Johnson & Johnson asserts that bankruptcy is the only means to resolve both current and future talc litigations in a definitive manner. Moving past the 400-year span of American past, the company argues that bankruptcy benefits all parties because it distributes settlement payments more equitably and effectively than trial courts, where litigants are awarded significant payouts, while others are left with nothing.

Despite the legal jargon, J&J does not really think that the bankruptcy will endure. But it’s a way to push for this $8.9 billion settlement and keep pressure on plaintiffs.
