The group representing claimants for talc made a motion Tuesday requesting the Third Circuit to consider their case and to send it back an earlier court with instructions for dismissing the bankruptcy. LTL requested Chapter 11 protection once again following the bankruptcy filing it made earlier was denied in the Third Circuit earlier this year and offered a $8.9 billion deal. April 13th, 2023: Update on the biggest announcement is an $8.9 billion over the course of 25 years settlement offer. April 12 2023 Update: People are asking how J&J could file for bankruptcy again. The answer is complicated and complex. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc lawsuits conclusively. That is, it believes it can pay less should there be a bankruptcy component that applies pressure for a settlement. Moving past hundreds of years of American history, the company claims that bankruptcy benefits all parties because it distributes settlements more fairly and effectively than trial courts, where litigants are awarded significant payouts, while others are left with nothing.

Lawyers representing cancer patients who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the largest “fraudulent transfer of assets in United States history.”

Despite all the legal jargon, J&J does not really believe that this bankruptcy will last. However, it’s a means to try and push the $8.9 billion settlement to keep pressure on plaintiffs.
