J&J’s proposed settlement with talc would pay $400 million to US state AGs. Is Talc In Makeup Dangerous .

Johnson & Johnson (JNJ.N) has put aside $400 million to resolve U.S. state consumer protection actions as part of a broader $8.9 billion plan to settle allegations that its Baby Powder as well as other talc ingredients cause cancer. Is talc in makeup dangerous.

J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company will pay various types of cancer patients in the bankruptcy settlement. Is talc in makeup dangerous. J&J has stated that its products containing talc are safe and do not cause cancer. It’s trying for the second time to end more than 38,000 lawsuits filed in bankruptcy, as well as prevent new lawsuits from coming forward in the near future.
LTL’s bankruptcy plan would pay $400 million to an additional trust to settle claims brought by state attorneys general alleging that J&J had violated states’ unfair practices and consumer protection laws through misleading consumers about the safety of its talc products.

Many states had initiated consumer protection measures against J&J prior to the time that LTL’s bankruptcy filing stopped those investigations from taking place in 2021. Is talc in makeup dangerous. New Mexico and Mississippi had already brought actions in the past against Johnson & Johnson before then and states like Arizona, Maryland, North Carolina, Texas and Washington had issued subpoenas or civil investigative demands according to court filings.

New Mexico and Mississippi have taken steps to halt the bankruptcy of LTL in a joint move with cancer victims as well as those affected by cancer and the U.S. Justice Department’s bankruptcy watchdog. They have argued that a successful business like J&J can’t benefit from bankruptcy protections intended for struggling debtors.
LTL’s first attempt at resolving the bankruptcy-related lawsuits was dismissed following similar arguments. A U.S. appeals court determined the LTL wasn’t in “financial financial distress” and ineligible for bankruptcy protection. Is talc in makeup dangerous. LTL filed a second bankruptcy less than two hours after that dismissal, arguing that the second bankruptcy was different in that it had less money and had more support for the settlement.

New Mexico and Mississippi said in their motion for dismissal that LTL’s renewed bankruptcy violates the law enforcement powers of the state by trying to unilaterally cap the liability of the company in state consumer protection actions.

LTL’s recent filings also provided more information about how the company plans to evaluate and pay for cancer claims when the bankruptcy plan is approved.

The maximum amount under the settlement would be $500,000 for patients diagnosed with cancer of the mesothelioma ovary before the age of 45, and $260,000 for patients diagnosed with advanced ovarian cancer before age 45.

From there, the proposed settlement offers discounts based on the kind and severity of cancer, the patient’s age, history of the use of talc, and other aspects. Is talc in makeup dangerous. For instance the case of a woman who used daily talc products, had a family history of ovarian cancer and was diagnosed Stage II cancer of the ovary when she was 55 may be eligible to receive a payment of $21,125 under the plan.

Judge gives order to J&J and talc oppositionists to take part in settlement talks.

Following another hearing in Johnson and Johnson’s efforts to use a Texas Two-Step bankruptcy strategy to settle talc lawsuits and federal bankruptcy judge Michael Kaplan has ordered the company and those opposing the plan to hold negotiations to settle the matter, Bloomberg reports.

In its second bankruptcy effort for LTL management, a subsidiary founded by J&J to settle claims – the company offered a settlement amounting to $8.9 billion. Is talc in makeup dangerous. While a firm representing plaintiffs agree with the offer, another group is against the settlement.

In the last week, an opposition group, known as”The Official Committee of Talc Claimants requested the bankruptcy court to dismiss this case arguing that LTL can not be considered financially distressed.

“The filing is a desperate and legally ineffective attempt by a few of law firms to stop claimants from deciding on the resolution plan, a plan that the overwhelming majority of claimants support,” J&J’s litigation chief Erik Haas, said in an announcement. Is talc in makeup dangerous. “The law firms involved in the filing are pursuing financial interests which clash with, differ from and are in opposition to the interests they represent. We’ll soon submit an answer before the court of appeals.”

