Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future talc lawsuits conclusively. That is, it thinks it can get a lower rate should there be the bankruptcy element which applies pressure to settle. Driving past 400 years of American time, the business argues that bankruptcy benefits all parties by distributing settlement payments more evenly and efficiently than trial courts, in which some litigants receive substantial award while others do not.

Hyperbole was not spared attorneys representing the victims claim it the biggest “fraudulent transaction of assets in United States history.”

Despite all the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way of pushing this $8.9 billion settlement to keep the pressure on plaintiffs.

April 10 2023 update: Bloomberg has an interesting piece on a law that has been passed in New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) on behalf of talc products. They exchanged in exchange for a portion of profits. J&J has now offered that it will pay $8.9 billion to settle any lawsuits.

The involvement of the funders is public information due to the New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. The rule aims to address the growing calls for regulation of the litigation funders. J&J is facing more than 60,000 claims when you combine federal and state child powder-related lawsuits.
