Moving past more than 400 years in American history, the company believes that bankruptcy is beneficial to all parties by distributing settlements more equally and efficiently than trial courts, where some litigants receive significant awards while others receive nothing.
The essence of this 3rd Circuit decision was this is not a case of an enterprise that is profitable, forming an entity to assume the legal risk and declare bankruptcy – something Congress thought of when drafting its Bankruptcy Code. However, it also stated it was not financially distress because J&J promises unlimited funding.

The involvement of the funders is publicly available because of an New Jersey court rule requiring the release of certain details about outside funding backers. The rules aim to tackle the growing demands for the regulation of lawsuit funders. J&J is facing more than 60,000 claims when you include state and federal child powder-related lawsuits.
