taking place in 2021. Is non talc baby powder safe. New Mexico and Mississippi had already brought actions in the past against Johnson & Johnson before then and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative subpoenas or demands, according to LTL’s court filings.

New Mexico and Mississippi have taken steps to halt the bankruptcy of LTL, joining cancer victims and their counterparts from the U.S. Justice Department’s watchdog on bankruptcy, who have argued that a profitable business like J&J cannot benefit from bankruptcy protections meant for the struggling debtors.
The first time LTL attempted to settle the bankruptcy cases was rejected after the same arguments, when a U.S. appellate court ruled that LTL wasn’t in “financial financial distress” and thus not eligible to receive bankruptcy relief. Is non talc baby powder safe. LTL made a new bankruptcy application in just two hours following that dismissal, arguing that the second bankruptcy was different in that there was less money available and had a greater chance of securing a settlement.

New Mexico and Mississippi said in their motion to dismiss LTL’s new bankruptcy violates the state’s law enforcement authority by attempting unilaterally to cap the company’s liability for state consumer protection laws.

LTL’s recent filings also provided more information on how the company would evaluate and pay cancer claims should the bankruptcy plan be approved.

The largest amount of money under the settlement would be $500,000 to those diagnosed with cancer of the mesothelioma ovary before the age of 45, and $260,000 for people diagnosed with cancer of the ovary prior to age 45.

From there, the proposed settlement will offer discounts based on the type and severity of cancer, the individual’s years of age, their history of the use of talc, and other aspects. Is non talc baby powder safe. For instance, a woman who used talc products weekly, had a family history of ovarian cancer, and was diagnosed with stage II ovarian cancer when she was 55 could be in line for a $21,125 payout under the settlement plan.

Judge orders J&J and talc opponents to discuss settlement negotiations.

After another round of hearings in Johnson & Johnson’s effort to use a Texas Two-Step bankruptcy strategy for talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the company as well as those who oppose the move to conduct settlement talks, Bloomberg reports.

In its second bankruptcy effort for LTL Management, a subsidiary set up by J&J to manage the claims company offered a settlement amounting to $8.9 billion. Is non talc baby powder safe. While one group of law firms representing plaintiffs is in favor of the deal, another group is against the settlement.

In the last week, an opposition group, dubbed”The Official Committee of Talc Claimants in the bankruptcy court, demanded to dismiss the case arguing that LTL is not a factor in financial hardship.

“The filing is a desperate and legally deficient attempt by a few of law firms to try to prevent claimants from voting on the resolution, which the vast majority of claimants favor,” J&J’s litigation chief Erik Haas, said in an announcement. Is non talc baby powder safe. “The law firms behind their filing are financially oriented and have conflicts that are in conflict with, diverge from and oppose the interests which their clientele. We’ll soon submit an appeal an appeal to the appellate court.”

Is non talc baby powder safe. Clay Thompson, a lawyer for MRHFM, which has more than 80 mesothelioma clients who have sued J&J and J&J, has said that the second bankruptcy attempt of J&J will fail.

“J&J issues press releases describing how fantastic the plan is but simultaneously demanding that plan details–including what individual sick people would actually be treated to,” Thompson said in a statement. “What do they have to conceal?”

Kaplan has instructed the sides to develop a new arrangement plan under the oversight and supervision of mediators.

On February 20, 2022 Kaplan affirmed the ability of J&J’s use of Chapter 11 to hasten a settlement that will free J&J from the thousands of lawsuits concerning its talcum products.

In January of this year, a federal appeals court overturned the decision, ruling that the business could not be considered in “financial distress.”

In the event that J&J’s request to challenge the U.S. Supreme Court was rejected on April 1, J&J was granted a second petition for bankruptcy roughly two hours later. In response to that move, Kaplan froze the lawsuits for 60 days in order to determine whether or not to approve another bankruptcy.

J&J’s unstoppable profit engine sputters after $6.9B the talc litigation cost.

In the 2 Chapter 11 attempts, J&J has purchased 19 months of which cases have been in limbo. Is non talc baby powder safe. The company wants claimants to vote on accepting their settlement. J&J requires 75% support for the settlement to be approved.

In addition to the team of talc lawyers that criticized the bankruptcy of the company in the U.S. Trustee, the U.S. Trustee which is a division that is part of the U.S. Department of Justice is also submitting a motion to dismiss LTL’s bankruptcy second case.

In a letter filed this week, U.S. Trustee Andrew R. Vara wrote that the doors of the bankruptcy court are “open to honest but unfortunate debtors.” These doors “are not open to parties that lack a legitimate bankruptcy reason or want to use the bankruptcy process to hinder or delay their creditors,” Vara continued.

