J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company intends to pay for different types of cancer victims as part of bankruptcy settlement. J&J is seeking the second time to end more than 38,000 cases in bankruptcy and stop new cases from being filed in the near future.
LTL’s bankruptcy plan will pay $400 million to an additional trust to settle claims filed from state attorney generals claiming that J&J violated laws against unfair business practices in the State of New York as well as consumer protection laws, by deceiving consumers about the security of its talc-based products.

The hyperbole wasn’t spared: victims’ lawyers call it the most significant “fraudulent move ever in United States history.”
Despite all the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way of trying to push this $8.9 billion settlement, and to keep pressure on plaintiffs.

Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a portion of any wins. J&J is now offering that it will pay $8.9 billion to settle lawsuits.
The involvement of funders is made public due to an New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. This rule is intended to address the rising calls for regulation of litigation funders. J&J faces over 60,000 claims when you combine state and federal child powder-related lawsuits. Third-party funding in mass tort claims has its pros and cons. March 16th 2023 Update: With the bankruptcy stay having been in effect, the first new cases were filed and incorporated into the class action for talcum powder MDL in just over a year. Seven new talc cases were joined to the MDL in the past month, bringing the total number of cases that are pending to 37,522.
February 25 2023 Update The following information is available: A Congressmen from Tennessee has now demanded that the U.S. Government Accountability Office (GAO) launch an investigation into the amount J&J product containing talc has cost the government in the years.
Recently, in an open letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the risks of its talc products over decades while tax dollars were utilized to treat people injured by exposure to the products. This lawsuit comes a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
