J&J’s defense group wants Ellis to be named to the position and again, but attorneys for the talc plaintiffs are protesting to the claim that Ellis has an unrelated conflict of interest which should stop her from being appointed to that post in the future. It’s hard to imagine an eventuality where J&J can push the settlements of baby powder through with these numbers. While J&J’s $8.5 billion offer might seem like a huge sum initially, it may not appear appealing after you calculate the figures. The proposed settlement based on our rough calculations – would not provide victims with much more than $100,000 per instance. That is not enough.
May 15, 2023 update: J&J could be facing lawsuit from an advocacy group that represents cancer patients. Is talc powder bad men. The group contends that J&J deliberately retracted an $61.5 billion funding agreement together with its parent company, LTL Management LLC, to simulate financial distress and confirm the unit’s Chapter 11 bankruptcy filing. The group argues that this act is equivalent to a fraudulent transfer of rights of victims’ compensation. They intend to investigate J&J’s actions in the wake of the dismissal of LTL’s first bankruptcy suit.
May 10 2023 Update: Next week next week, this week the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a petition to dismiss the second bankruptcy petition filed that was filed by J&J company LTL Management. This is the solution to resolve these claims for J&J. A baby powder settlement could be made. Is talc powder bad men. But it’ll need more money – billions of dollars – by Johnson & Johnson.
Lawyers are divided on whether or not to accept the plan and not all clients see the issue the same way their lawyer sees it. Second bankruptcy cases are bound to fail, and Judge Kaplan has scheduled a hearing for June to determine whether to discharge the bankruptcy for the 2nd time.
May 3 2023 Update The group of cancer victims suing Johnson & Johnson (J&J) demanded an order from they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt litigation over talc products. The committee representing talc claimants made a motion Tuesday, asking that the Third Circuit to consider their case and send it back the lower court with instructions to dismiss the bankruptcy. Is talc powder bad men. They also requested that the stoppage of tort litigation against J&J continue to proceed.
LTL filed for Chapter 11 protection once again following its bankruptcy filing that was denied in the Third Circuit earlier this year with a $8.9 billion agreement. The committee believes that the recent ruling which allowed LTL’s 2nd Chapter 11 to continue, while also halting trials against J&J is a reason for the immediate Third Circuit review. The US Trustee requested the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a formal response in the appeals court, characterizing the filing as a “desperate and legally deficient plan” by a handful of law firms with conflicting financial interests.
May 1 2023 Update: One most frequently asked question is how plaintiffs and their lawyers be able to turn down $8.9 billion. Of course, it’s a lot of money. But there are plenty of victims. Is talc powder bad men. They are a great claims for plaintiffs. We were reminded of this recently with two talc trials ended in large verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon led to an award in the amount of $18.1 million. A month later, another mesothelioma trial involving talc was held for trials at South Carolina and resulted in the verdict of $29 million in favor of plaintiff. Both cases were defended by Whittaker, Clark & Daniels Inc., one of the largest producers of talc in the U.S.
April 30 2023 Update: J&J initially attempted to pull the litigation over talcum powder into bankruptcy, they came with an offer to put aside $2 billion to settle the case. The sum was ridiculously low. There was no one among the talc victims who supported the proposal. This time around, however, J&J has increased the offer to $8.9 If the talc plaintiffs are willing to accept bankruptcy settlements and they also have the backing of a significant portion of the talc plaintiffs and their attorneys. Is talc powder bad men. However, 75% of talc plaintiffs, which is required for bankruptcy plan approval, it a tough road since there are so many lawyers with large collections of baby powder litigations opposed against the proposed settlement.
What are the solutions to the impasse? More billions.
April 25, 2023 Update: Talc patients have sought a court order to reject their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, insisting that the company is not financially strained. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Is talc powder bad men. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company was not eligible to receive bankruptcy relief because it failed to show financial trouble.
The claimants assert that LTL’s 2nd Chapter 11 case is an misuse of the bankruptcy system and that the case is being handled in bad faith. J&J asserts that the bankruptcy settlement is backed by “significant backing” from companies representing an estimated 60,000 people who are claiming. It’s fair to say plaintiffs’ lawyers and victims are divided over what they believe is an $8.9 billion offer for settlement.