On the other hand, J&J maintains there is no conclusive evidence that its Talc products, which includes the famous baby powder, can cause cancer. J&J has taken the products of the market–first to be available in North America in 2020–and the remainder of the globe later this year.

J&J wants to avoid the cost of going to court. J&J has won the majority of the cases that have been decided during trial, however, certain losses have been extremely severe.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Non Talc Baby Powder Safe

June 2 2023 Update: At the asbestos talc case which took place in California yesterday, a few technical glitches interrupted the opening statement by the defense lawyers. Is non talc baby powder safe. Jurors who were watching from home via Zoom however, heard Johnson and Johnson’s lawyer express skepticism about the 70s science claiming asbestos was present in their product, but the trial was abruptly closed.

The plaintiff could introduce their first witness, Arthur Langer. Langer stated that the presence of other minerals with talc is inevitable. He testified that his team informed J&J in the year 1971 about the presence of chrysotile asbestos within the talc of the company, but in lesser than 0.1 percent. The asbestos was discovered by him in the year 1976.

June 1, 2023 Update: Is non talc baby powder safe. This is the first court trial that has taken place since J&J took the decision to disband its Talc segment and file for bankruptcy is a pivotal moment for the ongoing litigation story. Trial began yesterday in the harrowing case of a young 24-year-old plaintiff who was diagnosed with an aggressive and rare form of mesothelioma in the past year, an illness that lawyers on both sides believe is a tragedy of a different kind.

Opening statements laid bare huge differences between the sides’ narrative. The attorney representing the plaintiff aimed his ire at Johnson & Johnson, alleging the use of deceitful methods in their research practices as well as throughout the litigation process. The attorney claims that, according to, the company tried to manipulate the definition of asbestos, despite internal documents from 1978 and 1994 showing that asbestos fibers in the plaintiff’s tissue are included.

Johnson &J’s tangled $8.9 billion settlement proposal hangs in the balance with the progression of this trial. Despite the particularity of this mesothelioma lawsuit and its distinct issues compared to the majority of talcum powder lawsuits, a verdict favoring the plaintiff could inflict an unintended setback to Johnson & J’s expectations of widespread acceptance of their proposed settlement with plaintiffs.

May 31, 2023: Update from Johnson & Johnson’s bankrupt talc division vigorously defended their second Chapter 11 filing in the face of challenges from injured talc claimants. In an opposition filed with the New Jersey bankruptcy court, the subsidiary argued that the case was vastly different from the first filing. It emphasized the unprecedented commitment of $8.9 billion to J&J the largest settlement ever in an bankruptcy case involving mass torts. Is non talc baby powder safe. Not mentioned: how the amount of the settlement signifies that it’s an equitable settlement. J&J also claimed support from several plaintiffs’ legal firms representing more than sixty thousand claimants. It is difficult to confirm however it is likely to be incorrect.

May 24 2023 Update: In the wake of Johnson & Johnson’s 2021 bankruptcy filing, the first trial involving the cosmetic talc products it claims to containing asbestos is set to start jury selection on Monday in California at Alameda County Superior Court, which is a well-known location for plaintiffs. The plaintiff claims his mesothelioma resulted from asbestos exposure through J&J’s products, an allegation the company is denying. The trial also includes six retailers accused of selling talc products.

May 22nd, 2023 Update: Lawyers involved in the second J&J talc bankruptcy are battling over who should be appointed to the post of the claims representative in the future, a role that is critically critical to resolving claims involving talc. Is non talc baby powder safe. Randi Ellis, a lawyer who is frequently involved in MDLs all over the nation was appointed as the claims representative in the initial bankruptcy. J&J’s defense group wants Ellis to be appointed to that role yet again, but the lawyers for the talc plaintiffs have raised objections on the grounds that Ellis has an unrelated conflict of interest which would prohibit her from assuming that position again. The issue stems from the possibility that Ellis was believed to have been involved in drafting the controversially litigated second bankruptcy, which raises questions about her capacity to be neutral. The reality is this bankruptcy will likely to get dismissed anyway.

May 17th, 2023 Update: The fake company J&J formed for the talc litigation bankruptcy informed an New Jersey bankruptcy court that they have allocated $400 million as a settlement for claims of states that accuse the company of deceitful advertising for its talc product. Is non talc baby powder safe. That’s an $8.5 billion settlement for cancer victims. It’s difficult to envision any scenario in which J&J will be able to push these settlements for babies at these numbers. Although J&J’s $8.5 billion offer may seem like a lot at first, it does not look good after you calculate the figures. This settlement proposal – by our rough calculations – would not pay victims much more than a median settlement of $100,000 per instance. That is not enough.

