The court in February of 2022 Kaplan stated that J&J’s use of Chapter 11 to hasten a settlement that would free the company from the thousands of lawsuits related to its talcum-based products.
But in the month of January, an appeals court in the United States overturned the decision, deciding that the company was not able to be considered to be in “financial financial distress.”

May 1st 2023 Update: One question people keep asking is how could plaintiffs and their lawyers be able to turn around $8.9 billion. Of course, it’s an immense amount of money. But there are a lot of victims. Is talc and baby powder the same thing. These are an excellent case for plaintiffs. We were reminded recently with two talc trials have resulted in huge verdicts for the plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon was settled with the verdict worth $18.1 million. A month later, another talc mesothelioma case went to the court on the other side of South Carolina and resulted in a verdict of $29million on behalf of the plaintiff. April 30 2023 Update: In the year 2023, when J&J first attempted to drag the lawsuit over talcum powder into bankruptcy, it did so with an offer to reserve $2 billion for settlements. This time, however, J&J has increased the offer to $8.9 If the talc plaintiffs are willing to accept bankruptcy settlements and also has the backing of a significant segment of the talc plaintiffs as well as their lawyers. Is talc and baby powder the same thing. But with 75% of plaintiffs of talc are required for bankruptcy plan approval It’s a long and difficult process because of the number of lawyers who have huge inventories of baby powder lawsuits that are opposed in favor of the deal.
What can be done to end the impasse? More billions.
April 25 2023 Update: Talc patients have demanded a judge reject the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, insisting that the company is not financially strained. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Is talc and baby powder the same thing. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible for bankruptcy relief because it did not show financial difficulties.
The claimants assert that the second Chapter 11 case is an abuse of the bankruptcy system, and that the case is being handled in bad faith. J&J claims the bankruptcy settlement has “significant backing” from companies representing about 60,000 potential claimants. It’s fair to say that lawyers representing plaintiffs and victims ‘ lawyers are divided on what they believe is an $8.9 billion deal.
April 21st, 2023 Update: A bankruptcy judge has decided that Johnson & Johnson must face new lawsuits alleging that the firm sold baby powder that was contaminated and causing cancer. Judges expressed doubt about J&J’s ridiculous effort to revive its strategy with another bankruptcy case.
April 13, 2023 Update: major update is about the $8.9 billion over the next 25 year period settlement offered. Lawyers representing cancer victims within the MDL Class Action have vowed to fight the settlement alongside those who claim talc. Why? They believe it’s not enough money for 70,000 victims who have cancer. Is talc and baby powder the same thing. These lawyers argue that J&J could negotiate a greater settlement or pursue individuals’ claims if the current bankruptcy is thrown out.
However, there is a second set of lawyers who are not part of the leadership group in group action. These lawyers have amassed the equivalent of tens of thousands of lawsuits. This group wants to settle for what is believed to be less than these victims deserve. Their argument is two-fold. First, they argue that the settlement – about an average of $100,000 per plaintiff – is fair.
That is a hard argument to present. However, their second argument has more teeth: victims can be no longer patient and demand their money today.
April 12, 2023 Update: People are looking for ways J&J could file for bankruptcy once more. The answer is complex and complicated. But let’s try to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future lawsuits involving talc conclusively. Also, it believes it can pay less when there is a bankruptcy component that applies pressure to negotiate a settlement. Is talc and baby powder the same thing. Moving past more than 400 years in American history, the company claims that bankruptcy benefits all parties because it distributes settlements more equally and more efficiently than trial courts where some litigants receive significant settlements while others get nothing.
The essence of the 3rd Circuit decision was this is not a case – the profit-making company that has an entity to assume the legal burden and declare bankruptcy Congress had in mind when it came to drafting the Bankruptcy Code. However, it also stated that the subsidiary was not financially distress because J&J promised unlimited funding.
This is why J&J jumped on the unlimited funding part of the deal and did not promise to provide unlimited funding for lawsuits. The company says that its modified financing arrangements with its subsidiary address concerns of the appellate court, while providing funds for claims. As if providing victims with less money will solve the underlying issue.
Lawyers representing cancer patients who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous ruling. The hyperbole wasn’t spared: victims’ lawyers call it the biggest “fraudulent transfer in United States history.”
In spite of the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method of pushing this $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10 2023 Update Bloomberg has an interesting piece on a law that has been passed within New Jersey that is shedding new light on the funding of litigation in the baby powder Class action suit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a share of any wins. J&J is now willing the payment of $8.9 billion to settle lawsuits.
The involvement of the funders is made public because of a New Jersey court rule requiring the disclosure of certain information about funders outside the state. The rules aim to address the rising calls for the regulation of lawsuit funders. J&J has to deal with more than 60,000 lawsuits when you include federal and state Baby Powder lawsuits. Third-party funding in mass tort claims has both pros and cons. But there is no question that we are witnessing how third-party funding can level the playing field for individuals and big corporations in the courtroom.
April 4, 2023 Update: It is fun to watch the worm turn in this legal battle. J&J has taken another blow this week when it was found that the Third Circuit denied J&J’s request to extend the automatic stay as J&J appeals a bankruptcy ruling at the U.S. Supreme Court. It has froze thousands of talcum powder cases and prevented the filing of new lawsuits ever since J&J initiated the controversial effort to spin the talc liability off into a bankrupt subsidiary more than one year in the past. Is talc and baby powder the same thing. After it was decided that the 3rd Circuit ruled that this bankruptcy was not valid a few months ago, the stay was removed. J&J had hoped to have it remain in effect until the SCOTUS appeal. But, no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance the Supreme Court is willing even to consider the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay being officially lifted, the first new cases were filed and incorporated into the class action involving talcum powder MDL in the space of a year. Seven new talc lawsuits have been brought into the MDL in the last month and brought the total number of cases that are pending to 37,522.
February 25, 2023 Update The following information is available: A Congressmen from Tennessee is now calling for the U.S. Government Accountability Office (GAO) start an investigation into the amount J&J talc products have cost the government over the decades.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of failing to recognize the dangers of its talc-based products for long while tax dollars utilized to treat people injured by exposure to the product. The lawsuit comes just a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
Is talc and baby powder the same thing. J&J needs to start making fair settlement offers for victims in order getting this behind it. It’s a mark on one of the most prestigious businesses.
