Is talc dangerous in my makeup. Randi Ellis, a lawyer who is frequently involved in MDLs throughout the country, was appointed as the claims representative in the previous bankruptcy. J&J’s defense team would like Ellis to be appointed in that position again, but lawyers for the plaintiffs in talc are arguing on the grounds that Ellis has conflicts of interest that would prevent her from taking on that role in the future. The conflict stems from the possibility that Ellis was believed to have been involved in the creation of the hotly litigated second bankruptcy, which raises concerns about her capability to remain neutral. It’s difficult to envision any scenario in which J&J can get the settlements of baby powder through in these figures. Although J&J’s $8.5 billion offer may seem like a large sum at first, it does not look very appealing when you look at the numbers. J&J’s global vice president of litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a statement in the appeals court, calling the request a “desperate and legally insufficient plan” by a handful of law firms that have different financial interests.
May 1 2023 Update: A question people keep asking is how could plaintiffs and their lawyers turn on $8.9 billion. Of course, that’s quite a sum. However, there are lots of victims. Is talc dangerous in my makeup. And these are really good arguments for plaintiffs. We were reminded recently by two talc-related trials that have resulted in huge verdicts for the plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon led to a verdict worth $18.1 million. A month later, another talc mesothelioma case went to trial at South Carolina and resulted in a verdict of $29 million on behalf of the plaintiff. Both cases were defended by Whittaker, Clark & Daniels Inc. one of the leading manufacturers of talc in U.S.
April 30 2023 Update: When J&J first tried to bring the talcum powder lawsuit into bankruptcy, they came with an offer to reserve $2 billion for settlements. This was an absurdly low amount. None of the talc plaintiffs supported the proposal. This time around, however, J&J has increased the offer to $8.9 for talc-related plaintiffs if they accept a bankruptcy settlement and they have the backing of a significant segment of the talc plaintiffs and their lawyers. Is talc dangerous in my makeup. But with 75% of plaintiffs who are a talc, which is required to approve bankruptcy plans is a difficult road with so many lawyers with large stocks of baby powder litigations opposed against the proposed settlement.
What could solve the impasse? More billions.
April 25, 2023, Update Talc plaintiffs have asked a judge to disqualify the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Is talc dangerous in my makeup. It was the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not eligible for bankruptcy relief because it had not demonstrated financial difficulties.
The claimants contend that the second Chapter 11 case is an misuse of the bankruptcy system and the case is being handled in bad faith. J&J says the bankruptcy settlement has “significant support” from firms representing an estimated 60,000 plaintiffs. It’s safe to say plaintiffs’ lawyers and victims ‘ lawyers are not united over this $8.9 billion offer for settlement.
April 21, 2023 Update: A bankruptcy judge has ruled in favor of Johnson & Johnson must face new lawsuits alleging that the firm sold tainted baby powder causing cancer. Even though trials for the talc lawsuits have been suspended for a minimum period of 60 days however, new lawsuits may be filed and lawyers may begin to prepare their cases. Is talc dangerous in my makeup. Judges expressed skepticism about J&J’s absurd attempt to revive its strategy by filing a second bankruptcy trial.
April 13, 2023 Update: The biggest story is that there’s an $8.9 billion over the next 25 year period settlement offered. Lawyers representing cancer victims involved in MDL class action MDL Class Action have pledged to fight the settlement with talc claimants. Why? They believe it’s not enough for more than 70,000 cancer victims. Is talc dangerous in my makeup. They argue that J&J should seek a bigger settlement or litigate individual claims if the latest bankruptcy is thrown out.
But there’s a separate group of lawyers outside of the leadership group in that class action. The lawyers collectively have accumulated many thousands of cases. The group is seeking to settle in what many believe to be far less than what these victims deserve. Their argument appears to be two-fold. They argue that the settlement, which is about an average of $100,000 per plaintiff – is fair.
This is an argument that is difficult to present. But their second argument has more teeth: victims can be no longer patient and demand their money now.
April 12 2023 Update: People are looking for ways J&J is able to file for bankruptcy again. The answer is complicated and confusing. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only means to resolve both current and future talc-related lawsuits definitively. Also, it believes that it will be less expensive in the event of an element of bankruptcy that puts pressure for a settlement. Is talc dangerous in my makeup. Driving past more than 400 years in American history, the company asserts that bankruptcy benefits all parties as it distributes settlement payments more evenly and effectively than trial courts in which some litigants receive substantial award while others do not.
The essence in the 3rd Circuit decision was this is not a case – the profit-making company that has subsidiaries to meet the legal burden and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code. It also clarified that the entity was in financial distress due to the fact that J&J promises unlimited funding.
Thus, J&J decided to go with the funding unlimited part of the holding and did not promise to provide unlimited funding for lawsuits. The company says that its updated financing arrangements with its subsidiary addresses the concerns of the appellate court, while providing funds for claims. As if providing victims with less money will solve the problem at hand.
Lawyers representing cancer patients who oppose the deal counter the agreement with what is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole is not exempt attorneys representing the victims claim it the most significant “fraudulent transaction of assets in United States history.”
Despite the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method of trying to push this $8.9 billion settlement to keep pressure on plaintiffs.
April 10, 2023 update: Bloomberg provides an insightful article on a new law in New Jersey that is shedding new light on litigation funding in the Class action suit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) concerning talc products in exchange for a percentage of any wins. J&J is now offering an offer of $8.9 billion to settle lawsuits.
The involvement of the funders is made public due to the New Jersey court rule requiring the disclosure of certain information about funding sources outside of the. The rules aim to address the growing calls for the regulation of lawsuit funders. J&J has to deal with more than 60,000 lawsuits when you combine state and federal child powder-related lawsuits. Third-party funding for mass tort lawsuits is not without its pros and pros and. There is no doubt that we are witnessing how third-party funding can level the playing field between people and large corporations in the courtroom.
April 4 2023 Update: It’s interesting to watch the worm turn in this legal battle. J&J suffered another setback this week, when the Third Circuit denied J&J’s request to keep the automatic stay in place during the time that J&J appeals a bankruptcy ruling before the U.S. Supreme Court. This automatic stay froze the cases of talcum powder in a number of years and stopped the filing of new lawsuits ever since J&J launched the controversial attempt to spin the talc liability into a bankrupt entity over one year ago. Is talc dangerous in my makeup. When the 3rd Circuit ruled that this bankruptcy was not valid some months ago, the stay was revoked. J&J was hoping to have it continued pending an appeal to the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance of the Supreme Court is willing even to accept the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay officially lifted, the first new cases have been filed and transferred into the class action involving talcum powder MDL within a year. Seven new talc cases were joined to the MDL in the past month increasing the number of pending cases up to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee is now requesting that authorities from the U.S. Government Accountability Office (GAO) launch an investigation into how much J&J Talc products have cost the government in the decades.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of not recognizing the risks of its talc-based products for years while tax dollars were used to treat those who were injured through exposure to the chemicals. The lawsuit comes just a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
Is talc dangerous in my makeup. J&J should begin to make reasonable settlement proposals to victims, in order in putting this behind. This is a blemish on one of the world’s greatest companies.
February 14 2023 Update: In the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