May 15 2023 Update: J&J might be facing lawsuit by an advocacy group representing cancer patients. Is non talc baby powder safe. The group claims J&J intentionally withdrew a $61.5 billion financing agreement in conjunction with its affiliate, LTL Management LLC, in order to create a false sense of financial distress and to validate the company’s Chapter 11 bankruptcy filing. The group asserts this action is equivalent to a fraudulent transfer of the rights of compensation for victims. They are planning to study J&J’s actions following of the denial of LTL’s first bankruptcy case.

May 10, 2023 Update: Next week next week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to reject the second bankruptcy filing from J&J company LTL Management. In the meantime it has approved an Order calling for both parties to take part in a settlement mediation with the hopes of achieving the global settlement can be been reached.

May 5th 2023 Update: Talc provider Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to many lawsuits claiming that its talc products cause cancer from asbestos exposure. Is non talc baby powder safe. Over 2700 people have sued the company and it is spending $1 million a month on legal defense. The company’s most recent $29 million verdict in South Carolina forced it to file for bankruptcy protection, arguing that assets should be distributed in an equitable manner among talc claimants instead of being confiscated by the receiver. Other suppliers of talc have been forced to file for bankruptcy as a result of the litigation.

May 4 2023, Update U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to reopen settlement discussions with lawyers who have rejected the company’s proposed $8.9 billion settlement offer. The court in Trenton, New Jersey yesterday the parties gathered in court to discuss next steps to take in this second case of bankruptcy. Judge Kaplan has pushed for further settlement talks.

This is the best way to settle these claims for J&J. A settlement for baby powder can get done. Is non talc baby powder safe. However, it will require more money – billions of dollars of Johnson & Johnson.

Lawyers are divided on whether or not to agree with the proposal and not all clients view the issue in the same manner their lawyer does. This second case of bankruptcy is likely to fail as Judge Kaplan has set a date for a hearing in June to decide whether to remove the bankruptcy after the second.

May 3, 2023 Update: A group of cancer victims suing Johnson & Johnson (J&J) requested to have the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is a bid to stop the litigation surrounding talc-based products. The group representing claimants for talc has filed a motion this week, asking for the Third Circuit to consider their case and to send it back the lower court, with instructions to dismiss the bankruptcy. Is non talc baby powder safe. The committee also requested that the halted tort litigation against J&J be allowed to continue.
LTL requested Chapter 11 protection once again following its bankruptcy filing that was denied in the Third Circuit earlier this year which offered the possibility of an $8.9 billion deal. The committee argues that the recent ruling which allowed the second Chapter 11 to continue, in addition to halting trials against J&J should be subject to the immediate Third Circuit review. The US Trustee has also requested be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a response in the appeals court declaring the filing a “desperate and legally deficient move” by a small number of law firms with conflicts of financial interests.
May 1st, 2023 Update: One common question that people ask is how plaintiffs and their lawyers turn around $8.9 billion. That’s of course quite a sum. But there are plenty of victims. Is non talc baby powder safe. They are a great case for plaintiffs. We have been reminded of this recently in two talc trials which resulted in big verdicts for the plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon led to the verdict worth $18.1 million. The following month, a second mesothelioma talc case was brought to the court at South Carolina and resulted in an award of $29 million on behalf of the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. one of the top producers of talc in the U.S.
April 30th 2023 Update: When J&J first attempted to drag the lawsuit over talcum powder into bankruptcy, it came with the option of putting aside $2 billion for settlements. The sum was ridiculously low. There was no one among the talc victims who supported the offer. This time around, however, J&J has increased the offer to $8.9 in the event that the talc victims accept a bankruptcy settlement and they have the backing of a significant segment of the talc plaintiffs and their attorneys. Is non talc baby powder safe. But with 75% of talc plaintiffs, which is required to approve bankruptcy plans is a difficult road with so many lawyers with huge stocks of baby powder litigations opposed in favor of the deal.

What could solve the impasse? More billions.
April 25 2023, Update Talc Cancer victims have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, saying the company is not financially distressed. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is non talc baby powder safe. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not eligible for bankruptcy relief since it was unable to demonstrate financial distress.

The claimants contend that LTL’s second Chapter 11 case is an fraud on the bankruptcy system, and that it is being pursued in bad good faith. J&J asserts that the bankruptcy settlement has “significant support” from companies representing around 60,000 people who are claiming. It is fair to say plaintiffs’ lawyers and victims ‘ lawyers are not united over this $8.9 billion deal.