Is talc in makeup dangerous. Clay Thompson, a lawyer for MRHFM who has more than 80 mesothelioma victims who have filed lawsuits against J&J and J&J, has said that J&J’s second bankruptcy effort failed.

“J&J issue press releases about how wonderful its plan is while simultaneously insisting that the details of its plan–including the treatment the individual sick individuals would be treated to,” Thompson said in the statement. “What is J&J’s plan to conceal?”

Kaplan has instructed both sides to create a arrangement plan under supervision of two mediators.

As of February 2022 Kaplan acknowledged J&J’s use of Chapter 11 to hasten a settlement that would release J&J from the hundreds of thousands of claims related to its talcum-based products.

But in January of this year, an appeals court in the United States overturned the verdict, ruling that the firm could not be considered in “financial financial distress.”

When J&J’s attempt to challenge the U.S. Supreme Court was rejected the same month, J&J declared bankruptcy about two hours later. In response to that move, Kaplan froze the lawsuits for 60 days in order to determine whether or not to accept another bankruptcy.

J&J’s unstoppable profit engine sputters after $6.9B talc litigation charge.

With Two Chapter 11 attempts, J&J has bought 19 months during which cases were put on hold. Is talc in makeup dangerous. The company is requesting that claimants decide whether they want to accept the settlement. J&J would need 75% of the vote for the settlement to be approved.

In addition to the team of talc lawyers that criticized the bankruptcy of the company, the U.S. Trustee which is a division of the U.S. Department of Justice, also filed an application to dismiss LTL’s bankruptcy second case.

In a statement this week, U.S. trustee Andrew R. Vara wrote that the doors of bankruptcy courts are “open to honest, but naive debtors.” Those doors “are not open to parties that do not have a legitimate purpose or that seek to use the bankruptcy process to delay or hinder their creditors,” Vara continued.

In its own words, J&J maintains there is no conclusive evidence that its Talc products, which includes its iconic baby powder, can cause cancer. J&J has taken the products of the market first on North America in 2020–and the rest of the world later this year.

J&J intends to steer clear of the costly business of going to court. It has won the majority of the cases that were decided through trial, though some losses have been punishing.
A well-known trial in Missouri ended in an $4.7 billion verdict against the drug company, which was later reduced to $2.1 billion following appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine cases involving talc, which are on appeal or have been concluded. Out of 41 trials 32 have resulted in the favor of J&J as well as mistrials or verdict for a plaintiff that was reversed upon appeal. Is talc in makeup dangerous. Separately, the company in 2020 sought to settle nearly 1000 cases at a cost of $110 million. Bloomberg reported at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Talc In Makeup Dangerous

June 2 2023 Update: At the asbestos talc case in California yesterday, a few technical issues disrupted the opening statements made by defense lawyers. Is talc in makeup dangerous. Jurors watching at home via Zoom, did hear Johnson & Johnson’s lawyer voice his skepticism about the 70s science affirming the presence of asbestos in their product before the session abruptly ended.

In the meantime, the plaintiff was able to present its first expert witness Arthur Langer. Langer said that the presence of additional minerals along with talc is expected. He said that his team was notified by J&J in the year 1971 about the presence of chrysotile asbestos in the talc of the company, but in lower than 0.1 percent. The asbestos was discovered by him in 1976.

June 1, 2023 Update: Is talc in makeup dangerous. First trial after J&J made the decision to split its talc segment and file for bankruptcy marks an important turning point in the ongoing talc litigation controversy. Trial began yesterday in the heartbreaking case of a young 24 year-old plaintiff who was diagnosed with a rare and aggressive form of mesothelioma in the past year, which both sides agree is a tragic loss.

Opening statements laid bare sharp differences in the two sides’ narrative. The attorney representing the plaintiff took aim on Johnson & Johnson, alleging the use of deceitful tactics in research practices and throughout the litigation procedure. The attorney claims that, according to Johnson & Johnson attempted to alter the definition of asbestos despite internal documents dating back to 1998 and 1994 that show asbestos fibers that were found in the plaintiff’s tissue are included.

