April 13th, 2023: Update on the major story is that there’s an $8.9 billion over the next 25 years of settlement. April 12 2023 Update: Many are asking how J&J can file for bankruptcy once more. The answer is complicated and complex. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future lawsuits involving talc conclusively. Also, it believes it can pay less should there be the bankruptcy element which applies pressure to settle. April 10 2023 Update: Bloomberg has an interesting article on a new law that has been passed in New Jersey that is shedding new light on litigation funding in the plaintiffs in the class action. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) over talc products in exchange for a share of any profits. J&J is now willing an offer of $8.9 billion in settlements for all lawsuits.

The funders’ involvement is public knowledge because of a New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. The rule aims to address the rising calls for the regulation of lawsuit funders. J&J has to deal with more than 60,000 lawsuits when you take into account federal and state baby powder lawsuits.
