J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company intends to pay different types of cancer sufferers in the bankruptcy settlement. Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future talc-related lawsuits definitively. In other words, it thinks it can get a lower rate should there be an element of bankruptcy that puts pressure to settle. Is talc in makeup safe. Moving past more than 400 years in American history, the company claims that bankruptcy benefits everyone by dispersing settlements more equally and more efficiently than trial courts where litigants are awarded significant payouts, while others are left with nothing.
The main thrust in the 3rd Circuit decision was this is not a case – a profitable company making subsidiaries to meet the legal burden and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. But it also said that the subsidiary was not financially trouble due to the fact that J&J promises unlimited funding.

Hyperbole did not go unnoticed by the victims’ lawyers, who call this the biggest “fraudulent move ever in United States history.”