April 21st, 2023 Update: A bankruptcy judge has decided that Johnson & Johnson must face new lawsuits claiming that the company sold baby powder that was contaminated and causing cancer. Even though trials for the lawsuits involving talc are delayed for at least 60 calendar days however, new lawsuits may be filed, and lawyers can begin preparing their cases. Is talc powder bad men. Judges expressed doubt about J&J’s ridiculous effort to revive its strategy with a second bankruptcy case.
April 13, 2023 update: the biggest announcement is an $8.9 billion over the course of 25 year period settlement offered. Lawyers representing cancer patients involved in the MDL class action have vowed to fight the settlement along with those who claim talc. Why? They think it is not enough for 70 000 cancer patients. Is talc powder bad men. They argue that J&J should negotiate a larger settlement or settle individual claims if the most recent bankruptcy is thrown out.
However, there is a second group of lawyers that is not part of the leadership of that class action. The lawyers collectively have accumulated hundreds of thousands of cases. The group is seeking to settle now for what is believed to be less than the victims deserve. Their argument appears to be twofold. First, they argue the settlement – about an average of $100,000 per plaintiff is fair.
It’s a difficult argument to argue. The second argument is more substance: the victims will be no longer patient and demand their money now.
April 12 2023 Update: Some people are seeking out how J&J can file for bankruptcy again. The answer is complex and complex. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future lawsuits involving talc conclusively. Also, it thinks it can get a lower rate should there be a bankruptcy component that applies pressure for a settlement. Is talc powder bad men. In a quest to cover the 400-year span of American history, the company argues that bankruptcy benefits all parties by distributing settlement payments more evenly and more efficiently than trial courts in which some litigants receive substantial award while others do not.
The gist of this 3rd Circuit decision was this isn’t a case that involves an enterprise that is profitable, forming subsidiaries to meet the legal burden and declare bankruptcy, which is what Congress thought of when drafting its Bankruptcy Code. However, it also stated it was not financially crisis because J&J promised unlimited funding.
So J&J jumped on the funding unlimited part of the deal and didn’t make any promises that it would provide unlimited funds for lawsuits. The company says that its modified financing arrangements with its subsidiary address the appeals court’s concerns while still offering funds to pay claims. It’s as if giving victims less money will solve the problem at hand.
Lawyers representing cancer patients who oppose the deal counter this with what you conclude is the legal argument. Is talc powder bad men. They counter with legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the largest “fraudulent move that has occurred in United States history.”
Despite the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way to push for this $8.9 billion settlement through and maintain the pressure on plaintiffs.
April 10 2023 update: Bloomberg is running an intriguing piece on a law that has been passed within New Jersey that is shedding new light on litigation funding in the class action lawsuit. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) concerning talc products in exchange for a share of any winnings. J&J is now offering to pay $8.9 billion in settlements for all lawsuits.
The funders’ involvement is made public because of an New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. The rule aims to address the growing calls for regulation of litigation funders. J&J is facing more than 60,000 claims when you add up federal and state baby powder lawsuits. Third-party financing in mass tort cases has pros and pros and. There is no doubt that we are seeing how third-party funding can level the playing field between individuals and big corporations in court.
April 4 2023 Update: It’s interesting to watch the worm turning in this litigation. J&J has taken another blow this week when it was found that the Third Circuit denied J&J’s request to continue the automatic stay while J&J appeals a bankruptcy ruling in the U.S. Supreme Court. It has stopped the cases of talcum powder in a number of years and stopped new lawsuits from being filed ever since J&J started the controversial process to spin the talc debts off into a bankrupt subsidiary more than a year in the past. Is talc powder bad men. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient only a few months back, the stay was removed. J&J had hoped to have it continue in the meantime of the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that for the Supreme Court is willing even to hear the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay in effect, the first new cases were filed and incorporated into the class action involving talcum powder MDL in just over a year. Seven new talc-related lawsuits were added to the MDL in the past month which brings the total number of cases pending to 37,522.
February 25 2023 Update: A Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) start an investigation into the amount J&J products containing talc have cost the government in the decades.
in a letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of failing to recognize the dangers of its talc product for decades while tax dollars were spent on treating people who suffered injuries from exposure to the products. The demand comes just weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
Is talc powder bad men. J&J should begin to make reasonable settlements to victims to in putting this behind it. This is a disgrace to one of the world’s greatest firms.
February 14 2023 Update: At a hearing today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