April 21, 2023 Update: A bankruptcy judge decided in favor of Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. Although trials for talc lawsuits are paused for a minimum of 60 days however, new lawsuits may be filed, and lawyers are able to begin preparing their cases. Is non talc baby powder safe. Judges expressed skepticism about J&J’s attempt to revive its plan with a second bankruptcy trial.

April 13th, 2023 Update: The big update is about the $8.9 billion over 25 years of settlement. Lawyers representing cancer victims in the MDL collective action promised to fight the settlement alongside those who claim talc. Why? They believe it’s not enough money for those suffering from cancer who are 70,000. Is non talc baby powder safe. These lawyers believe that J&J could negotiate a greater settlement or pursue individual claims in the event that the latest bankruptcy is declared unconstitutional.

But there is another lawyer group that isn’t part of the top leadership in group action. The lawyers collectively have accumulated many thousands of cases. This group wants to settle now for what many argue is less than these victims deserve. Their argument appears to be two-fold. First, they argue the settlement, which is about 100,000 dollars per plaintiff – is fair.

That is a hard argument to present. However, their second argument has more force: victims should not afford to wait any longer and need their money today.

April 12 2023 Update: Many are asking how J&J can go through bankruptcy once more. The answer is complicated and confusing. Let’s try to simplify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future talc lawsuits conclusively. That is, it thinks it can get a lower rate if there is an element of bankruptcy that puts pressure to negotiate a settlement. Is non talc baby powder safe. In a quest to cover hundreds of years of American time, the business claims that bankruptcy benefits all parties by distributing settlement payments more equitably and effectively than trial courts, where litigants are awarded significant awards while others receive nothing.

The basic tenet in the 3rd Circuit decision was this is not a case – an enterprise that is profitable, forming an entity to assume the legal responsibility and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. However, it also stated it was not financially distress because J&J promises unlimited funding.
Then J&J took advantage of the unlimited funding aspect of the deal and did not promise to provide unlimited funding for the litigation. The company claims that its updated financing arrangements with its subsidiary will address appeals court’s concerns, while offering claim payment funds. As if providing victims with lower amounts of money would resolve the problem at hand.

Lawyers representing cancer patients who are against the agreement argue this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole was not spared by the victims’ lawyers, who call this the biggest “fraudulent transfer that has occurred in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. It is however a method of pushing this $8.9 billion settlement to keep the pressure on plaintiffs.

April 10 2023 Update Bloomberg is running an intriguing report on a brand new law in New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) over talc products in exchange in exchange for a portion of winnings. J&J is now offering the payment of $8.9 billion to settle any lawsuits.

The funders’ involvement is made public because of a New Jersey court rule requiring the disclosure of certain information about outside funding backers. This rule is intended to address the growing calls for the regulation of lawsuit funders. J&J faces over 60,000 claims when you add up federal and state baby powder lawsuits. Third-party financing in mass tort cases is not without its pros and cons. There is no doubt that we are witnessing how third-party financing can help level the playing field for individuals and big corporations in court.

April 4 2023 Update: It’s enjoyable to see the worm turning in this legal battle. J&J was hit again this week, when it was found that the Third Circuit denied J&J’s request to extend the automatic stay during the time that J&J appeals a bankruptcy ruling to the U.S. Supreme Court. The automatic stay has halted the cases of talcum powder in a number of years and stopped new lawsuits from getting filed ever since J&J initiated the controversial effort to spin talc-related liabilities off into a bankrupt entity over one year ago. Is non talc baby powder safe. When it was decided that the 3rd Circuit ruled that this bankruptcy was not valid a few months ago, the stay was revoked. J&J had hoped to have it stayed in place until an appeal to the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that is that the Supreme Court is willing even to accept the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay having been in effect, the first new cases have been filed and transferred into the class action involving talcum powder MDL in over one year. Seven new talc-related lawsuits were brought into the MDL over the last month, bringing the total number of cases pending to 37,522.

February 25, 2023 Update: A Congressmen from Tennessee is now calling for be the U.S. Government Accountability Office (GAO) start an investigation into how much J&J product containing talc has cost the government in the many years.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of failing to recognize the dangers of its talc products for many years, while tax dollars were spent on treating people who suffered injuries from exposure to the products. This lawsuit comes a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.

Is non talc baby powder safe. J&J should begin to make fair settlement offers to victims to getting this behind it. This is a blemish on one of the top businesses.

February 14 2023 Update: During an appearance today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
