While J&J’s $8.5 billion offer seems like a lot initially, it will not look good when you consider the math. The proposed settlement based on our rough calculations – would not offer victims anything more than an average settlement $100,000 per instance. That’s not enough.

May 1 2023 Update: A most frequently asked question is how could plaintiffs and their attorneys turn around $8.9 billion. Of course, it’s quite a sum. There are a lot of victims. Is perfumed talc safe. They are a great claims for plaintiffs. We were reminded of this recently when two talc cases have resulted in huge verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon led to an award that was $18.1 million. April 25, 2023, Update Talc Cancer victims have demanded a judge reject their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Is perfumed talc safe. It was the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company was not eligible to receive bankruptcy relief because it did not show financial difficulties.
The claimants assert that the Second Chapter 11 case is an abuse of the bankruptcy system and that it’s being conducted in bad good faith. J&J says the bankruptcy settlement is backed by “significant backing” from firms representing approximately 60,000 claimants. It’s safe to say that lawyers representing plaintiffs and victims ‘ lawyers are divided on what they believe is an $8.9 billion offer for settlement.
April 21st, 2023 Update: A bankruptcy judge has decided in favor of Johnson & Johnson must face new lawsuits alleging that the firm sold baby powder that was contaminated and causing cancer. Although trials for the talc lawsuits have been suspended for a minimum period of 60 days, new lawsuits can be filed, and lawyers are able to begin preparing their cases. Is perfumed talc safe. The judge expressed skepticism over J&J’s ridiculous effort to revive its strategy by filing a second bankruptcy case.
April 13 2023: Update on the major story is that there’s an $8.9 billion over the course of 25 years settlement offer. Lawyers representing cancer victims who are part of MDL class action MDL group action promised to fight the settlement with the talc claimants. Why? They think it is too little money for the 70 000 cancer patients. Is perfumed talc safe. The lawyers say that J&J could negotiate a greater settlement or even litigate individual claims in the event that the latest bankruptcy is thrown out.
There is a different lawyer group that isn’t part of the leadership in group action. These lawyers have amassed the equivalent of tens of thousands of lawsuits. This group wants to settle the case now in what many believe to be less than the victims deserve. Their argument seems to be two-fold. The first is that they claim the settlement, which is about the equivalent of $100,000 per plaintiff is fair.
It’s a difficult argument to prove. However, their second argument has more force: the victims can no longer wait and want the money immediately.
April 12 2023 Update: Many are looking for ways J&J is able to file for bankruptcy once more. The answer is complex and complicated. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only option to address both present and future lawsuits involving talc conclusively. It believes it can pay less should there be a bankruptcy component that applies pressure for a settlement. Is perfumed talc safe. Going back to more than 400 years in American past, the company asserts that bankruptcy benefits all parties by distributing settlements more equally and efficiently than trial courts, which are where litigants get significant payouts, while others are left with nothing.
The essence in this 3rd Circuit decision was this isn’t a case that involves a profitable company making a subsidiary to take the legal risk and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code. However, the court also ruled it was not financially distress due to the fact that J&J promised unlimited funding.
So J&J took advantage of the unlimited funding portion of the deal but did not pledge that it would provide unlimited funds for cases. The company says that its modified financing arrangements with its subsidiary addresses the concerns of the appellate court, while offering claim payment funds. As if providing victims with lesser money could solve the overarching problem.
Attorneys representing cancer victims who oppose the agreement counter this by arguing that the plaintiff is the legal argument. Is perfumed talc safe. They counter with legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed attorneys representing the victims claim it the largest “fraudulent move in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. However, it’s a means of trying to push this $8.9 billion settlement and keep pressure on plaintiffs.
April 10 2023 Update: Bloomberg is running an intriguing report on a brand new law that has been passed in New Jersey that is shedding new light on litigation funding in the baby powder Class action suit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) regarding talc products, in exchange for a percentage of any settlements. J&J is now willing to pay $8.9 billion to settle lawsuits.
The involvement of the funders is made public due to a New Jersey court rule requiring the disclosure of certain information about outside funding backers. This rule is intended to address the growing calls for regulation of the litigation funders. J&J is facing more than 60,000 claims when you add up state and federal child powder-related lawsuits. Third-party funding in mass tort claims has pros and pros and. But there is no question that we are witnessing how third-party financing can help level the playing field between individuals as well as large corporations in the courtroom.
April 4 2023 Update: It is enjoyable to see the worm turn in this litigation. J&J suffered another setback this week, when the Third Circuit denied J&J’s request to extend the automatic stay during the time that J&J appeals a bankruptcy ruling in the U.S. Supreme Court. The automatic stay has frozen the cases of talcum powder in a number of years and stopped new lawsuits from getting filed ever since J&J started the controversial process to spin talc-related liabilities off into a bankrupt company over one year in the past. Is perfumed talc safe. After the 3rd Circuit ruled that this bankruptcy was not legal a few months ago, the stay was revoked. J&J was hoping to have it continue in the meantime of hearing the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance is that the Supreme Court is willing even to accept the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay officially lifted, the very first new cases were filed and incorporated into the Talcum Powder class action MDL in over one year. Seven new talc-related lawsuits were brought into the MDL in the last month and brought the total number of pending cases up to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee is now demanding that be the U.S. Government Accountability Office (GAO) launch an investigation to determine how much J&J talc products have cost the government in the years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of not recognizing the risks of its talc-based products for many years, while tax dollars were spent treating those injured by exposure to the product. This lawsuit comes a few weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Is perfumed talc safe. J&J has to begin making reasonable settlement offers to victims, in order to put all of this behind it. It’s a mark on one of the most prestigious businesses.
