The 3rd Circuit dismissed its first Chapter 11 case in January and said that the company wasn’t eligible for bankruptcy relief as it failed to show financial trouble.
The claimants argue that LTL’s Second Chapter 11 case is an abuse of the bankruptcy system and it’s being pursued in bad faith. It’s safe to say that plaintiffs’ lawyers and victims ‘ lawyers are divided on this $8.9 billion amount of settlement offered.
April 21st, 2023 Update: A bankruptcy judge has decided that Johnson & Johnson must face new lawsuits alleging that the company offered a baby powder with a contaminant that caused cancer. There is a different group of lawyers outside of the leadership in the class action. They have amassed many thousands of cases. This group wants to settle the case now with what they believe is lower than what the victims should be paid. Their argument is two-fold. The first is that they claim the settlement – about 100,000 dollars per plaintiff – is fair.
It’s a difficult argument to argue. The second argument is more substance: the victims will be no longer patient and demand their money today.

Johnson & Johnson asserts that bankruptcy is the only means to address both present and future lawsuits involving talc conclusively. In other words, it thinks it can get a lower rate should there be a bankruptcy element that creates pressure to negotiate a settlement. Is talc powder safe for face. Driving past hundreds of years of American past, the company asserts that bankruptcy benefits all parties as it distributes settlements more equally and effectively than trial courts, which are where litigants get significant payouts, while others are left with nothing.
The gist in the 3rd Circuit decision was this isn’t a case that involves an enterprise that is profitable, forming an affiliate to accept the legal responsibility and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. But it also said it was not in financial trouble because J&J offered unlimited financing.
This is why J&J took advantage of the funding unlimited part of the agreement but did not pledge to provide unlimited funding for lawsuits. The company claims that its new financing agreements with its subsidiary will address appeals court’s concerns, while supplying funds for claim payments. It’s as if giving victims less money will solve the problem at hand.
Attorneys representing cancer patients who are against the agreement argue the agreement with what is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole was not spared attorneys representing the victims claim it the biggest “fraudulent deal of assets in United States history.”

They exchanged for a percentage of any wins. J&J is now offering that it will pay $8.9 billion to settle lawsuits.
The funders’ involvement is made public because of an New Jersey court rule requiring the release of certain details about outside funding backers. The law is designed to respond to the increasing calls for regulation of the litigation funders. J&J has more than 60,000 claims when you combine state and federal infant powder litigation. Third-party funding of mass tort cases has both pros and cons. There is no doubt that we are seeing how third-party financing can help level the playing field between individual and big companies in the courtroom.
April 4 2023 Update: It’s interesting to watch the worm turning in this litigation. J&J was hit again this week when an appeals court in the Third Circuit denied J&J’s request to keep the automatic stay in place while J&J appeals an order granting bankruptcy before the U.S. Supreme Court. The automatic stay has halted hundreds of cases involving talcum powder and stopped new lawsuits from arising ever since J&J launched the controversial attempt to spin talc-related liabilities into a bankrupt subsidiary over one year ago. Is talc powder safe for face. When it was decided that the 3rd Circuit ruled that this bankruptcy was invalid a few months ago, the stay was revoked. February 25 2023 Update The following information is available: A Congressmen from Tennessee is now calling for The U.S. Government Accountability Office (GAO) launch an investigation to determine how much J&J products containing talc have cost the government in the decades.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the risks of its talc products for decades while tax dollars were spent on treating people who suffered injuries from exposure to the product. The suit comes just a few days after J&J’s significant loss in the 3rd Circuit Court of Appeals.
Is talc powder safe for face. J&J should begin to make fair settlement offers to victims, in order getting this behind. This is a blemish on one of the most prestigious firms.
