Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc-related lawsuits definitively. In a quest to cover hundreds of years of American history, the firm argues that bankruptcy benefits all parties as it distributes settlement payments more evenly and effectively than trial courts, which are where litigants get significant payouts, while others are left with nothing.

Lawyers representing cancer patients who do not agree with the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole is not exempt the lawyers representing victims call it the largest “fraudulent transaction ever in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. It is however a method to try and push the $8.9 billion settlement through and maintain the pressure on plaintiffs.
