J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company plans to pay different kinds of cancer victims as part of an arrangement for bankruptcy. April 13th 2023 Update: The biggest story is that there’s an $8.9 billion over the course of 25 years offer for settlement. Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc-related lawsuits definitively. Going back to more than 400 years in American past, the company asserts that bankruptcy benefits all parties because it distributes settlements more fairly and efficiently than trial courts, in which some litigants receive substantial awards while others receive nothing.
The main thrust of the 3rd Circuit decision was this is not a case – one that makes a profit, but an entity to assume the legal risk and declare bankruptcy – Congress had in mind when it came to drafting the Bankruptcy Code. It also clarified it was not financially crisis because J&J promises unlimited funding.
So J&J jumped on the unlimited funding portion of the contract and didn’t promise to offer unlimited funding for lawsuits. J&J claims that its new financing agreements with its subsidiary address appeals court’s concerns while still offering claim payment funds. As if offering victims lower amounts of money would resolve the overarching problem.
Attorneys representing cancer victims who are against the agreement argue this argument by saying that it is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole was not spared: victims’ lawyers call it the largest “fraudulent transaction that has occurred in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe that this bankruptcy will last. It is however a method to try and push the $8.9 billion settlement, and to keep the pressure on plaintiffs.

Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) on behalf of talc products. They exchanged in exchange for a portion of settlements. J&J has now offered an offer of $8.9 billion to settle all lawsuits.
The involvement of funders is made public because of a New Jersey court rule requiring the release of certain details regarding outside funding backers. The rules aim to tackle the growing demands for regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you include state and federal child powder-related lawsuits.
