Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) regarding talc products, in exchange for a share of any winnings. J&J is now offering the payment of $8.9 billion in settlements for all lawsuits.
The funders’ involvement is publicly available because of an New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rule aims to address the growing calls for regulation of litigation funders. J&J has more than 60,000 claims when you take into account state and federal baby powder lawsuits.