Johnson &J’s highly uncertain $8.9 billion settlement is hanging in the balance as we progression of this trial. Despite the particularity of this mesothelioma-related case and its distinct issues compared to the majority of talcum powder lawsuits A verdict in favor of the plaintiff could result in an enormous setback for J&J’s hopes for broad acceptance of their settlement proposal among plaintiffs.

May 31, 2023 Update: Johnson & Johnson’s bankrupt talc division is defending their Second Chapter 11 filing in the face of challenges from talc injury claimants. In an appeal to the New Jersey bankruptcy court, it argued that the situation was vastly different from the earlier filing. It also emphasized the unprecedented commitment of $8.9 billion to J&J as the largest settlement ever in an bankruptcy case involving mass torts. Is talc in makeup dangerous. Not mentioned: how the size of the settlement indicates that it is an equitable settlement. J&J also claimed support from several plaintiffs’ legal firms representing more than sixty thousand claimants. This is difficult to verify but likely incorrect.

May 24 2023 Update: In the wake of Johnson and Johnson’s bankruptcy filing in 2021 filing, the first trial concerning its cosmetic talc products that are believed to with asbestos content is scheduled to start jury selection on Monday, May 24, California in Alameda County Superior Court, a historically good location for plaintiffs. The plaintiff claims that his mesothelioma was triggered by asbestos exposure in J&J’s product, an allegation J&J denies. The trial also includes six retailers accused of selling talc-containing products.

May 22, 2023 Update: Lawyers involved in the 2nd J&J talc bankruptcy are battling over who should be appointed to the role of the claims representative in the future, an important role important to resolving the claim for talc. Is talc in makeup dangerous. Randi Ellis, a lawyer who regularly appears in MDLs throughout the United States was appointed the claims representative in the initial bankruptcy. J&J’s defense team would like Ellis to be named to the position and again, but attorneys for the talc plaintiffs have raised objections to the claim that Ellis has a conflict of interest which should stop her from being appointed to that post for the second time. The dispute stems from fact that Ellis was involved in drafting the controversially contesting second bankruptcy, which raises questions about her ability to be neutral. In reality, this bankruptcy will likely to be dismissed in the end.

May 17th, 2023 Update: The fake company J&J created to settle the talc litigation bankruptcy disclosed to an New Jersey bankruptcy court that they have designated $400 million to pay the claims brought by states accusing the company of misleading advertising for its talc products. Is talc in makeup dangerous. This amounts to an $8.5 billion settlement for cancer sufferers. It’s difficult to imagine a scenario where J&J can get these settlements for babies given these numbers. Although J&J’s $8.5 billion offer seems like a large sum initially, it will not appear appealing when you consider the math. This settlement offer based on our rough calculations, would not pay victims much more than a median settlement of $100,000 per instance. It’s not enough.

May 15th 2023 update: J&J might be facing lawsuit from an advocacy group representing cancer patients. Is talc in makeup dangerous. The group claims that J&J deliberately retracted the $61.5 billion funding agreement together with its parent company, LTL Management LLC, to create the appearance of financial hardship and validate the unit’s Chapter 11 bankruptcy filing. The group asserts this action amounts to a fraudulent transfer of victims’ compensation rights. They intend to investigate J&J’s actions after the announcement of the dismissal of the first bankruptcy case of LTL.

May 10 2023 Update: The following week, this week the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to reject the second bankruptcy filing from J&J subsidiaries LTL Management. In the meantime it has approved an order which requires both sides to participate in a settlement mediation with the hopes of achieving the global settlement can be brokered.

May 5th, 2023 Update: Talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products cause cancer from asbestos exposure. Is talc in makeup dangerous. Over 2700 people have sued the firm and it has been spending $1 million a month for legal defense. The company’s most recent $29 million verdict that was handed down in South Carolina forced it to apply for bankruptcy protection and argue that assets should be distributed in an equitable manner between talc claimants rather than being seized through the receiver. Other suppliers of talc have been forced to file for bankruptcy as a result of lawsuits.

