J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company plans to pay different kinds of cancer victims as part of a bankruptcy settlement. Lawyers representing cancer patients who do not agree with the agreement counter the agreement with what is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous decision. The hyperbole wasn’t spared by the victims’ lawyers, who call it the most significant “fraudulent move ever in United States history.”

Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. But it is a way to try and push the $8.9 billion settlement through and maintain the pressure on plaintiffs.

April 10 2023 update: Bloomberg has an interesting report on a brand new law within New Jersey that is shedding new light on the funding of litigation in the baby powder class action lawsuit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a portion of any profits. J&J is now willing the payment of $8.9 billion to settle lawsuits.

The involvement of the funders is made public due to an New Jersey court rule requiring the disclosure of certain information about funders outside the state. The law is designed to respond to the increasing calls for regulation of the litigation funders. J&J has to deal with more than 60,000 lawsuits when you include federal and state baby powder lawsuits. Third-party funding of mass tort cases has its pros and cons. However, there is no doubt that we are seeing how third-party funding can level the playing field between individuals as well as large corporations in the courtroom.
