April 13th 2023 update: the most important story is that there’s an $8.9 billion over the course of 25 years offer for settlement. Lawyers representing cancer patients within MDL class action MDL class action have pledged to fight the settlement along with those who claim talc. Why? They feel it’s not enough for those suffering from cancer who are 70,000. Is talc bad for you. But there’s a separate lawyer group that isn’t part of the leadership of the class action. They have amassed the equivalent of tens of thousands of lawsuits. They want to settle the case now in what many believe to be less than the victims deserve. Their argument appears to be two-fold. Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future talc litigations in a definitive manner. In other words, it believes it can pay less should there be an element of bankruptcy that puts pressure to negotiate a settlement. Is talc bad for you. Going back to hundreds of years of American past, the company argues that bankruptcy benefits everyone by dispersing settlement payments more equitably and effectively than trial courts, where litigants are awarded significant payouts, while others are left with nothing.
The main thrust of the 3rd Circuit decision was this is not a case of the profit-making company that has an affiliate to accept the legal risk and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. However, the court also ruled that the entity was in financial trouble due to the fact that J&J promises unlimited funding.
Then J&J decided to go with the unlimited funding portion of the holding and did not promise to offer unlimited funding for cases. The company says that its updated financing arrangements with its subsidiary addresses the concerns of the appellate court, while providing funds for claims. In the hope that offering victims less money would solve the overarching problem.
Lawyers representing cancer patients who oppose the deal counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous decision. The hyperbole wasn’t spared by the victims’ lawyers, who call this the biggest “fraudulent transaction of assets in United States history.”
Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. But it’s a way to try and push the $8.9 billion settlement to keep pressure on plaintiffs.
April 10 2023, Update Bloomberg is running an intriguing article on a new law in New Jersey that is shedding new light on the funding of litigation in the Class action suit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) over talc products in exchange for a portion of any winnings. J&J is now offering to pay $8.9 billion to settle all lawsuits.
The involvement of funders is made public because of the New Jersey court rule requiring the release of certain details about funding sources outside of the. The law is designed to tackle the growing demands for regulation of litigation funders. J&J is facing more than 60,000 claims when you include federal and state child powder-related lawsuits. Third-party funding in mass tort claims has its pros and cons. However, there is no doubt that we are seeing how third-party funding can level the playing field between people as well as large corporations in court.
April 4, 2023 Update: It’s enjoyable to see the worm turning in this legal battle. J&J suffered another setback this week, when the Third Circuit denied J&J’s request to continue the automatic stay in the meantime that J&J appeals an order granting bankruptcy to the U.S. Supreme Court. It has froze the cases of talcum powder in a number of years and prevented new lawsuits from being filed ever since J&J launched the controversial attempt to spin the talc liabilities into a bankrupt subsidiary more than a year back. Is talc bad for you. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient just a few months ago the stay was removed. February 25, 2023 Update This morning, a Congressmen from Tennessee has now demanded that authorities from the U.S. Government Accountability Office (GAO) launch an investigation to determine how much J&J talc products have cost the government in the years.
Recently, in an open letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the risks of its talc products over long while tax dollars spent on treating people who suffered injuries from exposure to the products. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.
