This time around, however, J&J has increased the offer to $8.9 for talc-related plaintiffs if they accept a bankruptcy settlement and also has the backing of a significant section of the talc victims as well as their lawyers. Is talc powder safe. But with 75% of plaintiffs in the talc category, which is necessary for bankruptcy plan approval is not an easy task because of the number of lawyers who have huge collections of baby powder lawsuits that are opposed to the settlement.
What is the solution to this impasse? More billions.
April 25, 2023 update: Talc cancer claimants have asked a judge to dismiss the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, insisting that the company is not financially strained. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Is talc powder safe. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company wasn’t eligible for bankruptcy relief as it did not show financial trouble.
The plaintiffs argue that the second Chapter 11 case is an misuse of the bankruptcy system, and that it is being pursued in bad faith. April 13th, 2023: Update on the biggest story is that there’s an $8.9 billion over the next 25 years settlement offer. Lawyers representing cancer victims who are part of MDL class action MDL class action have promised to fight the settlement alongside Talc claimants. Why? They argue that it’s not enough money for those suffering from cancer who are 70,000. Is talc powder safe. The lawyers say that J&J should negotiate a bigger settlement or settle individuals’ claims if the current bankruptcy is declared unconstitutional.
But there is another set of lawyers who are not part of the leadership of this class action. These lawyers have collectively amassed many thousands of cases. The group is seeking to settle the case now for what many argue is far less than what these victims deserve. Their argument is two-fold. They argue that the settlement – which amounts to 100,000 dollars per plaintiff – is fair.
It’s a difficult argument to argue. But their second argument has more substance: the victims will be no longer patient and demand the money immediately.
April 12 2023 Update: Some people are asking how J&J could file for bankruptcy once more. The answer is complicated and complicated. Let’s try to clarify it simply.
Johnson & Johnson asserts that bankruptcy is the only way to address both present and future talc litigations in a definitive manner. That is, it believes that it will be less expensive when there is a bankruptcy component that applies pressure to settle. Is talc powder safe. In a quest to cover the 400-year span of American time, the business claims that bankruptcy benefits everyone by dispersing settlements more fairly and efficiently than trial courts, in which some litigants receive substantial payouts, while others are left with nothing.
The main thrust of this 3rd Circuit decision was this is not a case – the profit-making company that has subsidiaries to meet the legal liability and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code. However, the court also ruled it was not financially distress due to the fact that J&J promises unlimited funding.
So J&J jumped on the funding unlimited part of the deal but did not pledge to offer unlimited funding for the litigation. The company says that its updated financing arrangements with its subsidiary address the appeals court’s concerns while still offering claim payment funds. As if offering victims less money would solve the overall issue.
Attorneys representing cancer victims who oppose the agreement counter the agreement with what is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed: victims’ lawyers call it the largest “fraudulent move of assets in United States history.”
Despite all the legal jargon, J&J does not really believe that this bankruptcy will last. It is however a method to try and push the $8.9 billion settlement, and to keep pressure on plaintiffs.
April 10 2023 update: Bloomberg offers an informative article about a new law within New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) concerning talc products in exchange for a percentage of any settlements. J&J is now offering that it will pay $8.9 billion to settle lawsuits.
The involvement of the funders is publicly available due to the New Jersey court rule requiring the release of certain details about outside funding backers. This rule is intended to address the growing calls for regulation of litigation funders. J&J faces over 60,000 claims when you add up federal and state baby powder lawsuits. Third-party funding for mass tort lawsuits has its pros and pros and. However, there is no doubt that we are seeing how third-party funding can level the playing field between people and large corporations in the courtroom.
April 4 2023 Update: It’s pleasing to see the worm turning in this lawsuit. J&J suffered another setback this week, when the Third Circuit denied J&J’s request to keep the automatic stay in place as J&J appeals an appeal in the U.S. Supreme Court. Automatic stays have frozen thousands of talcum powder cases and stopped the filing of new lawsuits ever since J&J launched the controversial attempt to spin talc-related liabilities into a bankrupt entity over a year ago. Is talc powder safe. When the 3rd Circuit ruled that this bankruptcy was invalid a few months ago, the stay was removed. J&J was hoping to have it stayed in place until hearing the SCOTUS appeal. But the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that is that the Supreme Court is willing even to accept the appeal? Low.

Seven new talc lawsuits were joined to the MDL during the month of March, bringing the total number of cases pending to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee has now demanded that authorities from the U.S. Government Accountability Office (GAO) start an investigation to determine how much J&J products containing talc have cost the government over the decades.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the risks of its talc products for decades while tax dollars were spent treating those injured by exposure to the chemicals. The suit comes just a few days after J&J’s loss to the 3rd Circuit Court of Appeals.
Is talc powder safe. J&J needs to start making fair settlement offers to victims to begin in putting this behind it. It’s a mark on one of the top companies.
