Attorneys representing cancer patients who oppose the deal counter this by arguing that the plaintiff is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s decision. Hyperbole is not exempt the lawyers representing victims call it the largest “fraudulent transaction of assets in United States history.”
Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. But it is a way of trying to push this $8.9 billion settlement to keep pressure on plaintiffs.
