May 1st 2023 Update: A question people keep asking is how the plaintiffs’ lawyers and their clients turn on $8.9 billion. Of course, it’s an enormous amount of money. But there are a lot of victims. Is talc in eyeshadow dangerous. They are a great case for plaintiffs. We were reminded of this recently with two talc trials ended in large verdicts for the plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon was settled with the verdict that was $18.1 million. The following month, a second mesothelioma trial involving talc was held for trials at South Carolina and resulted in a verdict of $29million in favor of plaintiff. This time, J&J has increased the offer to $8.9 in the event that the talc victims will allow a bankruptcy settlement and they also have the support of a large portion of the talc plaintiffs and their attorneys. Is talc in eyeshadow dangerous. But 75% of the plaintiffs who are a talc, which is required to approve bankruptcy plans is not an easy task with so many lawyers with large inventories of baby powder lawsuits opposed in favor of the deal.
What can be done to end the impasse? More billions.
April 25 2023, Update Talc Cancer victims have sought a court order to dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, saying the company is not financially strained. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is talc in eyeshadow dangerous. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not eligible for bankruptcy relief since it did not show financial stress.
The claimants contend that LTL’s 2nd Chapter 11 case is an abuse of the bankruptcy system and that it is being pursued in bad good faith. J&J states that the bankruptcy settlement receives “significant support” from the firms that represent around 60,000 people who are claiming. It is fair to say that the plaintiffs’ attorneys and victims ‘ lawyers are not united over this $8.9 billion settlement offer.
April 21st, 2023 Update A bankruptcy judge has decided that Johnson & Johnson must face new lawsuits alleging that the firm sold a baby powder that contained a chemical that causes cancer. Judges expressed skepticism about J&J’s ridiculous effort to revive its plan with a second bankruptcy case.
April 13 2023 Update: major update is about the $8.9 billion over the course of 25 years offer for settlement. Lawyers representing cancer victims involved in the MDL group action vowed to fight the settlement alongside Talc claimants. Why? They feel it’s not enough for those suffering from cancer who are 70,000. Is talc in eyeshadow dangerous. The lawyers say that J&J should negotiate a larger settlement or settle individual claims if the most recent bankruptcy is declared unconstitutional.
However, there is a second group of lawyers that is not part of the top leadership in group action. These lawyers have collectively amassed tens of thousands of cases. They want to settle with what they believe is less than the victims deserve. The argument they make is twofold. They argue that the settlement, which is about the equivalent of $100,000 per plaintiff is fair.
That is a hard argument to prove. But their second argument has more force: the victims can not afford to wait any longer and need the money immediately.
April 12 2023 Update: People are wondering if J&J is able to file for bankruptcy once more. The answer is complex and complex. But let’s try to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only method to address both present and future talc-related lawsuits definitively. That is, it believes it can pay less in the event of the bankruptcy element which applies pressure for a settlement. Is talc in eyeshadow dangerous. In a quest to cover 400 years of American past, the company argues that bankruptcy benefits all parties as it distributes settlement payments more equitably and effectively than trial courts where litigants are awarded significant award while others do not.
The main thrust in the 3rd Circuit decision was this is not a case – one that makes a profit, but an entity to assume the legal risk and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. But it also said that the subsidiary was not in financial trouble due to the fact that J&J offered unlimited financing.
So J&J took advantage of the unlimited funding portion of the contract but did not pledge to fund unlimited litigation. The company says that its updated financing arrangements with its subsidiary will address concerns of the appeals court while offering claim payment funds. As if offering victims less money would solve the underlying issue.
Attorneys representing cancer victims who do not agree with the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed the lawyers representing victims call it the most significant “fraudulent move of assets in United States history.”
Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it’s a way to push for this $8.9 billion settlement, and to keep pressure on plaintiffs.
April 10 2023 update: Bloomberg has an interesting report on a brand new law within New Jersey that is shedding new light on the funding of litigation in the baby powder suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) over talc products in exchange for a portion of any winnings. J&J is now willing to pay $8.9 billion to settle lawsuits.
The funders’ involvement is public information because of the New Jersey court rule requiring the release of certain details about funding sources outside of the. The law is designed to address the growing calls for the regulation of litigation funders. J&J is facing more than 60,000 claims when you take into account federal and state child powder-related lawsuits. Third-party funding in mass tort claims has pros and cons. However, there is no doubt that we are witnessing how third-party funding can level the playing field between people and big corporations in the courtroom.
April 4 2023 Update: It’s enjoyable to see the worm turning in this case. J&J took another hit this week when they were denied by the Third Circuit denied J&J’s request to continue the automatic stay while J&J appeals a bankruptcy ruling in the U.S. Supreme Court. It has frozen thousands of talcum cases and prevented the filing of new lawsuits ever since J&J launched the controversial attempt to spin the talc liability off into a bankrupt subsidiary over one year ago. Is talc in eyeshadow dangerous. When it was decided that the 3rd Circuit ruled that this bankruptcy was not valid just a few months ago the stay was removed. J&J wanted to see it remain in effect until the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that the Supreme Court is willing even to hear the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay officially lifted, the first new cases were filed and incorporated into the talcum powder class action MDL in the space of a year. Seven new talc lawsuits were brought into the MDL in the last month and brought the total number of cases in the pending process up to 37,522.
February 25 2023 Update: A Congressmen from Tennessee is now demanding that authorities from the U.S. Government Accountability Office (GAO) start an investigation into how much J&J product containing talc has cost the government in the decades.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of failing to recognize the dangers of its talc-based products for long while tax dollars used to treat those who were injured through exposure to the products. The lawsuit comes just a few weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Is talc in eyeshadow dangerous. J&J should begin to make fair settlement offers to victims, in order the process of putting all this behind it. This is a disgrace to one of the greatest firms.