May 4, 2023 Update U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to relaunch talks with lawyers who have rejected the company’s $8.9 billion deal. It was in Trenton, New Jersey yesterday the parties appeared in court to discuss the next steps for their second bankruptcy matter. Judge Kaplan pushed more settlement talks.

This is the answer to resolve the claims of J&J. A settlement for baby powder can get done. Is talc in makeup dangerous. But it will require more money, more billions of dollars of Johnson & Johnson.

Lawyers are divided over whether or not to accept the plan and not all clients see the situation the same way their lawyer does. The second bankruptcy case is destined to be a failure the judge Kaplan has set a date for a hearing in June to determine if she will close the case for the third time.

May 3, 2023 Update A group of cancer victims who are suing Johnson & Johnson (J&J) requested that they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt litigation regarding talc-related products. The group of talc claimants submitted a motion on Tuesday, asking that the Third Circuit to consider their case and send it back the lower court with instructions to discharge the bankruptcy. Is talc in makeup dangerous. They also asked that stoppage of tort litigation against J&J continue to continue.
LTL has filed for Chapter 11 protection once again following the bankruptcy filing it made earlier was rejected by the Third Circuit earlier this year with an $8.9 billion settlement. The committee argues that the recent ruling allowing LTL’s third Chapter 11 to continue, in addition to halting trials against J&J is a reason for immediate Third Circuit review. The US Trustee requested be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation Erik Haas, was quoted by Bloomberg declaring that J&J plans to file a formal response to the appeals court characterizing the filing as a “desperate and legally inadequate effort” by a handful of law firms that have conflicting financial interests.
May 1, 2023 Update: One most frequently asked question is how plaintiffs and their attorneys turn down $8.9 billion. Of course, it’s a lot of money. There are a lot of victims. Is talc in makeup dangerous. These are actually a good cases for plaintiffs. We were reminded of this recently in two talc trials which ended in large verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon resulted in the verdict that was $18.1 million. A month later, another talc mesothelioma case went to trial within South Carolina and resulted in the verdict of $29 million for the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. one of the most prominent manufacturers of talc in U.S.
April 30th 2023 Update: J&J first tried to bring the talcum powder litigation into bankruptcy, it came with the option of putting aside $2 billion for settlements. This was an absurdly low amount. The talc plaintiffs had not supported the offer. This time, however, J&J has increased the offer to $8.9 if the talc plaintiffs will allow a bankruptcy settlement and they have the support of a large segment of the talc plaintiffs and their lawyers. Is talc in makeup dangerous. But with 75% of plaintiffs in the talc category, which is necessary for bankruptcy plan approval It’s a long and difficult process with so many lawyers with vast inventories of baby powder-related lawsuits, opposed against the proposed settlement.

What is the solution to this impasse? More billions.
April 25, 2023 Update: Talc patients have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, which claims that the business is not financially troubled. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Is talc in makeup dangerous. The 3rd Circuit dismissed its first Chapter 11 case in January, saying LTL was not eligible for bankruptcy relief since it did not show financial stress.

The plaintiffs argue that LTL’s Second Chapter 11 case is an overreach of the bankruptcy system, and that it is being pursued in bad good faith. J&J asserts that the bankruptcy settlement receives “significant support” from the firms that represent approximately 60,000 claimants. It’s safe to say that plaintiffs’ lawyers and the victims are split over what they believe is an $8.9 billion amount of settlement offered.

April 21st, 2023 Update A bankruptcy judge decided in favor of Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. Even though trials for Talc lawsuits are suspended for a minimum of 60 days, new lawsuits can be filed and lawyers will begin preparing their cases. Is talc in makeup dangerous. Judges expressed skepticism about J&J’s pathetic attempt to revive its strategy by filing the second bankruptcy case.

April 13 2023: Update on the biggest news is the $8.9 billion over 25 year period settlement offered. Lawyers representing cancer patients in MDL class action MDL Class Action have promised to fight the settlement alongside talc claimants. Why? They feel it’s not enough for 70 000 cancer patients. Is talc in makeup dangerous. These lawyers argue that J&J should negotiate a bigger settlement or even litigate individuals’ claims if the current bankruptcy is dismissed.

But there’s a separate lawyer group that isn’t part of the top leadership in the class action. These lawyers have amassed hundreds of thousands of cases. They want to settle now for what many argue is far less than what these victims deserve. Their argument appears to be twofold. They argue that the settlement – which amounts to an average of $100,000 per plaintiff – is fair.

This is an argument that is difficult to prove. However, their second argument has more force: the victims can no longer wait and want their money now.

April 12, 2023 Update: People are wondering if J&J is able to file for bankruptcy again. The answer is complex and complex. But let’s try to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to address both present and future talc lawsuits conclusively. In other words, it believes that it will be less expensive if there is an element of bankruptcy that puts pressure for a settlement. Is talc in makeup dangerous. Moving past 400 years of American history, the company believes that bankruptcy is beneficial to all parties as it distributes settlement payments more equitably and effectively than trial courts, in which some litigants receive substantial settlements while others get nothing.

The gist in this 3rd Circuit decision was this is not a case – a profitable company making an affiliate to accept the legal liability and declare bankruptcy Congress thought of when drafting its Bankruptcy Code. It also clarified that the entity was financially distress because J&J assured it of unlimited funding.
Thus, J&J jumped on the unlimited funding aspect of the holding and didn’t promise to provide unlimited funding for cases. The company says that its new financing agreements with its subsidiary address concerns of the appellate court, while offering claim payment funds. It’s as if giving victims less money would solve the overall issue.

Lawyers representing cancer victims who do not agree with the agreement counter this argument by saying that it is the legal argument. Is talc in makeup dangerous. They counter with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s decision. The hyperbole wasn’t spared: victims’ lawyers call it the largest “fraudulent deal ever in United States history.”

In spite of the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it is a way to push for this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10 2023 Update: Bloomberg offers an informative piece on a law that has been passed within New Jersey that is shedding new light on the funding of litigation in the class action lawsuit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) over talc products in exchange for a percentage of any wins. J&J is now willing that it will pay $8.9 billion to settle lawsuits.

The involvement of funders is public knowledge due to a New Jersey court rule requiring the release of certain details about funding sources outside of the. The law is designed to address the growing calls for the regulation of lawsuit funders. J&J has to deal with more than 60,000 lawsuits when you combine state and federal infant powder litigation. Third-party funding of mass tort cases has its pros and cons. But there is no question that we are seeing how third-party funding can level the playing field between people and big corporations in court.

April 4 2023 Update: It’s interesting to watch the worm turn in this litigation. J&J took another hit this week when an appeals court in the Third Circuit denied J&J’s request to maintain the automatic stay while J&J appeals an appeal to the U.S. Supreme Court. This automatic stay froze thousands of talcum powder cases and stopped any the filing of new lawsuits ever since J&J began the controversial plan to spin the talc liability off into a bankrupt company over one year in the past. Is talc in makeup dangerous. When the 3rd Circuit ruled that this bankruptcy was invalid a few months ago, the stay was lifted. J&J was hoping to have it remain in effect until hearing the SCOTUS appeal. But the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance the Supreme Court is willing even to accept the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay now officially lifted, the first new cases have been filed and transferred into the talcum powder class action MDL in over one year. Seven new talc lawsuits have been added to the MDL during the month of March which brings the total number of pending cases up to 37,522.

February 25 2023 Update This morning, a Congressmen from Tennessee is now calling for the U.S. Government Accountability Office (GAO) launch an investigation into how much J&J Talc products have cost the government over the decades.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of failing to recognize the dangers of its talc products for many years, while tax dollars were spent on treating people who suffered injuries from exposure to the products. The suit comes just a few days after J&J’s loss to the 3rd Circuit Court of Appeals.

Is talc in makeup dangerous. J&J must begin making reasonable settlement proposals to victims to begin to put all of this behind it. This is a blemish on one of the top companies.

February 14 2023 Update: In a hearing today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
